    Payment for two days unauthorized use of my trailer for marina activities of $1,000 [$500 per day]

    Thank you for notifying us of this complaint.   It appears that there are two issues in the complaint and I will address them separately.  Both situations stem from the May 25th tornado that caused major damage to Ray Roberts Marina.   In the matter of the boat trailer, *** Roberts Marina was not involved in this matter.   *************************, marina owner noticed a Denton County Sheriff vehicle at the marina boat ramp and went to see what was happening.  He found that Tow Boat US had mistakenly used Mr. ******* trailer in an emergency rescue of a sinking boat.   Tow Boat was contracted by multiple insurance agencies to retrieve damaged and sunken boats from the tornado.  It's our understanding that ******************** trailer was parked at ******** **************** and Tow Boat thought they were using one of ******** trailers.   We are not sure what transpired but a Sheriff deputy was called and Tow Boat and **************** was accusing Tow Boat of trailer theft .   We know that Tow Boat was acting quickly in trying to prevent a boat from sinking and mistakenly took the wrong trailer by accident.  The boat was moved to another trailer immediately and **************** took his trailer.   We do have to state that ******************** reaction was unnecessary and extremely to the point of confrontation.  With his actions, ************************* made the decision to terminate his lease.  

    In the second issue we need to explain that the tornado damaged over 100 boat slips to the extent that they can not be repaired.   ******************** boat slip was among these slips.   In the weeks following the tornado, **************** made demands that we should build a walkway to his slip even though we had one boat house flipped upside down between his slip and the shore making a walkway impossible.  He then wanted to list his deck improvements for sale.  We explained that this wasn't possible since his boat slip could not be repaired and would be torn down at some point.  We do want to explain that the marina does not insure a boater's private property such as boats, boat lifts, patio decks, patio furniture, etc.  This is private property owned by the boater which the boater must insure themselves.  We are assuming **************** did not have insurance on his personal property.  **************** was fortunate in that his section of the boathouse did remain upright even though it can't be repaired.  We did offer and still offer the boat owners the opportunity to retrieve any personal property that they can.  **************** chose not to.  That offer does remain and he can make arrangements to retrieve his property.  

    We sympathize with every boater who lost property resulting from the tornado.   The marina itself sustained approximately seven million dollars in damage.  We have to accept that this was an act of God and was no one's fault including the marina's.  We understand that **************** is unhappy with his loss because we feel the same pain at a much greater level.   We do not feel that the marina owes **************** for his personal property as it was his responsibility to insure the property. Sadly, we feel this complaint is retaliatory towards the marina and hope the BBB can see this based on ******************** actions.

    I am rejecting this response because:   Lrrm supports their vendors stealing their customers property. ****** is lying. It was no accident my trailer was stolen with lrrm consent. It was clearly marked and in need of repair prior to use by its owner, not some of their unprepared vendor who was negligent in bringing proper equipment to the site. Why didnt tow boat bring their own trailer to the job site, instead of stealing mine. In my attached correspondence ****** agrees with tow boat actions. She is wrong about when my trailer was returned. My trailer was used by tow boats for 2 days and only when I contacted the sheriffs department was my trailer unloaded with the strange boat.  When I showed the situation to. **** he refused to take any action when the strange boat was on my trailer right in front of him.If someone takes your well marked property without your consent it is stealing. ****** what if I took your red cart for two days without your knowledge, would that be stealing 

    maybe the Next step is to file a complaint with the sheriffs department as they have a record of that day

    This will be our final response.   We are in the long process of repairing our marina from major tornado damage and don't have any more time to spend on this fraudulent claim.   This matter is between  **************** and Tow Boat US.  The marina's only involvement was to tell Tow Boat to remove the boat from the trailer and let **************** take it.  That was done and would have resolved any issue with a reasonable person.    Again, his trailer was not stolen but taken by accident in a boat emergency.  There was no theft whatsoever.   I do want to state that the marina owns multiple boat trailers and did give Tow Boat and ******** ******* center permission to use our trailers to retrieve storm damaged boats at no cost.  We also frequently loan our trailers to our slip tenants when they need to borrow one.   Again at no cost.  It's simply a courtesy.   We have no need to use ******************** trailer and the marina has not used it at any time.    As far as a red cart,  I don't have one.  I can say that if I did, I would gladly loan to any boater that needed to use it.  It's sad and disheartening to see someone have such an extreme reaction to this situation.
