Trinity roofing agent offering to help with my insurance to get a roof replacement as well as replacement of shed and cleaning if fence. She was able to get the insurance to pay. Her contact with me stated she was working off insurance estimate. Supplements and deductible included. The shed and fence were not touched and company wants complete estimate payoff. I also found items in the estimate that were not discussed between us ( nor done) but she wants to be paid. When I discussed this with the insurance, they said she tried to submit a $1700.00 supplement but was denied due to pictures not matching originals submitted. ( shingles were not a match) I meet with company but kept insisting that there was more work done that she paid for and did not want to compromise, just said that I would hear from her lawyer. I believe that she is misleading the customer and the insurance companies by submitting a certificate of completion when it is not.. i have attached our contact, the insurance estimate and her certificate of completion. Pictures of my fence and shed as they stand today.I have not paid anything to the company yet, until we resolve this.

    Complaint: 20724595

I am rejecting this response because:

      Dear ************************,

I am writing to you in regards to the demand letter of nonpayment to Trinity Roofing and restoration ,llc . Unfortunately , ************************, it seems Your client has not been very forthcoming with You. I am sad You have to represent persons who are very misleading, who falsify documents to the insurance company, and who knew from the get go we did not have any money to spare, not even for the deductible , but trinity roofing and restoration, llc agreed to wave that fee if we used their company.

Trinity Roofing and restoration, llc also should have told You that there has been several attempts (documented with the BBB) that we want to pay for work done to our roof in the amount stated by *************************** as customary for such service. However, she refused.

Reassuring you, there is no question that Trinity Roofing and restoration, llc performed and completed only the work to the roof and we did obligate ourselves to pay Trinity Roofing the price on the estimate given by ************************** only.  There was NEVER any other amounts given, written , discussed , or shown to us by Trinity Roofing and restoration, llc to agree apon.  Again, the agreed apon price was the estimate given by *************************** which is reasonable.

As a result to this, You may inform Your client the proposal is:
We will pay Trinity Roofing and restoration llc the amount of $9807.29 as stated, in exchange for full release of my property and Us, call it resolved, and part ways.

Failure to agree ************************, I suppose you continue with Your instructions to commence any and all means necessary. Trinity Roofing and Restoration, LLC will be the ones to pay any fees incurred in pursuit of this action because we are not wrong , liers , or trying to get something for nothing ( as is Your client) and are prepared to take this as far as youd like. However, I trust such action will not be necessary.

Should you have any questions, please do not hesitate.

    Sincerely,

        *********************************

    Regards,

    ********,
I am very sorry that you feel that we mislead you during this process. However, when we sat down with you and your husband, we went over the contract in detail before you and your husband signed it.  During that time, we discussed at length all amounts that both you and your husband were obligated to pay, which included all the amounts paid by your insurance company as a result of the hail damage sustained.  That is the agreement and the contract you signed, of which you have a copy. We were very up front when we told you that we could not complete the roof replacement for the amount of money your insurance company allowed for solely the roof; however, if the amounts included by the insurance company for the roof, the fence and the shed were included, as well as the deductible, that would make it economically feasible for us to perform the work.  This was all disclosed up front, in advance, and specifically set out in our contract.
During the process, and following completion, there were no complaints or issues raised regarding the work, or the successful completion.  In fact, you expressly stated that you were very happy with the roofing crew.
Once the work was complete, you texted us to come over so that way you can pay, a copy of that text exchange is also attached.  However, when we came over you then refused to pay. To this day, you have not paid a single dollar for the roof replacement nor have you identified any defect in performance or installation.
Based upon this, the entire contract is due and owing.  Once that amount is paid, we will transfer the warranty and will consider this matter resolved.

I am rejecting this response because:
    MRS. ********,

You're not sorry, you portray yourself as a God-fearing woman but you're a snake taking advantage to the innocent.  I'm going you try to keep this short. I wasn't happy with your crew, when I brought it to your attention, you blamed me.

Had you really gone over the estimate as you claim to have done, we would have known about the windows you added to the claim and looked to gain almost $1000.00. Had you truly told us that you were going to use all the proceeds we would have used someone else. you say we never tried to pay you, by your own evidence (text) We were trying to pay you, what the insurance was giving for the job not the full amount of the estimate. if that was the case, we would have used someone else that would have.

I believe if you're going to send texts as evidence you should send them all so it can be read in its entirety. I've attached the texts.

I have so much more to say and show but I think I'll wait till we have to meet in front of someone to share it.

As I told your lawyer, I reject your offer and let the burden of litigations begin. I will not back down.

    Regards,
