Iconic Construction, LLC. Tax ID: ***********. Owned by **** and ******************************FAILED TO PERFORM OR COMPLETE FULL REMODEL OF OUR PROPERTY BY THE **** SPECIFIED (12 WEEKS) ON OUR AGREEMENT.-TAKING THE LARGE SUM OF $55,143.66 PAID TO THEM TO PERFORM SAID SERVICES AND NOT TAKING RESPONSIBILITY OR REFUNDING THE MONEY EVEN AFTER ADMITTING THEIR NON PERFORMANCE VIA TEXT MESSAGE AND AUDIO RECORDING OF OUR CALLS.OUR AGREEMENT EXPIRED ON MAY 19, 2022 AND BY JUNE 13TH, 2022 *************************** STATED THAT HE WAS AWARE THAT HIM AND HIS BROTHER HAVE NOT PERFORMED AND THAT HE WAS AWARE THAT THEY WERE MAKING ** LOSE MONEY. *************************** ALSO ADMITTED THAT THEY HAD RUN OUT OF THE MONEY WE GAVE THEM. OVER FIVE MONTHS LATER OF THE EXPIRATION OF SAID CONTRACT, ******************************* AND MR. ***************************** HAVE NOT CONTACTED ** OR RESPONDED TO OUR CONTACT ATTEMPTS, NOR PAID OR HAD THE INTENTION TO TAKE RESPONSIBILITY OF THEIR ACTIONS AND CONTINUING TO ADVERTISE AND RUN THEIR BUSINESS AS USUAL. AFTER OUR INCONVENIENCE WITH THEM, WE FOUND THAT *************************** HAS A CRIMINAL BACKGROUND FOR THEFT AND HE HAS BEEN ARRESTED MULTIPLE ****S FOR THE SAME REASON. AFTER TAKING OUR MONEY, **** WENT TO BUY A BRAND NEW TRUCK, AND BOTH ***** AND **** TOOK ALL THEIR FAMILY TO A VACATION IN ******, ***. THE BROTHERS ALSO LIED ABOUT BEING LICENSED CONTRACTORS AND ABOUT HAVING A LICENSED ELECTRICIAN WORKING IN OUR HOUSE, FOR WHICH WE ALREDY SEND OUR COMPLAINT TO TDLR. -FALSE ADVERTISEMENT; USING FALSE STATEMENTS ABOUT THEIR extensive experience USING FALSE PICTURES TO ADVERTISE THEM AS THEIR WORK, ****** AND MISLEADING THE CONSUMER ABOUT THEIR SERVICES ON THEIR OFFICIAL WEB PAGE, iconicconstruction.godaddysites.com (which they closed after finding out about our complaint but I have proof). They took over $55k and I had to pay over $70k to other contractors and licensed electrician to come and fix all their wrong work done and finished the work.Business response

Good afternoon!
There are multiple false accusations and statements in the complaint as well as irrelevant personal statements which I will address. It is correct we did not complete the project in the 12 week period but customer also made changes to the project throughout the process which delayed the project. It was not all the customers fault, we also got very short handed a few weeks in to the project while also working another project at the time which the customer was made aware of. We understand the customer is asking for a full refund of $55,143.66, but that is not possible. A bulk of the work was completed such as old wiring was replaced, Sheetrock was cut throughout and reinstalled, desk was built, all interior and exterior demo, house was wrapped, kitchen cabinets installed, island was built, island and island cabinets were painted, custom microwave/oven combo cabinet was built, all windows were replaced along with reframing, chimney was reframed and tiled and grouted, guest shower installed, framing for master bath was started and new water lines installed(was later removed) whole house was textured and had begun painting, holes for recessed lighting were cut out on interior and exterior, and guest bathroom shelves were built. Customer visited the project site daily and never complained about work that was done and if something was misunderstood we addressed it. We never walked off the job site and stopped work and finances were never the issue. Last we heard from customer they said they were getting estimates from other contractors and would send them to us to get our opinion but we never received any and noticed job was completed online by realtors selling the property. Customer recently confronted us in public after not hearing from them demanding a full refund. The same day we received a message from customer making false statements about us. Yes we are continuing to advertise and run our business, we are not planning on stopping business and to provide for our families because of a inconvenience and problem we had with a customer. ******** also made accusations claiming one of the owners has a criminal record for theft and that he has been arrested multiple times for this reason. That information is all false and irrelevant. Neither owner has a criminal record. Customer states that one of the owners bought a brand new truck and that owners went on vacation with the family, and customer also messaged one of the owners saying she hoped one of the owners children had a great birthday and called the child by name which was never shared with the customer as well as the birthday. The owner she states purchased a new vehicle is true but the owner also is employed with another company and the purchase of the vehicle is in no way connected with this project. This is personal information which was never shared with the customer and neither owner has the customer in social media, and we find the fact that the customer knows this information to be threatening due to the fact that the customer would have to be stalking or cyberstalking owners for this information. We also find all these statements irrelevant to the project. Customer accused owners of claiming to be licensed contractors which is false. We never claimed to be licensed we only claimed to have a LLC. And that we were insured. Customer states we never had a licensed electrician work on the home. We hired a licensed electrical contractor which later in the project stopped responding and we later found out never pulled a permit. Exterior panel was never replaced due to this reason. Customer accuses the business of false advertising and having fake pictures on website. The pictures on the website are background pictures and templates provided when creating a website. We never claimed any of the pictures to be ours or our work. The only work we claim is on social media and we make it clear. Website was not removed due to complaint, website was removed due to not needing website. Lastly customer claims to have paid over $70,000 to fix our work and finish. As we all know there are many different contractors and all of them work different and it often comes down to matter of opinion to how work is completed. As stated above a bulk of the project was completed and most the work we performed still remains in the property. Our company never walked off the project and never stated we would not finish the project and would have still finished it if customer asked, customer chose to find a different contractor which is completely fine. We dont find being demanded a full refund is at all reasonable after the customer finished the project and used most of our work. but we do truly apologize for all the inconvenience we may have caused.Customer response

I am rejecting this response because:The response received was mostly false. We did not make changes that delayed the project, everything was talked since the walkthrough before hiring them but ***************************** will not take notes and will keep forgetting (I have proof of that). The only change we made was the siding which it worked at everyones advantage because we first decided to put stucco instead of siding and later on we decided FTMO go with siding which is easier, faster and cheaper to work with and ***** even mentioned that when we brought it to his attention. Nothing was done to the outside when we decided to go with siding instead of stucco so I dont see how that is a delay according to them. As far as we requesting full refund is also false and you can see that on our notice of cancellation letter. I never said that they didnt do any work on the property, I said that it was not completed and most of it was wrong which was brought to their attention when they were still having contact with us. The master bathroom was framed (like ********************** stated) wrong and it was brought to their attention since day one because they didnt do what was requested since the beginning and we did have an altercation for that. It was never fixed and all of the other contractors that came to see the house saw brought it to our attention and it had to be re-done COMPLETELY. Not only that but the new contractors found that the plumbing was so old that was coming apart and they had to replace the plumbing from the master bathroom all the way to the kitchen. As far as the wiring, it was also brought to their attention that it was done wrong by their non-license individual. The only place where there was no problem with the new wiring was on the guest bathroom, desk and the bedroom next to it. Other than that there was non working outlets and light switches, there was even a light switch connected with an outlet on the ** area where in order to have the ** (or whatever will be plugged in there) on, the light connected to that outlet needed to be on for it to function. This is just an example of the issues and since there was wiring everywhere and not labeled it was nearly impossible to find where each cable came from. There was also the wrong cable installed for the kind of appliances that we had. As you can see most of the wiring needed to be re-done. I had to hire a LICENSED electrician to do the work with required permit on place.
******************** is stating that never heard from us when we did tried to settle this situation and we did attempt to hear from them which they ignored. All of the information I have provided is public records and of course we will investigate as much as we can for evidence purposes. I have their workers testimony complaining about them which I will use if needed in case of a court. I have tried to settle this situation the best, easiest and cheapest way possible and they have not responded. I did came across *************************** at a local restaurant and I tried to talk to him and requested him to come to an agreement with us for what he responded that he does not care and that his criminal background doesnt matter. Yes, he does have a criminal background for theft even though they are trying to deny it. We are not requesting all of the money back but we are requesting the majority because just for the amount of wor they did they owe us about $35k of missing work, plus all the work that had to be fixed and re-done starting with electrical work, plus our contract stated that you will have to reduce $50 PER EACH DAY LATE of non completing the job. If you do that math it self thats already over $45k, plus I had to pay over $70k total to finish the work and all the financial distress that they put my family on and all the time spend. I cant believe they even try to lie about all this in public when they know that I have all the evidence in a form of text messages, recorded call from *************************** (the criminal) admitting that they did not performed and that they owe us a lot of money. I also have the pictures and videos. If they admitted here in this complaint that they didnt finish the work and that they were at fault, how come they havent answered to any of our attempts to settle this and come to an agreement with us. They havent even bothered. I also have the testimony of two of their previous employers which I will not name here unless we end up going to court and I will call them to testify.
you did claimed that *************************** was a licensed electrician when he is just an apprentice electrician (I also have proof of that).
you did mentioned to be a licensed contractor when you are not.
And I can keep going on with your lies. I have all the proof with dates and you know that.
if you know your lying and I have all the proof, then lets do this right and in the best way possible. Im requesting $50k refund, if we go to court you will end up having to pay over $100k in legal fees and attorney fees which you will be entitled to pay.

There was some changes made that did have some effect on the timeframe. A few examples are installing tile onto chimney, changing location of lighting multiple times in master bath, building custom cabinet. These were things not discussed from the beginning. As previously stated not all the time restraints was their fault, there were unforeseen circumstances that nobody could control such as employees leaving town without notice and leaving us short handed which was mentioned to the customers. As stated in their last response they are asking for a 50k refund which about a 90% refund. This is very unreasonable after a bulk of project was performed, materials were purchased, labor was paid, etc. we understand it was not completed but we never stated we would not be completing their project, yes there were delays but we were still going to complete the project. Customer decided they wanted to go a different route and have somebody else complete the project which is fine. The only part of the project they said was done wrong when we were still on the project was the shower framing everything else was addressed and fixed. The shower framing was set for a few days before customer brought their issue to our attention and customers were at the property daily and saw the framing on the first day we installed. We discussed just building a walk in shower with tile and glass shower door. Nothing else was discussed and agreed to when project begun. Replacing old water lines was never something that was discussed. Electrical work was not completed and we had power shut off in the home, so wiring could not be tested yet and checked so adjustments were not yet made. After customer made decision to not have us continue they stated they were going to request estimates from other contractors and would send us the estimates they received for our opinion and if we could help pay for it or complete the work ourselves but we never received a estimate and never knew they made a decision and later found out through social media that project was already completed. After which they contacted us again and requested the refund. All the information they provided is not public record and information has nothing to do with the project. Customer bringing up one of our children has nothing to do with the project and is very unprofessional. Where our family and us go in our free time and a purchase of a vehicle is not public record and has nothing to do with the project. Owner that purchased vehicle is also a full time employee at another company and needed a work vehicle. Purchase has nothing to do with the project. This project is also not the only revenue the company had. The information the customer provided was irrelevant. And as previously discussed neither owner has a criminal background much less for theft. Work that has to be fixed is going to be a matter of opinion depending on the contractor. Some contractors rather re do the work then continue the work that has been done which is completely fine because not all contractors do work the same way and have different ways of doing things. And yes contract states price has to be reduced $50 for every day thats late but it also states that if there are no circumstances that slow down the project which there was. Also customer is accounting for the time after the fact that they chose to get another contractor to complete the project. We were completely willing to keep working on the project until completion but customer decided to go another route. We never denied not completing work but we never made the decision to not complete the work. We never claimed that one of the owners was a licensed master electrician, and never claimed to be a licensed contractor to anybody. We have only ever claimed to have a llc and to be insured nothing more. We cannot do a 90% refund that neither is reasonable nor possible, we can only do a partial refund for the inconvenience or $3,500.Customer response

I am rejecting this response because:*****************************, you are such a lier. All of those "modifications" that you're talking about were mentioned since the beginning but you kept forgetting because you would not notate everything in detail. The customer shelf in bathroom was art of the price we received since the beginning. The tile on fire place was also discussed but the only thing we didn't know was if we wanted to do it only around the fire place or all the way up to the ceiling. About you "never mentioning that you won't finish" it's also a big lie because the person who brought that up was your criminal brother, ************************* who I have on a recorded call telling me that he was very stressed out about the whole situation and that the best option will be to cancel the contract for which I obviously agreed after 5 months of not seeing not even 50% of the work done. Your offer of $3,500 is a joke just like your company. Your brother ************************* and I ran numbers together just a couple of days before of you guys leaving the project and at the time YOU GUYS STILL OWED ** OVER $35,000 IN LABOR AND MATERIAL. When I spoke to your brother on one of the recorder calls, he mentioned that he was very upset at you, that he was looking to see if he can get a loan to pay us back and that he was aware of your lack of performance. He said he didn't want to keep making us loose more money (lol sarcastic of him saying that huh?). We did mentioned that we were going to get new bids from other contractors to finish the work because you needed to pay not only the over $35,000 that you owe in labor, but because you also needed to pay that extra time that you took (over a month over due date times $50 a day) plus what the LICENSE ELECTRICIAN will charge as well. We paid almost $60,000 and we didn't even get half the work done in 5 months. Your workers kept leaving you because of the bad treatment they received from you. They were undocumented and you were taking advantage of them. The project got delayed because most of the times you would not show up to work and we have the evidence of all that as well. The information I provided IS public records and that's how I got it. Your brother as well as other people very close to him have a criminal background, that is also public records and I got it very confirmed not only by ************************* himself, but also by the PD and his previous employer. You did say that you were a licensed contractor when we were talking about affordable house by 3d building and you also said that your brother was a licensed electrician when I confronted you for using a non-licensed electrician to work in our house (if you never had mention that, I would of never look up his license number which ended up being an APPRENTICE LICENSE and all of you will be hearing from TDLR very soon). Again, I have most of our conversations in text messages for evidence purposes, I have pictures, videos, recorded calls, ex-workers testimonies and you and your brother's previous employer's testimonies as well as all the PD records showing all the times your brother and owner ************************* was arrested for theft. The excuse of your brother buying a new truck "because he needed one for work" is dumb, because he did have an suv and it is very ironic that he went and get a new truck right after he was acting victim telling me that he felt very bad for not performing and not being able to complete our project because he didn't have any more money.
Your brother's FB profile is public and yours was public as well so everything that you post on social media is public and at this point, everything I find will be used as evidence. I have witnesses willing to share very serious testimonies and evidence against you and your brother.
Think about a better way to solve this.
