Advance payment was made in mid June with payment of $3,000. On July 16, a crew scarified and destructed the surface and expansion joints. On July 17th, the crew failed to show up nand e Area Manager said they were walking off of the job in its current stare of disrepair because I wanted to observe and watch the project.Since they have walked off of the project, I want the scarified surface and expansion joints to be restored to the previous condition prior to destruction, and fix the sprinkler head that I saw a worker kick over. I want a complete refund of my down payment, and $100 per day penalty for non use of the pool until it is restored to the predestruction condition where the poolis reusable. I also want the destruction dust and debris removed from the bottom of the pool from the destruction process.Business response

I have an Agreement in place that you walked off of the job without cause and kept my $3,000 deposit, and failed to respond for several weeks until BBB intervention, violating the Agreement and the agreed schedule, and a total "Breach of the Contract without cause of force majeure," or delayed schedule.
I have never authorized delay of the schedule, did not authorize "Walk off of the Job without Cause," or "Breach of Contract." The Agreement is in effect with Breach with purposeful failure to complete the Agreement.
Your crews caused significant damage to the surface, destruction of the expansion joints, washed slurry and debris directly into the swimming pool, contaminated the water, failed to remove loose pieces of previous Sundect that can be easily picked up with fingers with other hollow places of the previous applied Sundeck, and caused other collateral damage.
EXPECTATION:
1) I expect proper preparation of the damaged surface and removal of all loose previous applications of Sundeck and removal of hollow areas per application preperation documentation.
2) Proper scarification of the entire surface as described in the Sundeck literature for preparation.
3) Power wash without any slurry or debris washed directly into the swimming pool or plant beds.
3) Respect the owner's personal property and refrain from collateral damage, e.g. the irrigation system.
4) Finish the project expeditiously per the Agreement and accepted project schedule that was Breeched.
5) Writted copy of the warranty in effect.
Your most expeditious corrections and handling is expected immediately as you are far behind schedule causing significant inconvenience, stress, and loss of use.

Again, the crew walked off per instructions of the grossly incompetent ***********************. The project continues to be delayed with significant damage of about a quarter inch of concrete dust in the swimming pool. I told the workers to stop blowing all of the concrete dust into the swimming pool. This will cause significant damage to the swimming pool, pumps and filters.
The project is delayed again from the incompetent *********************** with loss of use during the summer season of about 1.5 mont od 3 months of summer (50%)
The crew has made unwanted scribed crack on most of the patio and pool deck. The texture is destroyed, the project is incomplete, and I have much damage to contend with the pool filter and equipment, incomplete project, and loss of use. because of the incompetence, deception, and weird moods of ************************ There is no place for mood or deception is business and construction.
I expect the following:
1) mistakes be corrected immediately without any more walk off or further delays (already 6 weeks delayed)
2) finish the project immediately
3) repair of any damage to swimming pool, it's equipment, required cleaning of the swimming pool from the concrete dust, and remuneration of lost water in the cleaning process
4) replace the incompetent *********************** with a competent person who will not allow further delays or problems, and knows what they are doing. She obviously does not! I can't deal with deception, incompetence, and her trying to take of advantage of the elderly person (elder abuse). She has a bad attitude, and her deception and lies are unacceptable.

There are five more items that I was promised would be taken care, but ATD Concrete will not respond and complete as follows:
1) The were to replace the brnd new Polaris filter bag that was dragging filled with concrete and snd had it weighted down.
2) Their workers broke the wheels on my barbecue set from mishandling it and unnecessarily moving it. The also did the same with my wrought iron patio table leg.
3) There is still cement debris In the filter rattling and wearing out the valve with vidio and audible.
4) There are still four former expansion joints that were forgotten to seal with mastic.
5) There is still significant sand and concrete in the pool being picked up in the Polaris debris and sand bag as the workers were nrglant nd blew all concrete, sand, and directly into the pool rather than sweeping it, removing it, and disposing of it. This cause significant damage to equipment and staining of the white plaster with clear cement stain lines and stains on the white plaster.
6) There are now steriel soil where the workers poured copious amounts of slurry in the flower beds. I removed most, but there are places with cement is stuck to the fence.
7) ***************************, owner, personally came over and did some cursory cleaning, and I respect his efforts, and even replaced a stolen extension cord. He is a good man who I have much respect. However the items listed above have not been addresses and are awaiting completion. There seems to be a big communications gap between the owner and his employees. The staff believe that if they close their eyes, the problems will be gone, thus they do not follow up on commitments. Again, the 6 items **** need to be completed. The project manager failed completely to oversee the project and quality resulting to negligent work, unnecessary damage, 7 week delay, and consequential damages that need to be remedied.

Well, I just want BBB to be aware that ********** has my direct number where we had communicated through out.
We replaced the pool filters in good faith even though the pool cleaning company told us they were dated and with old settlement, we still went ahead and replaced them. The pool got cleaned and treated, I had never heard about a Polaris bag, there was no cement in the pool and we raked around the perimeter of the pool deck to make sure all debris were disposed of.
As *********************** mentions, I personally did some additional clean up and asked him personally what was needed in order to be satisfied which we did, and asked him again if we had taken care of everything needed before I left, shook his hand and received final payment at the end of the day, I thought we were all Good.
Im only responding to this complaint jus to make BBB aware that ATD Concrete Coatings has made every effort to satisfy a customer, and if there is further issues that are going to be brought up after mentioned effort, then Im not sure what else I can do. I don't see the need for these claims to continue on when ************************ has direct contact with us.

I am rejecting this response because: The issues were nt completed or resolved. There is a communications issue between **** and his workers. I replied to his company
s survey with the list of uncompleted issues. Evidently he does not get the information about unresolved issues. **** is a great guy and interested in customer satisfaction, and personally came to my home. They did some clean-up, but the incomplete issues were not resolved. **** did leave me one of his used extension cord to replace the new extension cord that his crew stole. It is not new, but I did give me extension cord. The unresolved and incomplete issues are"
1) The Polaris bag has not been replaced as it ws full of cement and sand. It was 2 days old.
2) There are rocks in the valve. He had a video with sound of the rocks spinning in the valve taken by ****.
3) ******** pushed my barbecue grill sideways, and broke the wheels.
4) There are four more expansion joints that the crew neglected to put mastic.
5) There is one place where the nastic is bubbling up due to improperly laid surfacing. It needs to be fixed.
6) As per the original complaint, I still do not have a copy of the warranty.
7) ******** sprayed the foundation of my home toward the rear gate to match the resurfacing. It has cracked because of different expansion rates. This crack need to be repaired so water does not get into the crack which will cause breakage when it is freezing.
8) Although I have completed most of the cleaning of cement dust, debris, and sand, there is still a lot of debris ;eft in my flower beds where the crew dumped cement slurry and debris. It needs to be picked up and removed.
9) The Polaris still picks up sand and cement debris as the crew blew it all into the swimming pool.
10) The filtration system needs to be obtained and replaced because the previous was broken from all of the rocks and debris. The recently installed membranes and manifold were replaced in May and brand new.
NOTE: There was absolutely no supervision of the work crew or quality checks. The work crews were negligent, careless, and there is absolutely no excuse for the mess they made and left behind. Meanwhile, additional damage is being made with the filtration system with rocks in the control valve. I acknowledge that **** did replace the filter membranes which was encrusted with cement, but the manifold was left off because a replacement manifold was not available over the weekend. This manifold is crucial to be in the filtration system.
Additional Note: The filtration system is leaking since the membranes were replaced by ****. Still the manifold is missing.
The company has this information, but does not give it to ****, and the incomplete work and repair is ignored.
I want all 10 items above to be completed, or I will reverse my final payment of $3000, as I was promised that all of the work would be completed, but is ignored.

I personally walked with him and went over everything to make sure we were done. I pointed out that the joint work he talked about was not included and he agreed once I showed him the picture (attached) from before we started, there was never a discussion about the rest of the items and at the end of the day, after me asking several times if we were all good, to what he said yes, and even making his final payment later that day, that came in partially because it was entered wrong and corrected the following day, and not hearing from him for a couple of weeks through your portal, evidently there is a wrongful attempt to damage our company's reputation.
Attached are pictures of the condition of his pool and decking, a picture during the process where it shows how our crew covered the pool and surrounding areas, a picture of the pool filters full of algae from the green water that we still went ahead and replaced.
Honestly, I don't understand why he is submitting a claim when he could have contacted us directly, in my opinion, there is just something not right with this claim.

I am rejecting this response because:
I have called numerous times, however the people who answer the phone will not allow me to talk to ****, and they refuse to take a message.
The filter was gray with concrete dust, sand, pocks, and chunks of cement, not green algae! It was the rocks that broke the filter membrane.
Even today, there is sand and cement chips being sucked into the filter and pool sweep.
I am still removing chunks of cement and poured slurry from my plant beds.
The list of incomplete issues remain the same as my first notice of incomplete work and items broken.
It was not careless work, it was deliberate unsupervised work where the crews blew all of the cement and debris into the swimming pool. I asked them to stop, and they turned around and continued to deliberately blow sand, cement, rocks, chipped cement into the swimming pool.
The Polaris pool sweep bag was 2 days oldand destroyed from sucking up the sand and cement debis.
The crew moved my brick trim to the other side of the house for absolutely no reason.
The barbecue wheels are designed to go forward or backward, not sideway. They pushed it sideway which broke both wheels.
**** did give me a used extension cord for the same length of a brand new extension cord that the crew stole.
I do have great respect for ****, but there is a big disconnect between **** and his employees. The work crews were unsupervised and abused being unsupervised. It was more than careless, the consequential damages were deliberate. They also abused my hospitality and ignored my requests to stop blowing all of the debris into the pool. IT WAS VERY DELIBERATE!
I want the remaining items corrected, including the damage to the filter, pool, and plaster. I want a replacement bag for my new Polaris 280, and I want my barbeque wheels to be fixed. And I want the stoned removed from the valve. In addition, the filter leaks and the manifold is missing.
I will reverse the the final payment unless everything is corrected immediately. I erroneously assumed that all items would be completed, certainly by now. Again, I called several times for **** and listed the uncompleted work, but whoever answers the phone refuses to let me talk to **** and refuse to give him a message. The problem is not with ****, his entire workforce has a disconnect and are unsupervised.

I am rejecting this response because:
Please remember that I am a crime victim and sustained a broken back and Traumatic Brain Injury resulting is loss of short term memory, balance, nd coordination. Please call me as I cannot continue calling into your office. My short term memory does not allow me to remember calling to your office Thus, I must rely on written text.
Why won't your office people tell you that I called or take a message? This is neither standard business practices nor professional.
The bottom line is that there are some outstanding issues that have not been resolved, as previously itemized. The project must be completed, and I need to stop picking up from the unsupervised negligence. Again, the negligence was intentional by deliberately ignoring my instructions not to blow the cement dust and debris into the pool It was deliberate, covering the pool during scarification and tear-up of the scarification, and preparation. It was total disrespectful to the home owner. There would be absolutely no damage if the work crews had supervision, wore OSHA required respirators, and adhered to standard construction practices, which they did not. It was very improper that the work crew ignored my request to stop blowing all of the cement debris, sand, and concrete dust into the pool water. The worker turned around and continued blowing everything into the pool. They moved my yard pavestone, patio furniture, with absolutely no logical reason, and they pulled up the brick housing of the control valve brick vault. They poured slurry haphardlessly in the flowerbeds along with broken pieces of the surface. The vast majority of the cement debris and particles went directly into the pool. This cement dust and debris is very alkaline and caused discoloration of ******, and still remains on the pool equipment, diving board, and plants. They were not only negligent, but also extremely destructive. I have been working for days cleaning up the results of their unsupervised negligence, and there is more work discovered daily. My barbecue grill is not usable as I cannot move it with broken wheels. It is supposed to go forward or backward only, not forced sideways. I have remediated much of the damage, but there is much more to be addressed. Please remember that I am in recovery of a broken back and things are much harder for a 76 year old man.

1) I was satisfied with the promises of ****, the owner. He said he would have a crew to repair all of the damage, replace the Polaris pool sweet bag destroyed by all of the debris in the pool, repair the cement stain on the pool plaster, replace the broken barbeque grill, clean up all of the poured slurry in my planting beds, replace the broken parts in my pool filter from the cement debris deliberately put into the swimming pool, and clean up all of the cement slurry poured into the flower gardens, replace the items stolen by his crews, and correct all of the other damaged previously stated.
However, nothing was repaired, cleaned, or replaced as promised. They did not return at all despite the promises. **** gave me an unusable used extension cord for my brand new extension cord. Furthermore, there are many damaged parts of the coating that needs repair that are warrantable due to shoddy and negligent workmanship. They totally ignore my calls for repair the shoddy unprofessional workmanship as well as the promises.
2) I paid the final payment of $3,000 based on the promises of ****. I was duped into believing his promises. He is very convincing, but is akin to taking advantage of the elderly. This is an exploitation crime against the elderly. I admit that I fell for his promises and that I was exploited.
3) I don't have memory problems. I was a victim of Home Invasion where I was beaten, left for dead, unconscious lying on the floor for 3.5 days, and was beaten sustaining severe head trauma with multiple fractures to my skull. I don't have any memory issues. I will admit that I did succumb the the exploitation by ****, the owner. I was duped into believing his promises and duped into believing ****'s false promises taking full advantage of my trusting nature.
4) Again, absolutely no remediation has been done to fulfill ****'s promises to repair the damage they causes, replace the item they broke, stole, or repair the shoddy workmanship.
5) I have called into his office numerous times to complete the work, and requested that they leave a message for ****, however my calls were never returned. I remain totally ignored. And there is no remediation of any of the outstanding reparation. Obviously, they took the money and ran with absolutely not intention to finish the work repair or replace. There were many months that have passed where they could have come back to complete the work, but did not. And there were about 15 call to them, but the calls were not returned. Obviously, they have no intention to complete the work, repait their damage, or replace the items they stole. This is exploiting the elderly!

Miguel Sanchez, Area Manager, of ATD Concrete Coatings agreed to a signed and approved contract proposal to perform work on my pool deck ( per attached document ) and then would not schedule the job. Text messages sent to Miguel Sanchez on 10/13/2022 were not responded to as of 10/16/2022. Miguel agreed to do the work and resolution would be that he schedule and complete the job ASAP.Business response

The original proposal (attached) was sent back in September and it even show a note where it states that the customer wants to pay a certain amount, based on modification to size of the job. I'll get my lawyer involved in this, because is evident that this person doctored up a hand written proposal by typing over it when it was never agreed upon. ATD Claims they have a two year warranty for the work they perform. However multiple times their team has not shown up or were late. Their workmanship is very poor quality. Had in install late 2020, and have had problems ever since. massive cracking, overspray, chipping to a patio that does not get much traffic or a ton of sun. very disappointed with this experience. I am seeking a full refund for this poor job and experience and will hire another company to fix the poor work that was done.Business response

In any event, this was my response back in April 2021: Tony H******** replied on Google Apr 12, 2021 05:24 AM (PST) Since we spoke over the phone and we agreed to correct the problems, which we did the very next day, and where you were requesting a request and told me to think it over, the last thing I expected is for you to go straight to BBB and open a complaint. Needless to say, no refunds will be considered at this point. As mentioned, we made an attempt to make it right, and as mentioned, based on the customers reaction we were not in a position to proceed. Sorry this is not the same situation but a growing concern of your bad quality work. From the start Tony and his team did a **** job. Even Adam his tech that came out to my home yesterday admitted that its not common for a very small patio overlay to have so many issues. He stated that if they do something wrong they will come back and fix it. However i have made over 10 plus warranty claims in less then two years and still have a poor quality patio overlay. There is extensive crack, fading, missed areas of paint, chipping, and deterioration. This is a patio that does not get much traffic so the only impact is the Texas weather. Tony and his team told me this overlay would last 15 years and it has not even lasted 2. It is poor workmanship which I have told them from the start. Tony has no problem taking my money, but has no since of pride his business or the finished product. Lastly, i have filled numerous warranty tickets yet a warranty will not show up for months later. When dates are confirmed the appointments are missed. This has happened so many times now. Tony why don't you come to the home and look at the poor workmanship? If your not going to refund why not redo the entire job? Your tech even admitted it was done poorly. If not i request BBB to make sure that this complaint stays up to make sure that some else does not suffer my same fate. Thanks for your time. Business Response /* (4000, 9, 2022/09/06) */ Attached is the service ticket created on August 5th, 2022 when Mr ****** called it in, first time we've received any communication from Mr. Freeley since last complain submitted from him last year, to where BBB closed it due to resolution in ATD's favor.. On this ticket it shows where Adan submitted 2 hour of labor for the repair he did, to which it was done at no cost to Mr. ******. I spoke with Adan our service tech, and he said there were only minor repairs needed (pictures attached), and that he explained to Mr. ****** that they were cause by movement of the concrete, which we have no control over and is stated and our contract with Mr. ******, where it also states our 2 year warranty (not 15), same that we give every customer that we do work for. Adan also told me he stated to Mr. ****** on August 31st 2021, day Adan completed the repairs, that even the warranty would be up in November 2022, 2 years from original contract, that if there were minor repairs necessary after this expiration of the warranty, that he should be able to repair them at no cost to what Adan says that Mr. ****** was apreciative of it and also told Adan that he had plenty of paint for minor touch up if needed in te future and went on to take a picture of the polyurethane mastic that Adan used for part of the repairs. I feel strongly that we have comply with our responsibilities as the contractor, that our installation at Mr. ******'s home is done to standard where only minor touch ups have been required win originally installed in 2020. Therefore, I don't understand nor agree to any type of reimbursement, and vertically I don't understand the nature of this complain. The tech did come to my home however admitted that the chips and damages were do to poor workmanship not movement in the foundation. There is NO cracking in the foundation, however massive amounts of chipping in the overlay that ATD installed nearly 2 years ago. In fact Mr. Adam admitted this as well. Mr. Adan stated that it appears that the originally workers did not prep the area properly before putting the overlay down. I have photos and evidence to prove this as well and provided those to Mr. Adan. Surface cracking and chipping which has continued since the start of your installation. Mr. Adan even stated that he was not the one that did the initial work and said is was poorly done. Heavy amounts of fading, overspray, chipping, etc. These have been the same complaints i have provided to your company from day one. I have filed numerous complaints on your work and have come on deaf ear. Please re-review the complaints on google, BBB, yelp, facebook, etc that all reflect this as well. The patch work that Mr. Adan did this time was very bad. In one area where a large surface chip came up he did not even try to mold back into the same sharp. It looks like there was no interest of trying to getting the patch back to like kind and quality of the original work. Again just a reflection of bad business, bad service and bad warranty work. Again when reaching out to the company to start, i was told that the product would last 15 years before fading, chipping and deterioration. In reality the product failed from day one due to bad installation. Instead of showing pride in your work, you choose to try and argue and fight over bad workmanship. For BBB please make sure the public sees these complaints so no one else has to deal with this nonsense. Business Response /* (4000, 13, 2022/09/13) */ t this point the only thing I can offer is to visit with Mr. ****** at his residence along with Adan, our service tech, who has been with our company since 1997 and has read Mr. ******'s comments, and does not agree to any of his statements, nor that there is damage through out our installation. Again i have asked numerous times for the work to be redone or a refund and this has been declined. Adan has come to my home many times and has done repairs, however it does not fix the overall issue that the the overlay was not done correctly to start. We have a long list of chipping, cracks, overspray, underspray and heavy fading. all indications that the overlay was not installed correctly from the start. Adan agreed to this last time he was at my home and even stated yeah you probably are right and the made sure to say he was not the one that did the original work. The work performed at my home was not done correctly or i would not be sending warranty request and filing complaints. Its unfortunate y'all are not willing to address this. I have been asking for someone to look at the work since the time it was installed. yet y'all have declined and just have done small patch work here and there. I request BBB to make sure this is viewable to the public so others are aware of my experience. lastly you are always welcome to my home and i can show you the poor workmanship that was performed. On previous message Mr. ****** mentioned there is no cracking, now he is stating there are multiple cracks, Adan our tech states that there is nothing wrong with the coating and yet Mr. ****** is basically calling him a liar to which is an unacceptable statement since I personally know and have worked with Adam for over 25 years and never had this type of situation. I have had previously attached pictures and service ticket of our most recent service in correction to Mr. ****** statement that we have not been back to his property as he stated on his first statement of this claim. Clearly ATD does not want to take ownership for their bad workmanship. I have numerous photos of poor workmanship from The start of their job. And to blame it on a bad foundation or cracking of the foundation is just incorrect. If the owner is so certain why does he refuse to come to my home to look. It's because he knows he is wrong. The overlay has superficial cracking, chips, deterioration, fading, bubbling, warping, and overspray. It's really unfortunate a business needs to lie, disrespect a customer, and try to degrades one character just to cover their own bad workmanship.
