Pattern of Complaint:
BBB files indicate that consumer complaints involving Wall & Associates, Inc. demonstrate a pattern of concerns regarding fees, customer service, communication, and services rendered.  Specifically, complaints allege that: the business charges an initial fee and subsequent monthly fees to provide services to help resolve IRS and/or state and local tax problems; a lack of communication with consumers regarding their cases; failure to provide updates about the status of cases; cases are not resolved within the time frame given by the business; and that the IRS informs some consumers that they have not been contacted by the business at all on their behalf.  On August 22, 2018, BBB submitted a written request to Wall & Associates, Inc. encouraging the business to address the pattern outlined above.

On November 1, 2018, BBB met with Wall & Associates to address the underlying causes of these patterns.  The business provided BBB with the following statement and plan of action to eliminate its pattern of complaints.

“Over the years, W&A has represented tens of thousands of taxpayers. An important factor in successfully reaching resolution to a tax liability is communication between W&A and its clients.  This means communication must be effective both to and from the client. It is important that clients cooperate with W&A. To continue effectively representing its clients, W&A provides:

    1. W&A has a longstanding policy of providing its clients with an information folder to help aid in their clients’ understanding of the representation process.      This is given to the client at the initial consultation.  Included is contact information for reaching out to someone internally at W&A if the client should ever have any     questions regarding any aspect of the representation.

    2. Per policy, W&A returns client phone calls within hours of receipt.  In order to ensure adherence to this communication policy, independent oversight is provided by     W&A’s Client Services Group and management.

    3. When client information is received, a response is provided to the client indicating receipt of the communication.  If the client would like a current status of their     case, it is available upon request.

    4. Individual time frames are, by nature, unpredictable.  Some factors contributing to this unpredictability include slow response times from the IRS or other taxing     authority and non-responsive clients.  W&A professionally urges faster responses from the IRS or other taxing authority when necessary, while maintaining a     cooperative relationship with them.  W&A works with its clients to reduce the burden on them as much as possible; however, each client plays a role in the timely     outcome of his or her case by how effectively they communicate with W&A.  For these reasons, W&A makes no representations to its clients regarding time frames.     Upon hiring W&A, we can provide suggestions for how a client may positively impact their case.

    5. Consistent with ongoing policy, W&A will continue providing its clients with copies of written correspondence sent to the IRS on their behalf.  Any time the IRS is     contacted on behalf of a client, the client will be notified in writing of such contact and the nature of the contact.”

BBB will review complaint activity at three-month intervals to determine Wall & Associates, Inc.’s progress toward eliminating the patterns identified above and will provide the business with updates based on those reviews.

We went to Wall and Associates in July of 2019 to resolve my past due *** returns for multiple years. We were told at the initial consult that they would work directly with the *** to consolidate my debt and file all past due returns. We were advised that although they couldn't give us an exact date of resolution that this was typically a 6 month process. At this point in time we paid an initial $4000.00 down payment and signed an agreement to a $400 monthly payments as well as power of attorney for them to advocate directly with the ***. We were advised not to contact the *** for any reason and to forward any correspondence we may receive directly to them. Month after month, specifically from 7/19 through 12/22 we paid $400 per month and every time we inquired about progress we were assured a resolution and settlement would be "soon" and the delay was at the fault of the *** and their "typical" delay in the process. After nearly 3 and 1/2 years we finally received our settlement amount and were advised all past due tax returns had been accepted. We received copies of all of the returns for our records and paid all past taxes. Then, in July of this year we received notice that my 2018 taxes were never filed. We immediately called the *** and were advised that Wall and Associates (via Atlas Tax) submitted my 2018 return 3 times in one day on January 26th 2020 and were notified the return was rejected. They made a 4th attempt in February of 2020 and the return was again rejected. Wall and Associates never disclosed the rejection to us, but they continued to take our payments. We received a response from the *** and subsequently were immediately required to pay the taxes owed of $3793.00, penalties of $1924.67, and interest of $1514.12. We are requesting compensation in the amount of $19438.79 for money paid directly to Wall ($16000.00 in total) and the 2018 penalties and interest. They are totally incompetent and fraudulent.

Wall & Associates was retained to enroll me in a tax relief program with the **** I have paid them $450 monthly for four years without any resolution. In addition, my case keeps being reassigned to different teams, and I am asked to sign a different POA. I do not even know if I am communicating with Wall & Associates anymore because the email header indicates a distinct entity. Communication with my various representatives is sparse at best. I feel like I got duped while the tax debt was escalating. I think Wall & Associates is responsible because they have not provided the service I retained them for. All the interest accumulated since hiring them should be their burden, not mine. Or just give me my money back!!!

I contracted with Wall and Associates in July 2014, with an initial down payment of $3,700.00 and $450.00 per month thereafter. I was told at the consultation that my case would be settled within six months. I placed several calls during this time, only to be told "we're still in negotiations." I continued to pay the monthly fee until 2021, an approximate total of $35,000. The only reason I continued to pay was because they kept telling me it was getting close. I called in 2021 and asked for a copy of my file, as I wanted to see what sort of communications they were having with the **** I was told "we don't keep that sort of information." My tax debt at the time was approximately $36,000. Because of their inaction, I have since accrued fines and interest with the **** and found out that my debt had escalated to over $80,000. I then contacted another accountant with experience in dealing with *** issues, and she had my situation resolved in six weeks. I realize I am outside of the one-year boundary, but I just wanted to caution anyone to avoid this company. To this day it still makes me physically ill when I think about how much money I paid them, and now I owe the *** over double of my original debt. If I would have paid the *** what I was paying these people, my issue would have been completely resolved a long time ago.

We started with **************** in March 2020. We paid them $500 per month until January 2024 and did not get anything resolved with the *** regarding our taxes. The first year we had almost no communication and when we did they advised the *** was closed. When we finally got them to send the *** an offer they offered $1 which was done in 2023 and was rejected which I think they knew it would be. I need to get a refund of some sort. We paid in approx $18,000.00 and got nothing done. We still have our tax debit. These people do not communicate with you unless youre late paying $500 for the month and then they give you a call to collect. This is a lot of money and I feel like we were scammed. Is there really a Wall & Associates out there? Where else can we look into to try and recoup some of our money?

We began paying Wall and Associates in August 2021, and they have not resolved are issue as of January 17th, 2023. They have been lax in their communication with us over the same time period. The issue they were supposed to resolve was a tax issue. We are seeking the $6400.00 that we have paid them to date.

    Better Business Bureau:

I have reviewed the offer and/or response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Wall and Associates presented an offer in comprise to the *** on our behalf for $1.00, which they knew would be rejected. During the time period of Covid, approximately March 2020 through early 2022 we had little to no communication from *****************************, who was the contact person for case.  *** stated that the *** had shut down and she was unable to conduct business with the ***.

At the time of our initial contact with Wall and Assoicates, we had significant medical issues and an enormous outstanding balance with hospitals and doctors.  Had Joy been on top of our case, which began in 2019, this matter would have been settled in a timely manner.

Regarding the properties, we would not have had do anything with those properties if she had handled our tax matter more efficiently in the beginning.

We stopped paying because we had not heard from Wall and Associates in quite a while, and when we did hear from them, they stated that ***************************** was no longer handling our case and that it had been assigned to another case manager.

We would like most if not all of our money returned to us. We are considering reaching out to the ******** Bar Association and the ******** Attorney General.
