I had surgery and planned to get a Labrador puppy from tI communicated to ****** that I could pay her extra for veterinary and food costs for keeping the dog up to 6 weeks after my surgery which took place 3/22. Prior to this arrangement I asked to see a copy of the contract in order to move forward. She emailed me a contract with terms that looked reasonable and I put $350 down for the puppy. She then sent me a new contract that was different from the first one, the second contract had a special provision clause that did cover veterinary and food costs but also included vague terminology of etc. This etc plus food and vet costs were to be build monthly. It was at this point, I decided not to move forward. I did not sign either contract as ****** was using the opportunity to milk me for more money. I explained my reasons and the fact my doctor advised against it right now (even sent the letter from my doctor) and asked for my deposit back.****** has made this entire situation a terrible mess! Shes lied, exaggerated truths for her own benefit shes admitted to doing, and denied refunding me despite not having a signed contract. Despite the contract stating the deposit is non refundable. That non refundable deposit is only in effect once the contract is signed which I did not do. She even lied to a police officer I called on her about this!I want nothing to do with this con artist and want my money back. I do not think she is licensed in ***** or with the **** and feel she should be investigated.

    Business response

    04/11/2023

I have been working with ************ since she responded to an AKC Marketplace ad for a female chocolate lab out of a litter born July 2022. The puppy had just sold. I believe that makes it September 2022. She and another gentleman waited for the litter born in February and I gave them both first pick of the puppies born in the current litter, before I marketed them. I sent numerous videos, photos and pictures and stayed in continuous touch. My guess is at least ****** hours have been spent on research, texts, phone calls and FaceTime calls with her in the last 7.5 months. But, I wanted to help her and I liked her.

She represented all along that she would not be able to pick up the puppy right away. We came up with a contingency plan all the way through 5 months, which left him here up to an additional 12 weeks, with her paying for his expenses, vet, shots and whatever else that might entail for 12 weeks. She was unsure if she wanted it kenneled in the kennel or kept in my home and trained. It was a grey area. We were on EXTREMELY friendly terms. No one can foresee 12 weeks ahead. We had been putting pieces of this in place for weeks to cover her recovery period.

Long story short, March 16, when ************ asked for a copy of a contract, we were still at a Pick Contract (clearly stating non refundable). I was going to take deposits on a PICK. So, I sent her a copy of the Pick Deposit Contract. The Pick to be made at a later date. She and the other gentlemen from 2022 were Pick 1 and Pick 2, Pick 3-7 would be sold. Labradors are often marketed this way and THAT is the contract she was sent. She then sent me a deposit, 3 days later, on March 19, stating "I would like to take Velvet", "I'd like to pay you more since you're holding him longer for me." (She was continuously offering me money to help me and my business.)

Once she picked a dog, and consequently the other gentleman picked a dog, we were no longer on a PICK CONTRACT. I had advised them that personalities develop after 6 weeks, but it was what it was. I put together our agreement for the dog she picked, now a deposit/purchase agreement and sent it to her. I outlined our agreement, told her it was cobbled together, because it was, I said I hoped it worked for her, leaving it open ended and asked if she had  ANY questions. I sent this on 3/23. Again, a very friendly and open relationship had developed. I expected feedback if she had any issues. That was the norm between us.

I continued to send photos of her dog to her and information while she was doing the expected recovery. This was all in the plan nothing has changed. Nothing different.

Suddenly, 19 days later and 19 days of not being able to market this puppy, she changes her mind. Not 5 days later...19 days later. Not a hint of discontent. Nothing. Just boom!

************ has known since day one that she would be recovering and would need months before bringing home her puppy. I was happy to work with her and chose to NOT charge her boarding fees, only for food. I have gone above and beyond to work with her, as I do with all of my clients. I am sorry she changed her mind. However, hanging her mind does not entitle her to a refund of a non refundable deposit. Not signing an agreement because you are in the hospital, does not get you out of the obligation.

I do not have a single complaint against me in 4 years of professional breeding. I have many, many references, anyone from this litter or any past litters, you are welcome to talk to.

You are also welcome to all of the AT&T text records of our conversations to confirm what I claim. Tell me how to get them to you. You have copies of the contracts.

As I told her, it is quite expensive housing a dog and marketing them. He will now have additional shots and additional care. The deposit is to protect breeders from incurring these extra unexpected expenses, in the event someone just changes their mind. It is not fair to the dog, who could be in a loving home right now, or to the breeder.

Slandering someone simply to get your way is against the law. I would like for this to go away for the unfair, malicious attack it obviously is, from someone who will go to any extreme to get her way. This is simply wrong on so many levels.

    Customer response

    Complaint: 19921422

I am rejecting this response because:

**************** has consistently misrepresented facts to deflect from her wrong doing in this situation.

****** seems to be hung up on the time spent with a potential customermyself and has exaggerated the amount of communication time shes spent with me. She has admitted the ****** hours were an exaggeration and have attached a screenshot of that claim below.

**************** had ever opportunity to not communicate with me and I never bombarded her with messages and questions like she claims. She is not a consultation business but a breeder who was communicating with a potential client.

I did not become ill until January, with official spine issues until February 2023 and a diagnosis in March. Prior to March I did inform ****** I wouldnt be able to move forward with a dog.

After Libertys litter was born I helped her name two of them and even introduced her to two of my friends who do web design as she wanted a website for her business.

**************** has been extremely disrespectful, rude, and combative since *** decided not to move forward with the puppy. She fails to realize that my decision not to move forward has nothing to do with my lack of love or commitment for ***** who I do love very much, but her business practices which I found dishonest. I refuse to give my money to individuals who are constantly trying to manipulate those in their weakest moments. I was incredibly disappointed in **************** and her attempts to bill me for erroneous fees I never agreed to.

I had asked ****** on more than one occasion if she wished to move forward with giving me a dog. To which she obliged! Ive attached a screenshot below.

**************** not once indicated the deposit was non refundable verbally or in our text messages. She had only stated this on the two contracts sent to me. The ones I never signed!

Im rejecting her response as its obvious **************** is not being truthful or reasonable in her statement. I gave her more than enough time to do the right thing and shes continued to disrespect me. I can only think to say there maybe prejudiced undertones as to why shes acting this way towards me.

    Regards,

This is harassment. One more piece of a multi-level attack she has wagered against me and this will be my final response. No more harassment.

This woman has lied to the banking industry and filed a false scam banking report against me. Luckily I have banked at my bank for 25 years and now the **************** is investigating her for fraudulent reporting.

She has filed a report with the American Kennel Club for heaven knows what made up violation she came up with to throw at them. My reputation immediately quashed that.

She promised me on 4/10 that I will lose everything over this. She is working hard to try to make that happen and working to make BBB her accomplice. Screenshots attached.

She has called the **************************** and  pleaded with them to call me, even though the officer explained to her repeatedly that this was civil and not criminal, she had him call me to harass me anyway. We had a chat about how not signing a contract that clearly stated it was non-refundable, then sending the deposit anyway, was STILL A CONTRACT in its own standing. Very nice officer and I appreciated his view.

She threatened to call the Secretary of State. I havent heard from them yet. I guess it is still coming.

She has filed a report with the BBB consisting of largely inaccurate inflammatory and defaming remarks. Funny, I had no idea what a help it would be to my business to have a BBB listing. I need to get accredited. Thank you for that.

This is an adult temper tantrum at not getting what she wants, whether right or wrong.

Each note becomes more and more extreme in its nature and now I have been publicly called a racist. I am done. Nothing could be more insulting to a military child raised in the worlds largest melting pot of color, religion and sexual preferences. All we saw was rank that differentiated us. Enough lies, insults and attacks against me and my business. No more.

    Paragraph by paragraph in response:
I have deflected no wrong doing, because there was none.

My admission of exaggeration was regarding one million questions, I said the number was exaggerated but not by much. She manipulates what I say. It is in my email of 4/10, not 4/7, as she is claiming. Copy provided.

I am not a consultation business. I do consult with clients daily. I am used as a consultant daily. I do not mind. I am happy to help where I can. This buyer used me as a consultant continuously. Would this dog make a good service dog? How large will this dog be? Are paws an indicator? The point is???

April 7, on the day that the Buyers dog turned 8 weeks old,and her final payment on him was due, (19 days after she paid her deposit on her dog), THAT is when she notified me she was not going to move forward with the dog. She claims in her earlier note here that it was on the day she received the contract 3/23, this is not true. A copy of her 4/7 email is attached here.

This Buyer did offer suggestions for puppy names. She also offered help with 2 of her friends to help me build a website. She offered to give me money and pay extra on several other occasions. Being an  accused thief, I never accepted any additional funds from her. That doesnt make much sense, does it?

I am glad that she finally admitted to the friendly nature of the relationship. This friendly relationship that carried on for months, was easy going and suddenly went very wrong on her side on 4/7 with no notice in between.  She became mean and angry, with attacks coming from every angle. Up until that point, she was asking for pictures, sending love to *****, talking about him Then SNAP!

I have had exactly 3 communications with the Buyer since she informed me she was walking away from her dog. I am including the 2 emails 4/7 and 4/10 and the one text 4/10, where I asked her not to contact me again. I will let you decide if I was ANY of the things (extremely disrespectful, rude,or combative) she accuses me of being.  The only fee the buyer was billed for was the remainder due on her dog.  $800 dog, $350 deposit paid, $450 due. She was billed $450. No surprises.

I am attaching the top part of the screenshot that the buyer sent you. She intentionally cropped it to look bad for me. You can see what it actually said in its entirety. I am not in a rush and you should not be eitherI dont want you to race into this... There was ZERO pressure on this Buyer to purchase a dog. Screenshot  provided.

The deposit contract she asked to look at says repeatedly. non refundable. She sent her deposit 3 days later. Choosing not to send back the agreement, but sending the deposit, doesnt get you out of the agreement, as pointed out by her policeman.Within 3 days of receiving either of them, she could have backed out. She could have talked to me at any time. ANY TIME. She waited 19 days to cancel. This accounts for more than 33% of the puppys life and my ability to market him. It accounts for 100% of the time I had the litter on the market. She 100%prevented me from selling him before the day the rest of the litter could leave to go home. As previously explained, this is what the deposit protects the breeder against. It covers the extra expenses explained.

The note accompanying the deposit contract, 3/23, is attached to the 3 pages of emails, page 3. Its intention to be discussed and remedied if needed is obvious. I assumed it was fine for 19 full days.
The Buyer was aware her deposit was non refundable. She paid it being fully aware it was non refundable. Then sat on it for almost 3 weeks and changed her mind. Not my problem or my fault. I did my due diligence and far beyond. FAB Kennel will not be refunding her deposit. In many circumstances,we would offer to hold the deposit for a future litter, but that is not the case here. We do not wish to have any future dealings with this particular Buyer, nor could we release a dog to be cared for by her in good conscience. Thank you.

I have a spotless and sparkling reputation for being excellent at what I do and working with my clients to help them above and beyond. I am easy to communicate with. I do not believe I have a single client that would tell you anything less than that, possibly many that would say much, much more.

    I am done here.

I will let my reputation stand. Thank you for your time. I am sorry it has been so horribly wasted, as has mine. This is only one arm of her attack. Pardon me while I go put out the rest of her fires she has set in my life, purely out of spite.

    Complaint: 19921422

I am rejecting this response because:

****** has continually attacked my character and is racist! Her stating Im throwing an adult temper tantrum for her deception shows how deplorable, and unethical she is!

Im retaining an attorney to deal with this womans disgusting and unscrupulous business practices.

There are no reviews for this womans so called reputation and should have taken that as a red flag! Ive also filed a claim with my bank. As stated she cant legally hold my money as there is nothing in writing outside of the contracts I never signed indicating the deposit is non refundable.

****** is hung up on the length of time she spoke to a customer on her own free will.

I would have not filed any complaints against herhad she not attempted to manipulate me out of more money than we agreed to.

Her novel length posts are a distraction from the obvious. If I didnt have a case, an attorney wouldnt be willing to reach out to her for my money. Now she will just end up paying more money in my legal fees on top of the amount owed.

At this stage I find ****** incredibly unwilling to accept any responsibility and will exercise my legal right! Continue to defame my character and she will have more problems than she dreamed as the feds are next!

    Regards,
