            Mountainland Collection Agency regarding their continued efforts to collect fees related to a debt that has already been fully resolved. I reached an agreement with Alpine Pediatrics to resolve the outstanding debt under clearly defined terms. I have retained all pertinent documentation, including the settlement agreement and confirmation of debt resolution, which clearly state that no further fees or charges were to be collected. Despite this Mountainland Collection Agency has repeatedly contacted me regarding additional fees that are not only unwarranted but are also in rude, unprofessional, and has threatened legal action to both my wife and I. These repeated and unsolicited communications have caused significant distress and confusion, and they undermine the validity of the original settlement. I respectfully request that the Better Business Bureau investigate this matter and take appropriate actions to ensure that MCA ceases their collection activities related to this resolved debt.             We are sure sorry Mr. ******* feels as he does; but must also respectfully disagree with his assessment of things.   Mountain Land Collections (MLC) is a third-party debt collector that does NOT purchase the debt it services; but instead helps the original creditor(s) recover what they are owed.   The significance of that is that upon receipt of Mr. *******'s BBB complaint, we reached out to the original creditor who confirmed to us that the amounts MLC is trying to collect remain owed and have not been settled or otherwise comprised by the original creditor.  Certainly if Mr. ******* is willing to share the written agreement to which his complaint refers, MLC would be more than happy to look at it and equally happy to share it with the original creditor.   With regard to Mr. *******'s belief that we are constantly contacting him, our records show only three conversations with Mr. ******* on October 31, 2024, November 7, 2024 and February 13, 2024.   That level of contact is very reasonable and complies in all respect with applicable laws.    Finally, we invite Mr. ******* to review the contact signed with the original creditor on June 25, 2024.   In relevant portion it reads:  I understand and agree that should my account become delinquent, and it is referred to an outside collection agency, I shall pay [a collection fee].   I further agree to pay all other costs of collection and/or enforcement including but not limited to court costs, reasonable attorney fees, and interest . . . . Any interest due hereunder shall be calculated at 18% per annum and may compound as frequently as daily."    MLC is not attempting to collect any amount that is not authorized by the terms of the specific agreement with the original creditor.  As Mr. ******* is aware, he paid the original amounts owed only, and no interest.   Finally, though we disagree with Mr. *******'s assessment of our agent, we have nevertheless meet with the agent with whom he spoke to remind and train her on company expected levels of customer service and how to better explain issues of "remaining amounts owed" such as interest.   If Mr. ******* would prefer to speak with one of our executive level managers, we certainly invite him to contact us at ###-###-####.

            I am rejecting this response because:

            Firstly, when we reached out to the original creditor they assured us that the debt had been paid through the original creditor. When I spoke to their accounting and billing they were able to log into whatever portal they use to access MLC’s open debts and she was able to tell us that nothing was open and all debts had been paid off.
            Secondly, when speaking with the original agent I asked her for a letter of validation. Instead of accepting and issuing the request letter she pushed back and said that letter had been issued in October. I don’t believe we ever saw that letter and if we had we should still be able to get another letter issued regardless of the status of the “issued” letter from October. As of 2/19 I still haven’t received a letter of validation.


            Thirdly I can’t stress how unprofessional and confrontational the agent from MLC was when speaking to me on the 13 and also my wife earlier in the day. Accusing her of not saving a phone number or upgrading her phone in that time.

            This consumer's complaint appears to be a form-complaint taken from the internet.  It is MLC's understanding that the BBB was screening out such form complaints.  Nevertheless, we did look into this mater.   The substance of Mr. ******** complaint is that he is not "liable for this debt" because he "do[es not have a contract with Mountain land collections [sic.]."  However, the existence or non-existence of a contract with Mountain Land Collections is irrelevant.  We are a third-party debt collector that has been engaged by two different original creditors to collect on  unpaid balances alleged to be owed to each of each of them.   Additionally, our records confirm that despite our many attempts to contact Mr. ******* we have had zero contact with him.   As such, his statement that he has requested a contract (let alone anything else) from *** is simply not true.  Finally, since more than one original creditor has assigned accounts to us for *********************** it is not clear to which specific "debt" Mr. ****** refers.  We would welcome contact and dialogue with Mr. ****** and certainly invite him to contact us.  We can be reached at **************.

            This is a debt collection agency that does not accurately report the debts owed to the credit agencies, claiming you owe less than you do and then when you make contact and set up payments claim they are willing to work with you during a hardship and allow you to make partial payments. Then they take you to court for making partial payments. They are scammed criminals that should not have a high rating. They should not be in business. It is disgusting to lie about a debt owed and then lie about making partial payments to avoid court only so they can add on even more cost to the debt with attorney fees. Investigate them, I bet this is normal business practice and takes place daily.

            Perhaps the most cordial way to respond to Ms. *****’s complaint is to say that we vehemently disagree with every statement she has made and are a bit stymied as to why she would make such statements when she herself is aware of the repeated courtesies we have extended to her.   We do not incorrectly report information to the credit agencies and we have indeed tried to work with Ms. *****’s toward an amicable resolution of a pending lawsuit.   In May 2023, Ms. *****’s signed a written payment agreement.  This agreement set forth the exact amount she and MLC mutually agreed was owing as well as a mutually acceptable repayment schedule.  It also set forth agreed upon consequences should there be a breach of the agreement.  Though we do not wish to be unsympathetic to Ms. *****’s current situation, the reality behind Ms. *****’s complaint is that she is frustrated MLC filed litigation to hold her to the terms of her May 2023 agreement; and that MLC is not willing to allow her to unilaterally change its terms.  For some reason, Ms. *****’s feels that MLC’s efforts to hold her to the terms of her own written agreement is somehow a scam.   It is not.  Just like a landlord expecting consistent rent based on the underlying written rental agreement, MLC expected regular monthly payments based on its written agreement with Ms. *****s.    What Ms. *****’s seems to have overlooked is how MLC agreed to work with her clear back in May 2023 when we formulated a mutually acceptable plan for her to make monthly payments on a large balance already past due amount owed to a medical provider.  MLC had no obligation to accept payments.  But we agreed to.   It is also telling (and frustrating to MLC)  that Ms. *****’s complaint fails to mention that on December 19, 2023, MLC agreed yet again to work with Ms. *****’s by: (1) voluntarily removing the contractual penalties to which Ms. *****’s had agreed; and (2) by allowing her to significantly reduce her monthly payments for a short period on condition that Ms. *****’s contact MLC in February 2025 in order to discuss her ability to get back on track with the original payment agreement.   Whether she sees it or not, MLC will always strive to do the right thing.

            It is our understanding that the BBB was screening complaints for language such as this which is clearly "form" in nature.  Nevertheless, MLC is grateful for the opportunity to respond.  Despite the consumer's statement that she has requested a copy of the original contract from us, we have had zero communication with this consumer in over 3 years.   Additionally, it is not clear which of two possible accounts the consumer's complaint is about.   One account with MLC was reduced to valid utah  judgment in September of 2021.   The last communication with the consumer regarding this account occurred in November 2021.  Another newer account was placed for collection in November of 2022.  We have had zero communication from the consumer regarding this newer account.    It remains outstanding.  There is no contact between MLC and the consumer; nor is one necessary in order for accounts assigned to MLC for collection to be valid.  MLC is a third-party debt collector that collects on accounts placed for ********************** by original creditors.  With regard to the newer account, the original creditor attempted to collect on the account and when they were unsuccessful they assigned the account to MLC for ********************.  *** did not purchase the debt/account.  The original creditor stays very much involved and has requested ***'s help in collecting it.   MLC would love to help this consumer resolve these matters.  If she desires, she may contact us at **************.

            In April 2023 a collection/debt showed up on my credit score that I wasn't familiar with. Since then I have been trying to figure out what the original bill was from. I would receive up to 6 calls a day about this. Yet, when I emailed, they could never confirm and instead said I had to call. I've tried to call. The only thing I can guess was that this issue stemmed from a hospital visit. I have health insurance, so I tried to have my insurance company call to pay the bill. Still nothing. Via email I have verified my name, phone number, email, date of birth and SSN. Now they say "the account is closed." But cannot provide more detail as to what that means. I've never had a debt collector after me and I've never had an unpaid hospital bill. But I do like to know what I am paying for before I pay my bills. I've been emailing with ****** *****.

            This is indeed a very unique situation.  Because MLC is considered a debt collector, we are subject to a litany of state and federal laws and our interpretation of one such law is that it is inappropriate for us to conduct business (i.e try to collect) any amounts owed from an individual whom we have learned now resides in an area where we are not license or otherwise authorized to conduct business.  Candidly, it is a compliment to Ms. ***** that she nevertheless desires to address an account that we ourselves have opted not to pursue.   There is, perhaps, a way to address this.   As long as Ms. ***** acknowledges that MLC does not intend to attempt to collect on the alleged debt, we would be happy to try and answer her questions.  Then, if SHE desires to VOLUNARILY pay, she may do so as she chooses.  But we have two requests:  First, wed prefer that Ms. ***** personally speak and interact with one of our executive managers rather than texting or emailing with anyone else.  That executive managers name is *****.  She can be reached M-F 8:00 a.m to 5:00 p.m. MTD at ************. Our second request is that Ms. ***** contact ***** rather than having ***** contact her.  We believe this approach is appropriate given the constraints we feel we are working under but will still allow us to appropriately interact with Ms. ************************** know that many do not understand the laws under which we operater, and we also know that many in our industry do not honor those laws.  We hope that Ms. ***** will feel our sincerity in trying to do the right thing and are very sorry that doing so has led to her frustrations.

            We believe Ms. Prinvil-Andouzin has confused us (Mountain Land Collections) with another company or entity.  

            In her complaint she states: "I am not liable to this debt with capital one bank and credit one bank . . . . "   However,  MLC does NOT have any relationship with nor it is trying to collect on any debt(s) placed by either Capital One Bank or Credit One Bank.   Additionally, Ms. Prinvil-Andouzin states: "they not provide me with the original contract as I requested."   However, according to our records, we have had NO contact with or from Ms. Prinvil-Andouzin at all.    Similarly, Ms. Pinrvil-Andouzin's desired outcome is to have the capital one bank and credit one bank negative credit remarks removed from her credit.  However,  Mountain Land Collections has NOT submitted any credit reporting information at all with regard to Capital One Bank or Credit One Bank.   For these reasons, we believe Ms. Prinvil-Andouzin is confused and that her complaint was intended for another entity.

            It is our understanding that the BBB was "filtering" for complaints such as this which contain form language lifted from the internet.   Nevertheless, MLC responds as follows:

            MLC is a third-party debt collector that has been contracted by EPIC Emergency Physicians Integrated Care to recover on an alleged outstanding balance arising from Emergency Room Services rendered to Mr. Hertz on May 6, 2021 at Mt. Point Hospital.  Given that MLC is the legal assignee of the account in question, the existence or non-existence of a contract between Mr. Hertz and MLC is irrelevant.

             To date, and despite multiple attempts to contact him, MLC has had only one brief telephone encounter with Mr. Hertz which occurred on February 17, 2022.  He called us and when our agent explained that EPIC had placed an account for collections he hung up.  We've not been able to contact him since.   At no time has Mr. Hertz ever requested any additional information from us nor disputed what is validly reported credit information.   We'd love to work with Mr. Hertz toward an amicable resolution.   We invite him to contact us via telephone at (801) 492-1596.
