    My son's wedding was on 05/25/2022. My son paid Danielle ******** $1,200.00 up front to work on his wedding. At some point, she required more money. She stated that she sent emails to my son and his fiance, however, they were never received. My son spoke to her several times over the phone and she did not mention that she needed more money. She did not communicate that she was no longer working on his wedding. Instead, he found out from another vendor that she had dropped him. When he called her and tried to make a payment, 1 week before the wedding, Danielle told him that she had already given her crew the day off and refused to help. She also refused to refund his $1,200.00. I feel that she stole from him and I'd like for her to refund his money.

    Business Response /* (1000, 5, 2022/06/13) */ Notice letter from our attorney to the wedding clients: My name is ****** ****** and my firm represents One Fine Day Weddings & Events ("OFD"). We were recently retained by OFD after your actions towards my client became intolerable--specifically your breach of the Wedding Management Terms of Agreement (the "Contract") as well as the defamatory remarks that have made against my client since the Contract was cancelled due to your non-payment. You are hereby put on notice sent all future correspondence directed to OFD to my office. As you both are aware, you and OFD entered into the above-referenced Contract with an effective date of Monday, August 23, 2021. The Contract was signed by you both on October 3, 2021 and was fully executed on October 4, 2021 by OFD. Section XIV of the Contract titled Event Package Services Fees states that you agreed to pay a total amount of $3,600.00 for services rendered by OFD. The Contract is also clear that $2,400.00 is a non-refundable retainer payment and that the entire amount must be paid by 5:00pm CST on March 27, 2022. Furthermore, Section XIV of the Contract states the following: Above quote is valid until 09-23-2021. Payment in the form of case, check or credit card is accepted for services rendered. There is a forty-dollar ($40.00) service fee for returned checks. Final Payment will be made no later than sixty (60) days prior to the event date. Past due payment fees of fifty dollars ($50.00) per day may apply if payment is not received in full by specified time on the contract without written notification and prior approval by Coordinator. After four (4) days of late charges with no payment the contract will be considered automatically terminated by the Paying Client and Clients will still be held liable for service fees owed to Coordinator for this Agreement. In order to reactivate the service contract, a penalty fee of two-hundred and fifty dollars ($250.00) will be owed and the contract will not be considered active until payment and penalty fees are paid in full via cashier's check or in person cash payment. One Fine Day will not be responsible for the unavailability of originally contracted items and the client agrees to substitutions as deemed necessary by the Coordinator once payments have been finalized. See Wedding Management Terms of Agreement, Section XIV (emphasis added). I am attaching a copy of the contract to this letter for your convenience. As you are also aware, you have failed to pay $2,400 of the $3,600 owed to OFD under the Contract, nor have you paid any of the late fees owed. As a result, you are in breach of the Contract. Moreover, the Contract makes clear that my client had every right to terminate the Contract due to your failure to timely pay. My client also had (and still has) every right to sue you both for breach of contract and chose not to do so. However, despite my client's willingness to walk away from the issue and move on, it appears that you and your family/friends are unwilling to take the same approach. To date, we have records of at least 10 people that have made false and defamatory remarks in various places online against my client. This is where my client draws the line. It is clear that there is now an organized assault on my client and its reputation due to no fault of its own. In fact, every negative review left by the 10+ people mentioned above were made despite you being the only party that breached the Contract. This complaint needs to be withdrawn before further action is taken. Consumer Response /* (2000, 7, 2022/06/14) */ (The consumer indicated he/she ACCEPTED the response from the business.) I was unaware of the contract my son signed. I will let this go eventhough I disagree with the company. I don't believe they should be able to threaten legal action based on negative reviews.
