We had recently purchased a home from ******'s Homes, closing on the property on January 31st, 2022. From there, the business provided us a thirty day list for defects on the home. The list came and went, with two outstanding matters left opened, and the ******* conducting the oversight on the list's completion assured us they would be addressed at a latter time. As of time of writing, two matters still remain to be completed, with a third now developing. There is concrete work within the garage that must still be corrected, and per the contract of the home sale, blinds were meant to be installed. As the months rolled on, we have attempted to contact ****** Homes, with the lattermost contacts falling to to their voicemail and their company's ******************** both yielding no response from the homebuilder. The latest matter requiring attention is a leak in the guest bathroom, although to be fair, that did develop just this weekend. My only fear is that they will attempt to shy away from the matter, similar to just even making contact regarding status of the concrete work and the blinds. Lastly, we asked them to remove the microwave from the top of the stove, as it violated Fire Code, and despite promises that they would take it down, and that it needed to stay because "that was the plan for the house", we have had no other contact on the matter.Business response

Concrete work: Homeowner was told that as soon as concrete came available the work would be done. We contacted the concrete contractor and we need less than a yard to fix this issue which the concrete company will not sell a small amount of concrete to us. The ******* is aware of this and he knows that as soon as pours concrete near by he is to get this completed.
Blinds: ******************* does not have control over this. The supplier to this house, ordered a shipment of blinds just last week and is to arrive in 3 weeks. We dont know if the blinds for this house is in that shipment. The homeowner was provided with the contact information to the supplier so he can ask them directly for an update.

Purchased a new home build in **********.Signed a contract via docusign On February 25 and have multiple communications telling me to lock in a 75 day loan as house will be done by then (approx May 18)Per my contract, any questions to ensure scheduling delays should be via communicating. I did so. They dont replay. Have been trying to contact builder. Sent numerous emails, made phone calls was told they would ball back within one hour and NO call back. Get no return information so I drove from ********** to get answers.At the build site, agent said they could have the house done within a week if they wanted to but are stalling. My loan officer contacted seller. They faxed over a manipulated copy of the original signed contract. They sent in a copy of the contract they dated March 7 (10 days after the contract was signed by the us the buyers)( where they later added in blue pen a closing date of 6/13/22. This contract was manipulated with no addendum made to the contract or contacting us. We were not aware of this until this weekend when our loan officer contacted us. When we asked them they basically stated to bad that they are allowed to manipulate contracts and change dates at any time. and stated "laws are different than **********" . This delay is resulting in possible fees incurred by me as it goes past the closing date for my loan and no answers. I believe the buyers representative is being deceitful in their sales practices, the builder rep is not being forthcoming and they are taking advantage of us being out of state with no representation there. I have pictures of the original docusign and the manipulated one.Business response

Dear BBB,
The Complaint appears to misrepresent a purchase agreement signed by an individual Vs. a purchase agreement signed by "Both" parties i.e. an Executed Agreement. An executed agreement, should be signed by all parties.
In this instance the Buyer signed electronically the first docusign document. The other party, executing the agreement, signed in blue ink and filled in the blanks such as dates and names to formalize the agreement. The Executed agreement was then properly returned to the Buyer. It is not the responsibility of the Seller to monitor or involve themselves with Buyer' lock-in rates. The Buyer in this case may have a misunderstanding that the Seller has something to do with Buyer's lender, they do not.
It is recommended, the Buyer familiarizes themselves with the purchase agreement. The agreement states in paragraph 9. However, in any case, Seller shall have, at a minimum, 180 days from the date of commencement of construction for
substantial completion.Best,

I cannot get the builder to go correct the issues noted on Inspection Reports. My home inside is two tone, caulking on windows is cracked and messy. Retainer rock wall needs to be broken down and redone so that the cement can stay in place. You touch the rock wall and the cement comes out like water. My home is uphill and if that retainer wall continues to crack it is going to cause my home to shift putting us in danger. On some windows dirt keeps coming in and nothing has been done. They tell me a day and they cancel at the last minute or do not show up. Some of my walls have pimples, bumps and they refuse to fix that. I paid $246.000 I expect for all the imperfections to be fixed. I have four professional Inspections where all the above is noted.Business response

All Edwards Homes customers are given a warranty manual and a site portal to schedule or coordinate warranty repairs.
It is recommended the Complainant follow proper warranty request through the portal.

I completely understand that COVID put a halt on a lot of things and the market went through the roof. First I had countless issues, with dates on the house. Our realtor/seller's rep from ******'s was truly a nightmare to work with. I along with my lender and my realtor had to chase her constantly, extremely rude and lack customer service skills to say the least. Once I received my house it took 2-3 days to get my keys partially due to funding but I couldn't get anyone to answer the phone or get to the office to pick up my keys. I then received my keys on December 10th 2021. On December 31st it rained and my garage ceiling leaked to the point of popcorn falling and ruining a computer monitor as well as boxes of electronic and personal items. Again called them but no one answered the phones ever. I emailed and they said they and took over 2 months to get someone to come work on it. Currently still pending 30 day items to be fixed. No answer from ******'s.Business response

******'s Homes provides a limited warranty that covers construction defects with the home. Chapter 27 of the ***** Property Code covers, in detail, what qualifies as a construction defect. Edwards will continue to repair any and all qualifying warranty items. Pursuant to the terms of the contract, service request may be made through the portal. It is encouraged that all Home Buyers familiarize themselves with the limited warranty coverage.Initial Complaint

Deployed on active duty, completion of my new home in *******, ** is now almost 4 months overdue. Edwards served me with a $6k price increase a couple of months after signing, now we are close to completion and my agent called and said I have 72 hours to accept a $40k price increase if I dont want to lose this (my first) home and be homeless when I return to the US next week. My mother has POA on this transaction and has been repeatedly been following up on completion date, with limited feedback from Edwards Homes. I feel Edwards Homes are price gauging and blaming it on Covid, I already agreed to pay the $6k extra they asked for over my original contract signed, now I feel they are further taking advantage of me with an additional $40k ask when if they completed the construction as originally contracted I would have possession of the home 3 months ago. Can you please help me, keep the home I agreed to purchase without being held for a $40k ****** by Edwards Homes unreasonable demands?Business response

I am rejecting this response because:
Edwards Homes is not communicating with the 'Buyers Agent' either. There have been numerous attempts by our realtor to communicate with Edwards Homes on my behalf, and those communications are going unanswered also. As previously mentioned in my original complaint, my realtor told me that Edwards indicated in communication to her that I had received/would be receiving the amendment for the additional $40K ask with a deadline to accept it. As of 8:50am PT Friday 3/18/2022, I have still not received the amendment request from Edwards. I have also filed a complaint with the State Attorney General of ***** regarding this predatory price gauging, lack of communication, and delayed completion of this construction.Business response

Response to Rejection by Alleged Customer,
Customer's rejection response states:
1) "There have been numerous attempts by our realtor to communicate with Edwards Homes."
Answer: Pursuant to the Contract Terms all changes must be in writing and agreed to by all parties. Edwards does not show their are any unanswered communications by either the Customer or the Customers Realtor. Note that Customer did not include any communication attempts in their rejection.
2) "My realtor told me that Edwards indicated in communication to her that I had received/would be receiving the amendment for the additional $40K ask with a deadline to accept it. As of 8:50am PT Friday 3/18/2022, I have still not received the amendment request from Edwards.
Answer: Edwards does its best efforts in delivering Amendments in a timely manner. If the Customer has yet to receive the document then it is recommended the Customer's Realtor track down any the desired document.

I am rejecting this response because:
We have several email chains evidencing our follow *********** Edwards and their agents without response. I will not be furnishing copies of this correspondence in this forum at this time, as I know the email address *********************************************************** (among others) has been copied on almost all emails that have been sent, so Edwards does have these written requests in their corporate domain.To date we still have not received a fully executed copy of the last Amendment Edwards requested I sign.
I have also filed a complaint with the ***** Attorney General regarding this matter with Edwards Homes under the Deceptive Trade Practices Act.

This response is addressing the most recent rejection from the complaining party. Complaining party posed only one question on the most recent rejection. That is:
"To date we still have not received a fully executed copy of the last Amendment Edwards requested I sign."
Responses from Company: If in fact a an Amendment was executed by all parties, the ***** ********************** ("****") would require the Buyer's Broker/Agent deliver to Buyer all correspondence within two calendar days. This responsibility can be found on the **** website under ******************** Provisions Relating to the Requirements of Licensure ***** Broker Responsibility (j) A broker or supervisor delegated under subsection (e) of this section must respond to sponsored sales agents, clients, and license holders representing other parties in real estate transactions within two calendar days.
It is strongly recommended the Buyer (Complaining Party) contact their Representing Broker and request all missing documents.
