    Rent was raised during contract, when told them I never signed the addendum nor does it follow the contract, they still charged me the extra amount anyways. This property management doesn't follow their contract.

    Good afternoon!  I am writing in response to complaint # 106816.  On October 28th, a letter was put on the complainant’s door (see attached) which stated that due to a significant  increase in our property taxes and insurance premiums, we were having to enforce our Special Provisions clause that is written in Paragraph 32 of our Residential Lease Contract that states, “If, during the term of this lease, charges incurred by Landlord relative to variable costs, including but not limited to electricity, water, gas, sewer, and garbage charges, insurance premiums, taxes, janitorial, fuel costs, or any other operations expense directly related to the premises, exclusive of management, are increased, Landlord shall have the right upon thirty (30) days written notice to Tenant, to increase the monthly rent in an amount equal to the pro rata share of Lessee to the total increase incurred by Landlord….” .  Although, we tried everything we could to prevent this, we could no longer sustain the substantial financial increase this created as the monies owed were retroactively dated to January 2022.  We offered residents to come into the office and see the hard evidence if they wished to do so.  The complainant did not request to see the documentation and this increase went into effect on December 1st.  I am attaching a copy of page 7 of the Residential Lease Contract initialed by the complainant showing that she understood and agreed to the terms of the lease. (See attached) I have highlighted the special provision that relates to this complaint as well as the complainant’s initials showing agreement.  I am also attaching the complainant’s vacating sheet showing charges that she incurred upon move out. (See attached) Her name has been redacted per BBB policy.  As you can see, the complainant was only charged for her utility bills that were left unpaid for usage while residing in the apartment.  She was also charged for drip pans that were left dirty upon move out.  Because the charges were for monies owed for utility usage, she only had one month on her residential lease contract in which the increase effected, and she did not pay for her December utility bill, I do not feel that any refund is warranted.  Please feel free to call or email me if any further information is needed.

    I am accepting and rejecting this response because:
    As for the rental increased understood. But I had one of the property managers come in to look over the apt before leaving to make sure there were no issues/problems or other concerns that needed to be taken care. In fact, the property manager noticed that maintenance when after fix/painting the bathroom wall still left things behind. I explained to her that I have not changed anything from when I got it. And there was damages to the apt before coming in to notify immediately so no further damages incurred. example: plumbing, flooding of the apt with previous tenants(hence damage still on bottom of cabinets). So the drip were like that coming into the apt. Also if this was an issue this should have been stated during the walk through when I handed over my key that Thursday.
