    This builder built our home in 2022 and was recently found guilty, fined, admitted his guilt, waived his right to a hearing, and paid the penalty to the Texas Department of Licensing and Regulation (TDLR) (we have the case number) for hiring an electrician to do the electrical work on our home who was not licensed by the TDLR as an Electrical Contractor in Texas. The electrician was only an Apprentice Electrician and did not hold a Master electrician license as required by law. We have a pending opened with the TDLR against a second electrician this builder hired after the Apprentice Electrician was jailed and could not complete the work on our home. This second electrician hired by our builder is in under investigation for not completing the work according to the current national electrical code, as required by law. Instead, our builder called the county and instructed this electrician to use the 2017 code. This was not the current national electrical code at the time. When we found this out, the builder had to send this electrician back out to our home under our warranty to bring our home up to the current code. In addition, the BBB's website states that BBB believes that consumer opinions, whether positive or negative, can be valuable information for the business and its prospective customers. BBB discourages businesses from using non-disparagement or confidentiality clauses in customer contracts to prohibit or penalize complaints or negative reviews filed with BBB or elsewhere. Using these clauses to stifle expression is contrary to BBBs vision of an ethical marketplace where buyers and sellers can trust each other. Businesses that do use them may find this information disclosed on their BBB Business Profile on BBB.org to inform the public of the practice. In addition, BBB Accredited Businesses cannot use these clauses consistent with their commitment to the BBB Accreditation Standards. A Dispute Publication Waiver was in our contract.

      McKay Vassaur Custom Builders has operated as a trusted and well-respected residential builder in ****** and ************* since 2008.  


      *****, McKay Vassaur Custom Builders regrets, however unintentionally, having failed to be in strict compliance with TDLR standards and requirements as they apply to the electrical work performed during the construction of your beautiful home.  As a business owner who places the utmost importance on the content of my character and operating a business that delivers a top-of-the-line product for our valued customers, I feel compelled to clarify the accuracy of events.


      That being said, after being presented with the issues, McKay Vassaur then contacted Burnet County (prevailing permitting entity) to confirm that we were in compliance having wired the home to the previous 2017 electrical code standards. Burnet County confirmed we were in compliance with their standards if we adhered to 2017 electrical code. This confirmation was sought after the issues in question arose........there was never any instruction made to our electrician to intentionally wire the home to a sub-standard level.


      Our clients (*****) then elevated the issue to TDLR (***************************** & Regulation). Upon receiving the **** complaint letter, we realized our primary error was our failure to ensure the electrician we employed to work on the home possessed the required credentials. The tradesman in question performs excellent work and is affiliated with a well-respected electrical company that has performed work in and around ****** for many years. However, personally and in business I have always operated under the principle that not being keenly aware of specific legal requirements is no excuse for non-compliance. McKay Vassaur Custom Builders elected to take full responsibility for the incident, employed the properly licensed and well-respected electrical company mentioned above to attend to the issues needing to be upgraded to 2021 *** Standards, and paid the TDLR-levied fine associated with the matter in full. There was never any jail time assigned to the original Apprentice Electrician in conjunction with this matter.  


      Since then, we have implemented stricter hiring practices and additional training to ensure that all our electricians meet the necessary qualifications and certifications. Our commitment to trust, transparency and repeat customers remains our highest priority.


      With regards to the verbiage in our contracts, we utilize a standard TAB (***************** of Builders) new home contract for our custom home builds. It does contain a Dispute Publication Waiver intended to prevent folks from publishing false, or as in this case, grossly exaggerated negative commentary about our business. McKay Vassaur Custom Builders absolutely makes mistakes, but we have never failed to take responsibility for those mistakes. We have always undertaken the actions necessary, no matter the cost, to ensure we have fulfilled our contractual obligations to the letter, and consistently perform over and above those obligations as a gesture of appreciation for our great customers. Our record in business since 2008 is a testament to that fact.

    My wife and I have been speaking with ****, the owner, for over a year and a half working through planning, ideas, and asking every question we could think of when building a home. Let me start by first saying that **** and his organization are world class! We spoke to and toured every home builder in the area, even speaking with builders from outside of the *** area, and let me tell you that the quality of our home, the speed in ****'s ability to answer questions, solve problems, and his knowledge have not only been amazing but truly a blessing to our family. His pride and attention to detail shines through every portion of our home. From start to finish, and even small things needing to be taken care of through warranty have been absolutely seamless. Probably one of the hardest things we dealt with when speaking to other builders was them taking the time to actually listen to what we were looking for, this is not the case with ****. He addressed all of our questions leaving zero doubts in our mind that we were always aligned. **** is undoubtedly one of the kindest, honest, and transparent people we have met, and his team is truly amazing. You would be doing yourself a huge disservice by not contacting McKay Vassaur Custom Builders for your home build or remodel. Thank you, ****, for building our dream home and making us feel like family from day one!
