    I contracted with Hugo ********************** LLC to build a covered round pen for horses on May 18, 2023 at 2:00pm. **** and I meet at Ellis ******************** to sign the contract/documents from the ******************* for $25,000. ( I started the loan paperwork and was approved in March 2023 though the *******************.) The check from the Ellis ******************** would be available the next day, May 19, 2023. I deposited the check in my bank account. My bank releases $5000 of the $25,000 on May 24, 2023 and **** received a cashier's check for that amount on May 26, 2023 he said to pick up materials. And four day later $20,000 was deposited and a cashier's check of $15,000 was picked up by Hugo ********************** of ****'s Home on May 31, 2023. During the month of ***************** did not do anything with building the covered round pen. I would message him though ******** messenger and he would say he was coming never showed. On June 15, 2023 **** dropped of metal that he has at his home in Rice. I would constantly message **** about when was going to work on the covered round pen. And he would make up one excuse after the next. ( I have all the ******** messages from day one as evidence) On June 25 and 26 two employees of ****'s came out to start the layout and concrete base. June 28 and 29 the guy working on the base said they would be back after the concrete set. On July 3 **** phone thought ******** messenger to see if he could use used I-beams. I said yes. I said you can use everything used but the roof tin has to be new. ( I changed the materials from wood to metal cover round pen after a very bad microburst storm hit *****. And I was worried how wood would hold up in the high winds. And **** agreed to the chance) **** has a demolition business and he plan to get the I beams though demoing mobile home. This took about two months to get the I beams (total of 8) I would message **** for an update but all he did was tell me what I wanted to hear. He would make excuses. Everything would have been ok between us if he would tell me the truth on what was happening and prove an date when he would have all the beam and start up work again. ( And I understand stood that he was use this type of I beam to keep the cost down. Not just for me but for himself. He would be hire to demo a trailer and get paid to do the job and take from that demo for free) So the I beams did not cost Hugo ********** Work did not start back until August 30, 2023 a welder named ********************* worked though the end of August unit November. He cut and welded all the eight post. The beginning of September ********************* worked on the main beam and preparing the other truss. Up until **** stopped paying *********************. And as of December 24, 2023 **** still owes $470. In September 2, 2023 **** asked for $2,500 for materials and I gave him a cashier's check. (But he used this money to pay ******* Slides from the month before)At the end of September two different welder came putting up all eight truss. And the date on completing the cover round pen was October 1. **** and his brother came and dropped of perling ( and not enough to do the job) late at night on Thursdays Dec 9, and said his welders would be here Saturday to start putting them up. They were a no show. On December 12, the second set of welders showed up to get this equipment because **** was not paying him and would not work unless **** paid upfront. As of today, December 24, 2023 nothing has **** done to on complete the contract job. I would like to recover the money to finish the covered round pen. I have a welding company coming out on December 28 or 29 to get a estimate on how much to complete the job. I will provide this estimate for the BBB complaint and that will be the money I want to recover to make this right. I also have the contract, two witnesses, *******'s check, and all the ******** messages, and I can provide pictures of what the covered round pen look like as of December 24.
