Nov. 2023, I pd 1st of 3 pymts for the build of a shell home, for materials, but not to begin til Jan.2024. Instead of 4 wks to build, it was 7+ weeks. Longer it went, more problems arose. Several structural & others issues pointed out to builder were ignored: roof trusses in 2 pieces & not meeting walls, moldy wood for stair treads, wide gaps in siding - too wide for caulk to fix, gap btwn OSB *********** truss - so you can see through to the outside, missing bolts on foundation supports, are some issues ignored. ***** in front door, damaged fuse box from workers breaking into locked fuse box, cuts in ****** boards - resolved, but only when I insisted. Piles of scrap ***************** were left. I had to clean up. The breaking point: the work was done (except for replacing fuse box, front door, replacing 2 cut porch boards & to clean up scrap piles). I was told several times, for several days, the unused materials would be picked up/moved. A pile under my carport, leaving my 2 vehicles exposed. A hail storm came, damaging my vehicles. Builder agreed vehicle damage was due to materials not being moved when promised. A small amount was withheld from last pymt, while estimates were sought for actual damage ***s. Now, a month later, builder wants the *** withheld & is refusing to acknowledge liability for the damage. There's over $12,700 in vehicle damage, $6500 to have structural issues fixed & $5000 for cost of materials to fix orher issues. Only 3 days in the 7 weeks, was there a full crew of workers. Most days 1-3 men. These men were Hispanic & only spoke English or claim to understand when they were praised/thanked. Otherwise, they acted not to understand. Wirh issues every day, there should have been atleast one English speaking worker. The longer they were here, worse the quality became. Pointed out & discussed issues needing attention - I was told they'd be repaired/replaced/fixed, yet many problems still exist, ignored, left for me - someone disabled to fix.Business response

The customers list of complaints were addressed during the punchout stage. This is a normal stage of construction. We corrected any of the issues she mentioned before she would make out a check. If she had any structural issues or otherwise she would NOT have written a check for most of the final balance. At that time her only concern was the hail damage her vehicles had received. This damage was minimal and almost unnoticeable. Now there is supposedly structural issues and other things wrong. There are no structural problems presented in these images. Also no hail damage. Any minor issues that still existed could be resolved as part of our services, but when you do not pay the full Bill you do not get full service. The customer gave us permission to use the covered area for materials storage to keep it safe during our project. We even moved the structure for her free of charge. There is no time limit on materials getting picked up and we are not liable for damage to customer property due to acts of God.Customer response

I am rejecting this response because: the company's answer is ridiculous. Per the pictures, the hail damage is very apparent. The company is completely liable for the vehicle damage. Infact the company insisted that I get estimates for the damage.Issues with the structure were highlighted & pointed out to ********. I have text messages about the issues, stating they would be corrected & weren't. Pictures do not lie. I just spent $4200 correcting some of the issues, by another company. Everyday, the few workers that were on the premises, created more issues. I just wanted them gone.
This is not the 1st complaint made against Dillon Shell Homes regarding structural issues. Also, when I sent a letter regarding issues, to the address on proposal, the address does not exist. I had to research, to find an address for owner.

The customer has the company manager's direct contact information. No issues were brought up about structural problems. We corrected and replaced any potential structural issues during punchout. The claims of having to spend thousands on additional labor and materials to correct our product is unjustified. We left the customer with a sound product. Hail damage liability is the only concern she had upon project completion. This case is being brought to small claims court for Dillon Construction to collect final payment of $3,000 which the customer withheld against contract. Hopefully this will be resolved within ***** days.Customer response

I am rejecting this response because:
This reply, just as the 1st one (which took 3 requests to receive) is false. This last reply counterdicted their 1st reply. There had been a previous complaint for the same issues in structural nature. There is a great amount of proof that the issues were brought to the company's attention & issues were not corrected. Not to mention that the company's 1st reply said there was "no hail damage", yet no admit to to their being told/shown of it.

No one is saying the vehicles have not received any hail damage. The company is not responsible for hail damage or other acts of God. As for the claims of faulty workmanship, all issues were remedied during the punchout stage of build. It was part of the complaint that the roof trusses weren't sitting on the walls. This is not a truss built home, it's traditional stick frame build with a loft and support walls . Any true concerns for faulty workmanship should be confirmed by an inspector report. I am rejecting this response because: again, the company is back-peddling. Before they said there was no damage, but by the pictures; there is damage and they admitted to it. Attached are 2 pictures: 1 shows the wall studs don't go all the way to roof trusses (another picture of roof trusses not meeting wall, submitted prior). 1 shows the roof trusses don't touch/meet the middle roof beam.We have had a few major storms recently. The roof over the front door leaks. Pictures show wet ceiling and water dripping down front door, inside! I contacted builder & requested he send his roofer. His reply was to pay the $3000 & he'd send someone to fix it.
I had been waiting on them to file suit& serve me. Their prior reply said they had done that. False again. I never received a demand ltr or service. Following the reply on leak, I sent a 3rd demand letter (1st 2 refused) and said I would take legal action if they refused to comply. They finally filed May 14, 2024. This company has continually lied and when confronted changed their story. I hope no one hires this company. Thank you for your time and diligence in getting company to initially reply.

The customer did file a leak complaint , to which the company responded that if the contract was paid in full we could look at the roof under warranty. The customer then agreed to pay the remaining balance and mail it to the company. This was never received and the customer warranty is still VOID. The customer has been served and court date is set for the 18th of June. Any further resolution of this issue will be resolved in court.Customer response

I am rejecting this response because: I never agreed to pay the $3000. I stated that I had attempted to mail to them and the envelope was returned twice/refused, so I asked for the correct mailing address. *********** assumed it was a payment. A 3rd Demand Letter was sent. An Answer and a Counter-Claim has been filed.It is believed that Mr. ********************** has driven past my house several times, without stopping and attempting to discuss matter/issues.
