    I purchased a 2018 Dodge Journey two years ago with 4,500 down and proof of full coverage insurance. I have maintained payments, and even the times I had to be late, he gave 15 days before applying a late fee, as well as allowing another month payment to be due before even considering removal. Over the time ***** ***** has become more and more aggressive towards any contact I've had with him as well as making threats. I had my 4th son in February of this year, and it caused me to fall behind on a lot of things. My note became due on the 16th on May, 2022. I let ***** know I was going to be a little late due to just starting back to work from maternity leave. As usual that was fine because it was only one month of 435$ and he hadn't even started sending out late fees. I messaged ***** on the 9th of June letting him know I would be in the following morning with my note from May as well as the one for June in which wasn't due yet (Until the 16th). He stated that was fine, and that morning (June 10th) at 7:45 AM before his business even opens for the day he sent a tow truck. I followed with a call asking if I could come in and make the payments and get the car. He began yelling at me, so I handed my mother the phone and he told her "Out of 500 people he liked me the least, and the car was dirty and needed an oil change so he wasn't giving it back or allowing me the chance to redeem it" He then requested 14,000 dollars or said the car was gone. With all said and done several people contacted for me that know him well, and he let them know it wasn't about the money, it's "Simply because he doesn't like, or want to deal with me anymore" The car was 29,995 when I purchased and I have paid almost half of it off. I have 4 children, 2 of which have health conditions and go back and forth to appointments and he has took my money for 2 years to not allow me to continue to buy it due to how he feels, which isn't a reason to take a car away

    In response to Case # 17438, **** ***** purchased the 2018 Dodge Journey on July 16, 2020, for $19,995.

     

    **** ***** was late on every payment. She only came in to pay after multiple attempts on our part to contact her by text messages and many phone calls. When she did pay the payment, the next month would be due. After the 16th of each month **** ***** had 15 days before late fees appeared.

    When Longhorn Auto Sales contacted her, she would give times and dates that she would pay the amount owed. Then she would call days after the agreed amounts and dates and ask if she could pay a different amount on different dates. This would happen every time a payment was due. She would not keep her word. In results of not following through she was getting further behind. When she was told that she was behind she would become angry and non compliant.

    **** ***** was not threatened in any way. She signed a contract that had expectations to follow. On of those expectations was if payments were not made on time that would result in repossession. When the 2018 Dodge Journey was repossessed it was in extremely poor condition. She also signed and agreed to getting regular oil changes and did not comply. If oil changes are not done at least 3000 miles, it causes damage to the vehicle. The vehicles value is affected greatly when proper maintenance is not being don correctly.

    When the 2018 Dodge Journey was repossessed and returned to Longhorn Auto Sales I **** ***** inspected the vehicle and undermined that **** ***** needed to pay the amount owed on the contract because the vehicle was neglected.

    I **** ***** have owned Longhorn Auto Sales sin 1979. I am confidant that my decision to repossess the 2018 Journey from **** *****, was executed within the law and guidelines of the regulated agencies that cover the Motor Vehicle Buy Here Pay businesses
