A demand was sent to the American Arbitration Association requesting arbitration by my attorney. The demand has not been recorded or responded to within the 10 calendar days it promises.

This letter responds to your August 8, 2024, letter regarding the complaint *********************** submitted to the Better Business Bureau. Thank you for providing American Arbitration Association, **** (***) with the opportunity to respond. *** has moved **************** case to the next step of the case intake process. Nevertheless, if ************** wishes to withdraw her arbitration demand at this stage, *** will refund the filing fee she paid. As brief background, the *** is a not-for-profit 501(c)(3) organization founded in 1926. The *** is dedicated to fair, efficient, and economical methods of alternative dispute resolution, and it provides a broad range of dispute resolution services, including administering arbitration cases, through offices throughout ***************** and one office in *********. As to arbitration cases filed with it, *** is the neutral organization that administers the cases, and the arbitrators on those cases decide the parties claims and defenses. *** has requested the employers share of the filing fee so that *** can proceed with administration of **************** case under the *** Employment Arbitration Rules. Should ************** no longer wish to proceed with her arbitration demand, she or her attorney can advise ***s Employment Filing Team, and *** will refund her filing fee. Otherwise, upon receipt of the employers filing fee, *** will proceed with administering **************** case. Please let me know if you have any questions regarding this response. Very truly yours, ***********************

I was advised to use the American Arbitration Association as the result of a complaint against a former employer. Since beginning the arbitration process, the case manager had acted in a clear and biased way towards the former employer known as the respondent. The respondent's communications are answered and the case manager is refusing to answer any questions and communications I as the claimant have had about the policies and procedures of their practices. Theses are not neutral behaviors.

The American Arbitration Association is set up to help arbitrate cases. There have already been instances of negligence in the process. Example 1: Case manager contact information was incorrect.
Example 2: Case manager didn't acknowledge/address several parts of communications.
Example 3: ******* communications did not indicate email as preferred method of communication nor does any documentation of practices/procedures. It was only communicated after several attempts by claimant to reach case manager.
Example 4: Received multiple duplicate requests for same information.
How can this arbitration process be trusted or deemed competent when there are several examples of breakdown in process?

I was referred to them by a company they have a long relationship with. From the beginning I was provided with misinformation, conflicting information, and ignored. The *** claims to be neutral yet the process and procedures favor the respondents since they have a long established relationship and history. The case manager didn't even keep her contact information updated. **************** said one thing, case manager told me another, and the pro se team said something different. I saw more than one instance of arbitrators commenting on each other's performance on LinkedIn. How can the integrity and competence of this process be trust if basic information is not accurate, updated, and properly communicated.
