I hired Renovative Home to perform a two day estate sale at my parent’s home on ***** ****** ****. Terms of the contract included that Renovative Home would: -Sell items at full price only on the first day where full price was set by Renovative Home. -Record each item sold and it’s price. To summarize my complaint: Renovative Home did not perform the above satisfactorily and thus my share of estate sale proceeds was understated. When I received a check for my share of the proceeds, the listing of items sold showed several items sold on day 1 for less than full price and there were about 100 items that were not listed at all. The company used this incomplete listing of items sold as the basis of sharing the proceeds from the sale with me. I complained that my share was based on the incomplete listing of items rather than on the total amount of cash and credit card receipts during the sale. I think it is reasonable that any client would expect the gross proceeds taken in to be the basis of determining the client’s share. I initially let the company know that I thought she had simply missed including a page of items sold. After much back and forth, she did eventually send additional checks but this represented only about 25 of the nearly 100 missing items. I sent a listing to the company of items that sold and indicated whether the item sold on Day 1 or Day 2. I offered to send her pictures of items missing from the proceeds listing including picture of items sold on day 1 for less than full price where I had a picture showing the price marked. I estimate that there were additional proceeds taken in during the sale for which my share would be around $1000. And I came up with this amount by trying to estimate pricing of each missing item that would favor Renovative Home, i.e. be on the low side. I have offered to settle with her for $750, but she has not replied to my offer. Please let me know what additional information or documents you would like to have
