    I contracted services with owner *********************** on Aug 19, 2022. He was going to install iron fencing all around the back yard, 2 iron doors on each side of the house, a gate and railing in the front of the main entrance. The promised date of installation was mid-Sept (Sep 12). The total cost of the project was *****. I gave him a deposit in a form of check in the amount of $1200. A first part was installed later in September 30, 2022. Almost all the back yard and one side door was installed at that time. After finishing that part, he told me that they brought the wrong parts for the other side door and the front and that they&#**;re were going to go back to the shop and get them come back and finish the complete installation. Due to my job, I couldn&#**;t wait for them to do that so I paid him $2800 (check #****) for the whole project since I wasn&#**;t going to be around by the time they&#**;ve finished. Well, when I came back home and saw that he didn&#**;t finish the job as promised. From Oct 1st 2022 up to May 11, 2023 I have been calling and texting (I have all phone records and messages) him asking about my job. He answers the phone or responds to my texts but never follows through with his promised dates. I just want my job finished or my money back to find someone who can finish this kind of job.

    I have contacted ********************* and got an agreement to finish the work. I try to keep reaching her but wont answer me. Today June 27,2023, I went to her house but no one was home. I have all intentions to finish the work. I tried calling her but she didnt answer

     I am rejecting this response because: This isn't exactly true. He reached out to me saying that he had received my letter and that he wanted to finish the job. He agreed to come and finish on a certain day but he (again) didn't show up. I texted him and called him (I have phone records) he said that 'he came to the house' to get measurements again on what was pending but that I didn't answer. I work from home. I have my office in my residence. I'm here most of the time. So, even in the slightly chance that he did come by and I didn't answer the door as he claims, it wasn't on the day that we have agreed on.

    To be specific, on **** 20 he texted me at 10:31 apologizing for the extended delay and letting me know that if it was okay if he could finish the job 'next Tuesday' which was **** the 27.

    I responded, yes and that it was the last chance I was giving him if not, I was taking to Court.

    On Tue **** 27 he texted me at 8:06 "Today, we're going to your house with no further delay" . At 2:31 he texted me *******worker had an emergency and we couldn't go". "What's the design you wanted in the front so we can go just one day and finish everything the same day".

    I answered that I didn't remember what I picked (I remind you that I contracted him 11 months ago). I asked him to send some pics of what he was going to install or any photos of similar jobs he had already installed. After that we exchanged a few conversations of what was going to be done. I finished by saying when he would do the job...that I wanted it that week (it was a Tue). He agreed to finish the job (again) before the end of the week.

    Well today is Wed July 5 (7 days later) and he hasn't come or contacted me.

    This situation is just unbelievable of a business. I know it was my fault having paid in advance without verifying that the job was done as agreed. I did it in 'good faith' since I used his services/business due to a recommendation. 

    If he doesn't install my work by July 10. I'm suing him and taking him to court. Thanks
