    On 3/12/2022 the company listed above sold a dog to me that was sick the following day I brought the dog in due to not eating lethargic and flimsy. They kept the dog in days and assured me that the dog was healthy and ready to go. The dog did not make it and unfortunately passed away. The original debt collector is asking for veterinary records stating that the dog was sick when called in to this company they have no record of me bringing the pet in when In fact I did the kennel supervisor who told me to bring her in said that she was seen by the vet there inside the store. The animals had a virus and she wasn't sure if that is what was wrong with the dog at the time. the sales person sold us a deal stating that we received free items from the store he had us shop around and said that he was giving us a credit to purchase items for the dog. looking over the receipt the items were in fact not credited but added to the bill and increased the overall purchase of the dog. these practices unfair and illegal they then sold us a dog that was not of the correct breed the dog was very small the dog when compared to real shitzu was small and not of the same characteristics. After doing my research this company has many lawsuits against them for unsafe and unfair practices and the selling of sick animals overpriced and then not following through with what there employees are selling to consumers. I plan to sick legal counsel against not the creditor and the original seller due to the discrepancies as a active duty solider if you are in military service, the Servicemembers Civil Relief Act (SCRA) limits the amount of interest you can be charged for certain loans or other obligations you took out prior to entry into active duty or while on active duty military service to 6 percent. I reached out to floor manager and said that the company would get back with me now I am stuck with a bill for a dead animal I am beyond upset and disgusted at the sales practices of this company.

    I have the documentation when I addressed this with the company they stated they had no record of me bringing the Puppy in before it passed away. Also the attached documents contain my private information to include my full ssn which I do not believe should be exposed. This was the document needed and I will forward this to the lender as proof that the dog was sick only two days after having her. I was not told what was wrong with the dog but I do know that they mentioned they had a viral infection in the kennels. Thank you for your response I will seek higher legal advice concerning this matter.

    Date of purchase: 04.07.2022 Amount of money: $6,176.54 Business: Petland Dallas, XXXXX Preston Rd, #1428, Dallas, TX XXXXX, XXX-XXX-XXXX Nature of Dispute: Warranties / Unethical sale Has business tried to resolve? Petland Dallas' solutions,pet refuses to stand behind warranties. They said "The surgery for the removal of the undescended testicles is covered by Petland Dallas under the neuter (Neuter is not $95 but $245 per Dr. ****) at Pet Vet Hospital only". I would like to understand why Petland Dallas took in a male puppy from Breeder Wayne ****** of Sugarcreek OH and Distributor Max A. **************** Canines of Fresno, OH who allow licenses to expire and reopen under new names when they have repeat violations. They sold Petland Dallas a male Shorkie in April 2022 with abdominal bilateral cryptorchidism (Cryptorchidism, a congenital genital defect in male dogs). Each were knowledgeable and understood this was a hereditary / congenital issue and all warranties would not be covered under replacement, or partial refund or full refund on puppy since you have to wait to see if they fall between 2-6 months of age. So the 14 day warranty does not help (nor does the 1 Year Warranty cover per their Solutions Team) in this type of situation. Petland Dallas' vet also knew this. When a first time pet owner purchases a pet from a pet store they have no idea that they are being told promises and information that is false. Our puppy is costing us well over $6,000.00 - unimaginable! Petland Dallas refuses to take puppy back, refund partial or in full. I wanted to breed to recoup some cost (and said as much with Hugo the Petland Dallas' Sales Associate and Dr. **** of Pet Vet) only to be told by Pet Vet that dog would pass ** ABC to any male dog born and since dog has no sign of testicles at over 4 months he is probably sterile. Unimaginable that this huge pet store chain is allowed to charge outrageous cost and not stand behind what all their websites state about warranties.

    Business Response /* (1000, 6, 2022/06/29) */ Petland Dallas provided Ms. ****** with the attached limited warranty to which she signed in acceptance of all terms and conditions. At the time of purchase, the customer was provided with up-to-date medical records and our limited health warranty and our lifetime puppy warranty. On June 13th Ms ****** contacted Solutions Pet to start a claim for a full refund of her puppy purchase price due to issues with Cryptorchidism. Ms. ****** expressed at the time it was her intention to breed to puppy and felt that she was deceived into purchasing a defective puppy. On June 16th Ms ****** was informed that her claim was denied for a refund. During the sales process, Ms ****** was provided with the daily health record, pet key, and the veterinarian health exam, which all noted that this puppy was bilateral cryptorchid. She received a copy of the Veterinarian Health Exam signed by Dr. **** stating that the puppy was bilateral cryptorchid. In Paragraph 6 of the Warranty it states " the puppy is provided solely for the purpose of a companion pet. There is no guarantee expressed or implied that you will be able to use this pet for showing or breeding purposes and breeding may void any lifetime coverage." Petland Dallas does cover the surgery for the removal of the undescended testicles during the neuter surgery at Pet Vet hospital only. Please also note that the breeder has had the same USDA license number since 2014. They have had no direct violations. The customer stated that they change their number to hide violations. There are more than one Wayne ****** who are breeders. This breeder is Wayne R ****** not Wayne A ******* Please see inspection reports for Wayne R ****** attached. I wanted to purchase my first pet ever, a female dog which would be 16 lbs at adulthood for hiking companion and apartment size; all shared with Hugo. He showed 3 dogs. I chose one. As he was completing paperwork Hugo came back and said, Oh sorry dog does not have balls. My response, what? I chose a female. He said I handed you a male with cryptorchid. What? This is my first time buying a pet and never heard of this. Hugo reassured me it would be fine. He said his balls would drop between 2-4 months our vet can tell you more. Plus, if it dosen't work out you have PETLANDS GUARANTEE OF LIFETIME. Return pet for refund, keep pet get half reimbursement and/or choose another oer. He said it was a win win. I was deceived from the start. I have been patienr, done my part. And yes, there are 2 Wayne ******'s but the Wayne R. ****** breeder who sold Petland dog knew it was defective and yes breeder has had numerous violations. Also, Petlands vet accepted dig "on the chance" his testicles would drop. Still no sugn at close to 5 months. Also, Petland vet said $95 fir neutering which is in contract is not valid because of cryptorchid. All around a deceptive sale to an innocent person. This is NOT resolved. I want help in coming to an agreement please.
