I signed contract online sent from JS Construction salesman. The date of email was 1/16/24. The salesman picked up a check shortly after and the check was cashed on 2/20/24. The contract committed to provide a new "tapered & sloped" valley system in existing "dead valley" in rear of house and to install 29 squares of **** ********* metal slate roofing panels along with necessary accessories. The salesman contacted the **** division salesman in ******* about **** training online and accompanying installment manuals and promised the installers would be properly trained by the manufacturer and installed according to their product specifications. My dispute began the day they began the install in early May/2024. It was clear from day 1 that the crew chief was unprofessional, and the production manager (my contact provided by office personnel) was not qualified to manage the crew chief. After several days and numerous concerns on the ground, I got on the roof and snapped numerous photos of their install. They were over half way finished and I called the building inspector for a visit, and the **** salesman to review the photos of the butchered materials. The photos provided clear evidence of highly unskilled labor, not only in the **** product, but also as metal roofing professionals. They had not taken the training with **** as promised or read the installment instructions. The president of company then got involved and apologized for the mess. I agreed in good faith to allow him another chance with another installment crew that had participated in the **** training online, and to proceed under the guidance of the **** salesman to ensure proper installment. The salesman came to town for two days to supervise the beginning of the new install and brought numerous installment manuals for the team to read and study (written in Spanish). Now, they have not followed code again. Owner sent employee over to harass and threaten me. False Advertising as METAL ROOFERS.Business response

I have reviewed the response offer made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. Regards, ******* ******President Smith continues to deceive. I stated in writing, to him, that I needed to get any further communications between us, in writing, due to past deceptions, and to protect myself legally. He sent an employee over to my building project shortly after and uninvited. The employee blamed me, and President Smith's salesman, for any breach of the contract siting my "unreasonable expectations", and for signing a contract that was undervalued. I received four estimates for the roofing project and one was almost exactly the same as President Smith's. Another offered a lifetime warranty on their labor and they were required to travel from ******* so 7k more, and justified. The last estimate was extremely high and not in my budget. His employee told me "his" options and threatened a mechanics lien if I did not accept one of them. I had two helpers on site that day that heard the conversation from the back porch, and therefore witnessed the harassment and threats from his employee.President Smith has repeatedly sent unskilled workers to my roofing project, and the result has been damage to the metal slate shingles, some not reusable, some gouged, and multitudes scratched by the carelessness of his workers, and a lack of staging provided by President Smith, as promised in his contract. The staging was needed according to other professional metal roofers that I have consulted with, and my own experiences as a ***** ******** residential builder, for over 25 years. President Smith has willfully ignored the manufacturers instructions and residential building codes on both of his installs after repeated conversations, in writing and verbally, with his customer, about the importance of those instructions, and codes, for not only my satisfaction, but the building inspector of the City of *******, and the manufacturer of the metal, ****, and their lifetime warranty. President Smith continues to avoid responsibility, minimize the damages inflicted on his customer, blame others, and violate the contractor laws he is legally required to follow. Why would I cooperate further with President Smith on his contractual promise to complete my roof? His mission on his website is "to inform, educate, and earn the trust of our customers" and "we are confident you can count on us to get your next project done right the first time". He promotes himself as an "expert" in metal roofing and the roofing industry. His workmanship, and his leadership, paint a very different picture of his company. I am elderly and I have limited income. I cannot afford any more of his damages to the metal, or the maintenance of a damaged, new roof. I have repeatedly shown good faith, and contributed an additional 10k to help him, and his crews, to complete my roof to my satisfaction, and in compliance with contractor laws, but without gratitude, or recognition, of my efforts, by him. Cooperation is no longer an option. The contract states that the metal materials are the property of President Smith. The value of the materials were originally, before the damage, approximately 18k. He can pick up all of his materials and refund my deposit of $16,500. That is the only fair and just resolution to our dispute.Business response

We have reached out to the customer to resolve this matter. We asked to meet with the customer with another crew to plan the completion of the job in a manner that looks good, doesn't void the warranty and will not leak. We look forward to completing the project and resolving the issues in that manner.Initial Complaint

On 10 June 2024, I signed a contract for roofing and guttering from this company. That is over 50 days ago. The total amount was $2,495. They required a down payment of one-third of the total cost which amounted to $748.00. They would not accept a credit card. My check cleared the bank on 12 June. Since that time, they have refused (actually ignored me) to provide a date for the work to be done. Twice they told me the work would be done, but no one showed up. On July 12, I contacted them and they said the work would be done on Monday 15th. No one came. On 26 July, I called and was told that the secretary and the scheduler would meet on 29 July and they would call and give a definite date. I heard nothing from them. Twice they have told me the ventilators had not arrived: twice they have told me they have arrived. On the 26th, the man who answered the phone told me the ventilator was sitting beside him. Today I sent them an email that I wanted to get the work done. No reply. I want a refund. I am 88 years of age and have cancer, type 2 diabetes, COPD, anemia, apnea, Crohn's Disease, a blocked artery, asthma, and the muscle on my left lung does not work. I also have anxiety, depression, and difficulty walking. I also live alone. What the company has done to me is approaching elder abuse. It is extremely upsetting to me to have to deal with them. They have never been honest with me, and I am wondering if this is a scam. I have too many other things to worry about. I have documents for much of this which I can supply to you. Unfortunately, much of the contacts have been by phone and text messages (which due to the lapse of time have disappeared from my computer.Business response

I have reviewed the response made by the business in reference to complaint ID ********. Within a couple of hours after the BBB sent the complaint to the company, they called me. An appointment was scheduled for today (6 August 2024). They arrived on time and completed the work in less than three hours. I am still unsure why it took them more than 50 days to make an appointment. A company representative told me that the company had grown too fast and things were chaotic there. The salesman (who came to do the work) stated that they had been unable to obtain the fan/ventilator. Regards, ***** ****Initial Complaint

We sent the crew out today at 2:00 2-17-2022 to inspect the leak around the chimney. The crew inspected the chimney and found that the chimney had multiple cracks around the chimney and also the bricks are starting to break apart. We got the crew to seal around the chimney for extra preventatives. And also, we got the crew to use a concrete and brick seller and completely sealed up the brick for the homeowner and are hoping that this should stop the leaks. However, the cracks are large, and it could be recommended to redo the chimney because of the poor conditionn of the bricks and mortar. This has been taken care of.Initial Complaint

On May 12, 2022, I signed a contract with JS Construction Associates to install gutters on my house. I gave them a 50% deposit on 06/08/2022 for $1283.00 (so a check for $1283.00 which cleared right away on 06/09/2022), per the terms of the contract. Since that time, they have never contacted me. I have contacted them about 10 times, with no return call. On the last call I called them, 11/16/22, I spoke with the office assistant and asked her when we might be on the schedule to have our work done since it was past the 180 days in the contract to start the job. I told her that if I did not hear from them within the week, I wanted a refund. She advised that she would speak with Mr. ***** and get back with me. I have not heard a word and called her again on 11/21/22 and asked for a refund of our down payment. She said that she would let Mr. ****** ***** about us wanting our money back and would call me and let me know when we could expect this. I have also contacted the salesman, *****, numerous times who acts as though he knows nothing about what is going on with the business. I want my money back. I feel like this is not good business. No one contacts you to keep you in the loop as to what is going on regardless of how many times you contact them.Business response
