Johnathan Lawson Construction, LLC, was contracted to build our house in Surgoinsville in December 2021. He promised (verbal and writing) to complete our house by 28 February, 2023, per the terms of our construction loan, but it was not completed until 13 October, 2023, and there are two Tennessee Residential Building Code violations that the he has not corrected. The first code violation is that the bathroom exhausts are vented into the attic. The contractor told me that that exhausting to the soffit vents in the attic was acceptable (and he's been doing it this way for 20 years) and refused to correct it until I called the state inspector who, in turn, called the contractor and told him to fix it. The builder"corrected" 2 of the bathroom exhausts but did not close the soffit vents immediately adjacent to the exhaust, which violates building code. In fact, they are installed the exhaust fans in the soffit vents and exhausted moisture and odors simply enter into the attic from the exhaust fans. One bathroom remains vented directly into the attic. This issue was identified to the contractor in the Fall of 2023. The second issue is that a couple of the exterior wall systems allow rain to enter into the stem wall and soak the cinder block from the top of the stem wall all the way to the concrete garage floor, in violation of Tennessee Building Code Chapter 14, Exterior Walls. These stem walls are approximately 9 ft high. As you can imagine,we're worried about mold, mildew and eventual structural problems. This issue was first identified to the contractor on 29 February, 2024. He has attempted to fix the issue 3 times without success and my most recent requests for solution have gone unanswered for 2 1/2 months.

    Customer response

    11/25/2024

I have filed a complaint with the Tennessee Department of Commerce and Insurance and the contractor has responded to that office regarding my complaint.  Since TDCI is an enforcement agency, I'll continue to work with them to resolve my issue, so please remove my BBB complaint.

    best regards,

    Lonny *****
