*** solicited a contract after Hurricane ***. I signed a contract with them in January of 2023 to pursue roof repairs with my insurance company ***. *** eventually went under and an additional settlement was never obtained. *** encouraged me to sue *** stating that I "only had two years from the original claim to do so." Numerous emails were sent to me from various *** employees in an effort to obtain my agreement to sue ***. In each of those an emails, my account was referenced as "N/A" since work was never initiated. Several times, pursuing legal action was discussed as being "optional." I chose not to pursue legal action against *** and let *** know my decision in June 2024. After the 24-month period since Hurricane *** expired in September, I received a bill from CMR for almost $4,000 citing "breach of contract" and trying to recoup "lost revenue." When I questioned why an invoice was never provided in the almost 2 years since the executed contract date, an explanation was not provided. I then asked for an itemized statement of charges and documentation of breach of contract but neither was provided. On 11/14/24, in accordance with the contract, I sent written notice of my cancellation of the contract to ***. At this time *** has not performed any construction to my property yet they continue to try to pursue a balance and breach of contract simply because I refused to pursue legal action against ***. I am not obligated to CMR as work was not performed to my property. I would like to receive written confirmation from *** acknowledging my termination of contract and releasing me from any obligation to their company.Business response

CMR has been more than willing to get on a call with the client and discuss. However, the customer has just completely ghosted CMR for the better part of a year. The reason the statute of limitations expired is because the client refused to respond. Instead, the client sent a cancellation letter but won't return any calls, emails, or texts. We have been attempting to get this resolved, but now we are discussing this on the BBB. The BBB complaint wasn't filed until we pursued the client legally and hired an attorney for collections. If the customer would like to resolve this then communication will be required.Customer response

I am rejecting this response because it does not meet my request for resolution.It is telling that instead of addressing the complaint request, the *** representative chooses to resort to name calling. That same attitude is what I have experienced via telephone and voicemail and precisely the reason I have requested contact in writing only.
To address the ghosting allegations:
I notified Austin ******** 6 months ago that I would not be pursuing legal action against UPC. UPC is an insolvent insurance company. At this point I considered my dealing with CMR complete.
Austin ******** confirmed that an account balance did not exist, and that legal action against UPC was optional.
I received multiple written communication from CMR over an 18-month period all referencing my account as N/A because work was never performed to my property.
Since making this complaint with BBB, the next correspondence I received from *** suddenly had a job number attached to it. A job doesnt exist as no work was ever performed on my property!
The first invoice requesting payment from CMR is dated 10/15/2024, which was 22 months after signing the contract and only after the time limit to pursue legal action against UPC expired (9/28/24). It has one line item on it for $3,645.16 with no further explanation of how they arrived at that figure. When I questioned the charges, I was told by ******* Golden that he didnt actually know why my account landed on his desk nor could he find a reason to validate it so he would have to get back to me.
It is important to note that there has not been any work performed on my property--Not by CMR or any other roofing company. Since receiving that invoice, I have requested an itemization of charges with dates of work performed and written documentation of the alleged breach of contract to be provided on multiple occasions. They have refused to provide either. I have had numerous conversations with CMR employees which have not resolved the issue, so I have now asked for all future communication to be in writing. I have sent written cancellation of the contract in accordance with the contract specifications to their office which they have also ignored.
CMR is preying upon homeowners in hurricane-stricken areas with questionable business practices. They lock customers into contracts with the promise to provide legal assistance for claims against insurance companies. But if the homeowner doesnt pursue legal action against their insurance carrier CMR then turns on the homeowner for breach of contract. If the homeowner actually contracts for work and pays CMR in advance, they dont complete the work. Either way, CMR wins, and the homeowner loses. It is a similar story over and over. My complaint joins over 200 others that have resulted in **** accreditation with BBB to be removed. As stated in the original complaint, I simply want to end any further contact from this company who has done absolutely no work to my property.

I am rejecting this response because:CMR has not provided the information requested. I asked for a detailed invoice showing dates and worked performed. I also requested evidence of breach of contract. Neither has been provided.
Meagan from CMR was notified via telephone on 12/30/24 around noon that the information still has not been provided. I have made several requests for these documents and they refuse to provide the information. It is a simple and reasonable request to be provided with the detailed information for which they are billing. Any legitimate business would have already provided it.

*** has provided the customer with a detailed invoice however, the customer is now requesting even further detail of the invoice which is not only unreasonable but outside of our normal processes and procedures. The customer was also provided with the contract and the language in the contract for the breach. this seems to be just another tactic and delay to resolve this issue. Attached is the invoice that was provided which shows one singular item without explanation of the work performed or charges incurred and when. As noted in the original complaint, work was never performed on my property and I know of no legitimate reason for this invoice. Again, *** is unable and unwilling to provide documentation of how they arrived at this figure. As noted on the invoice, a job number does not exist which substantiates that work was never performed on my property. It is clear that **** expectation is that a consumer would pay an invoice, with an amount of their random choosing, without any explanation of charges. This is not a normal or professional business practice and a significant concern.

I am rejecting this response because:Upon receipt of the original invoice, I immediately requested an explanation and itemization of charges. As I write this response, a detailed invoice explaining charges has still not been provided (despite 27 requests for this information -4 of which are in this BBB complaint). CMR's most recent response states, "There is really no argument other than the client doesn't feel CMR is owed anything for what was done." Work was never performed on my property, which begs the question: What exactly was done?
I suspect that their refusal to provide this information is due to their inability to substantiate the random amount for which they are trying to bill me. Since filing this complaint, *** has changed their story 4 times while mine has remained the same.
First, accusation of completely ghosted CMR for the better part of a year.
Next, CMR has provided all documentation to the client.
Then, Cmr has provided the customer with a detailed invoice.
And finally, only after I provide documentation that those statements are all false,
The client is being sent a revised document to review.
That is just within the scope of this complaint. Outside of this BBB complaint, I have received harassing texts, calls,voicemails, and emails from *** employees trying to get me to pay the invoice without questioning that no work was ever performed on my property. The icing on the cake here is that the most recent revised document that they refer to isnt even an explanation of charges. It is an invoice for $1,000.00.
Had this claim been legitimate, it would have been substantiated with documentation upon my first request. CMRs' refusal to explain charges on an invoice of almost $4,000.00, despite no performed work,numerous customer requests, and a ******************** complaint, tells me all I need to know about their business practices. Florida CHAPTER 489 CONTRACTING is intended to protect consumers from fraud by outlining industry regulations. House Bill 7125 established harsher penalties for fraudulent activities committed by contractors. **** continued pursuit of any amount from me, knowing that work they never performed work on my property, is intentional fraudulent billing.
It has never been CMR's intention to settle this amicably. They intended to force and coerce me to sue my insurance company to lock me into a bill with them. They created an erroneous invoice only after I notified them that I would not be pursuing that course of action. A few weeks later, they even went so far as to send me a message for a Black Friday discount if I paid it in full that day. They offered a 5% discount on an invoice for which they will not provide an itemization of charges to explain. Imagine that.
The original complaint clearly outlined the only amicable settlement I would accept. I want CMR to close my account as per my written cancellation notice, which is by the contract, and to not contact me further.

I paid CMR 17k for a new roof 2 months ago. They hung a permit on my house and its been two months with no roof and no projection of when I may get my roof. They just give me the runnaround with excuses.Business response

CMR and the client have been in constant communication. The issue was that we had back to back hurricanes at the same time as the project was submitted into production. We already had the roof scheduled for the week after Thanksgiving. The customer actually wanted to remove this complaint as there was just a misunderstanding on the timing. I want to protect everyone from this fraudulent company. CMR Construction & Roofing, LLC ******************************************************************** License # ***** | License # ***** Ive done two homes with them, and they pressured me into questionable practices, including possible insurance fraud, without delivering quality work. Within less than six months, both properties have serious issues: leaks, mold growing inside, and cheap materials used throughout. Im about to pursue legal action against them.This company only cares about collecting money from customers without providing real service or solutions. I know others are equally dissatisfied, and dealing with them has negatively impacted my health and well-being. Please dont let anyone refer you to this company. *** has addressed this multiple times. The leak that is on the ceiling is an old leak from before we started. We have investigated the leak two other times and there is no leak. We also have completed the roof and have been paid in full. We are even at the home today and the tenant is not answering the door for us to investigate the stain for the 3rd time. CMR makes roofing to my house after three years, the job is almost done so in the job scope is a 7x16' garage door which they do not want to install, they porposed to me give a 1500 usd credit by this jobn y call a garage door company and price to replace the door is ******** usd. i have paid CMR 90% of the job, by contratc i can retain 10% up to they honor the full job as per our contract, we keept 5621 USD to CMR a month ago the place a lien over my house by ********* usd.I want to get 100% or compensation to do the job ith others, i cant accept 1500 to replace the door.Awaiting for your opinion regarding this issue Best regardsBusiness response

The fundamental issue here is the representative who finalized the contract with the client assumed we were completing the entire scope of the approval. CMR is not a licensed garage door company. So therefore, there is a discrepancy in the garage door. The door the client currently has was installed under a previous code. The contract is for insurance proceeds. The insurance company paid for a like and kind door to what the client has. That amount was estimated at $1495. Which is why we offered $1500. CMR is willing to split the cost with the homeowner, but CMR cannot pay for the entire door as the insurance company didn’t approved nearly $5,000 for a door. The clients door is a standard white garage door and the client wants an upgraded rated Mocha custom door. We are willing to credit the homeowner $2,500 for the door and the final balance would have to be paid. We have been trying to settle this for months but have not received any calls back from the homeowner after we had to file the lien for non payment. We are ready willing and able to settle this amicably.Customer response

As you can see on the attachements, our door is mocha color, is hurricane impact garage door with motor driven, and as you said in your letter insurance claim include it to be replaced, nevertheless this door is included in the global sum contract where is not price by item, if you indicate in the contract price for every item everybody could see how much is the cost. so in this case you have to pay for a complete door instalation as we are satisfied, at this time we invoque COMPLETION term including in our contract, owner can withhold 10% of the total contrat should significant services be reuired after sustancial complexion of the project. From my side, has being demostrated the estimate e set to you mtach with the garage door installed, I see there is two alternatives CMR install the door as we have now, or pay me this money to complete the job as per estimated attaced.Awaiting for your answer to get a satisfactory solution ASAP

Unfortunately, the client doesn’t get to arbitrarily decide on the value of the items in the claim. Per both the insurance companies assessment and one by a third party hired by your attorney, valued the garage door at $1995. Your estimate was not for what you have but rather a top of the line door. You are also asking for a top of the line opener which also was not paid for in the claim. Again, CMR wants to get this resolved but we are not going to pay to upgrade your garage door and opener. You have a builder grade door. No windows in it, nothing special. A basic white garage door. So if you would like CMR to replace that door with one that is like kind and quality, we will do that, and it will be a white basic builder grade door, like what is there. Or you can take the $2000 credit that we are offering and put the upgraded door and opener on.Initial Complaint

I had a freequote done on May 23, 2023. It was determined by CMR that my roof needed to be replaced due to hurricane Ian ******* I filed an insurance claim with my insurance company and also contacted a lawyer to help me. **** estimate was $7*****. My insurance company sent out an adjuster and determined that would only allow $ ****** stating it only needed repairs not replacement. I consulted my lawyer who contacted *** and asked for a price now that construction materials were not as hard to find and the prices of materials lowered significantly. They said they would take $40,000.I called the customer service asking if they would do just the repairs and was told they do not do repairs only replacement, even thought their website states that they do repairs and replacement. In the interim, I had 2 other companies come out and give me quotes for repairs and or replacement. Both were significantly less money. Again I called *** and they would not do repairs. I then called the customer service representative and asked for a release from the contract, she said she would pass my request along. I never heard another word back and that was in June.I then had my lawyer call and they were told that they would release the contact but I had to pay the 25% of the quote. I personally called the *********** and spoke with someone that said they might lower it to $9,000, from $10,101. That was rejected by the owner and ** of the company. The ** called me and at first was pleasant, but then his demeanor changed. He actually accused me of trying to make money off my claim and that even if we did do the repairs my insurance company would make me replace it within the next year. I simply told him that I had no faith in his company and would like to move on. I also offered them $ ***** which they declined. The ** said the owner would not take anything less than the 25% and shouldnt have to.Business response

To clear up any questions, the last conversation prior to this response from CMR, my lawyer and I were told that *** was holding to their original amount of $10,101. However, since the latest response, I have spoken with **** and we have come to a mutual agreement. Once I receive the mutual agreement, with **** signature, this resolution will be completed.

I am rejecting this response because: Pursuant to the response left on the BBB, I contacted **** to advise him that I would accept the cancellation fee as stated in the BBB complaint. I requested an email to be sent to my attorney agreeing to settlement stated in the complaint, **** immediately responded he did not authorize the settlement stated and would not accept any amount other than the $10,150 he offered for all the work they have done. I could not understand all the work he has done comment when no roofing permits were pulled, no materials were ordered. **** ended the conversation stating he would only accept his settlement amount. I have attempted to contact *** on a few occasions since this conversation and have not received a response back. Also, my attorney has attempted to contact *** via email, text messages and phone for a mailing address in order for CMR to sign paperwork and *** has not responded to any of their attempts.Regards,

*** completed a new roof project on my residential property on 07/18/2023. It is currently under a 2 year warranty and has since started to leak in an area over the family room. *** had not received any leak notification up until this BBB complaint. Reached out to the homeowner to confirm just now and will have somebody there to investigate. What was not noted in the above complaint is that something has fallen on the roof and caused damage. I entered into a contract with CMR in March 2023 after ******************* knocked on my door, promising they could help me get an insurance claim and fix my roof. He assured me theyd connect me with a lawyer, and I signed the contract, trusting them. Fast forward 19 months, and although I now have a settlement check, this company has turned out to be an absolute nightmare. CMR is facing serious cash flow issues, which is evident not just from online reviews but from firsthand horror stories, like my neighbor who had to wait THREE YEARS to get her roof fixed.Now, after all this time, I'm trying to cancel the contract and am hit with the outrageous demand of a 25% cancellation feesomething ******************* conveniently FAILED to mention when I signed the contract. This is unethical, dishonest, and downright predatory. My insurance claim came to $26,000 (after a deductible of $6,800), and the quote CMR gave me was magically the exact amount needed$32,800. How convenient! This reeks of manipulation and deceit. To add insult to injury, Ive gotten 10 other quotes for the same work, all ranging between $17,000 and $21,000.CMR is now trying to squeeze $8,200 from mea hefty 25% of the $26,000 settlement and my deductible combinedjust for canceling. This is robbery, plain and simple. My goal now is to make sure no one else gets trapped by this sham of a company. CMR Construction and Roofing is a disgrace to the roofing industry, preying on people who can't afford such massive out-of-pocket expenses.DO NOT USE CMR CONSTRUCTION & ROOFING! Unfortunately, there is not much truth in this complaint. The customer signed a contract with CMR for insurance proceeds plus the deductible. It is on the contract very clearly that the deductible of $6,200 is owed from the client. Furthermore, after talking with the client today, CMR in no way did anything wrong to the client to prompt the cancellation. She stated that the reason for her cancelling was because she had interior items she needed done as well and could not afford to pay her deductible. She also said that her neighbor told her not to use CMR. After reviewing the notes, the customer never had anything negative to say to or about CMR until there was a settlement. The statements made by the client are not only false but they are slanderous in nature. Even this week, CMR attempted to assist the client to build the roof still and allow her to use the deductible for the interior and she decided with the branch manager of that office to cancel and pay the cancellation. The client also agreed to the cancellation amount on the phone and agreed to sign a mutual release. This complaint comes not only as a shock based on the interaction agreeing to a settlement but also is not a fair representation of CMR and is an attempt to slander the company's image on a public forum. We would ask that this complaint is removed in its entirety based on the basis that CMR has not violated any BBB standards in this complaint.Customer response

Nothing I said is slanderous because I believe it to be true. From my perspective, CMRs actions appear unethical, dishonest, and potentially predatory because the cost of their work is higher than the industry standard, as mentioned in my original comment. I received estimates from several roofers, and they were all $10,000 to $12,000 cheaper. They also fail to EXPLICITLY and VERBALLY mention the cancellation fee which is buried in the small print of the contract and the fact that the quote to fix my roof happens to match the settlement is what has led me to my perception of the company.
I also agreed to cancel and pay the fee because I wanted to be done with CMR, especially since they were unwilling to negotiate the cancellation fee when I asked. Forums such as this (BBB) were created for customers like me to share their experiences with accredited businesses, and that's exactly what I did.
Obviously, we will have different interactions with businesses, which is exactly what prompts negotiations. As I stated, my attempts to negotiate were unsuccessful, so here I am on a public forum expressing my views on our interaction, just as CMR is free to do the same.
CMR claims they worked the file and are entitled to $8,200, but I cant recall CMR doing much, if anything at all. They connected me with the lawyer..so I am willing to pay a fee but I l find it unreasonable for them to expect a percentage of the settlement, including the deductible.
Before writing my review, I took the time to read a good portion of over 300 comments left by other customers across several platforms.I find it hard to believe that over 300 people woke up with the intention of slandering a business that was only seeking to do right by them.
I am not here to deny that there was a contractobviously,there was one. I am here to warn future customers to read the contract carefully by sharing what they can expect if they dont, which is exactly what you accused me of not doingreading the contract.
To add insult to injury, a director called me and threatened to sue me for expressing my views unless I removed this review. That is a very disappointing and bullying tactic.

Two and a half years ago I got a knock on my front door by a young man soliciting business for CMR Roofing. He explained that we had a tornado in the area a few months ago and he would like to inspect our roof for damage. After a brief inspection he advised that we would be able to have our roof replaced. after two and a half years, CMR has done exactly nothing for us and now at settlement time they want 25% of the settlement to let me out of the contract. They have done NOTHING for us since we signed the contract. They began by seeking $135,000 for a new roof. Now they say they will finish the job for $71,000.I have found another roofing company that will do the job for $43,750. the amount of my settlement is $56,299. CMR has slow walked this process and been unresponsive until now. I don't want to do business with CMR. Their reputation in this community is terrible and I feel they are being unreasonable in their pricing and the amount they are requesting to let me out of the contract.Business response

CMR contacted me Immediately after receiving my complaint and in a very pleasant phone call the Director of Operations resolved the problem in seconds. I am now very pleased with the outcome. It seems as though CMR is striving to make a comeback!

I am rejecting this response because:Nice guy called me and wanted me to drop the bbb dispute. Told me if I paid for the material he could have my roof done in 60 days. I told him I think that should work. Before he hung up I asked him if I could call or text the number to get a hold of him. He said yes. Preferably text because hes in meetings and busy but that should work. Well I talk to my husband and he had a few more questions and so far no response. Tomorrow will be the fourth day. Seems like waiting is all I do with these people.

Here was a little miscommunication and the customer was texting the wrong number. We communicated today and we are good to go. All questions have been resolved.
