    Deceptive sales practices from SmartRoof: The sales representative, *************************, provided me a quote for a solar roof system at $33,645, post state and federal incentives (quote attached). However upon further inquiry, the 3rd vendor (**** ******) that ****** claimed that would buyback the 15-year SREC credits at a lump sum $48,750, denied ever offered such buyback. Furthermore, the Federal incentive termed as "Solar Tax Max Extra Incentive," amounting to $59,341, is apparently a tax consultation service from a third party named ***** *** ****. The results of this service are not guaranteed by Smartroof. Had I signed the contract with SmartRoof, I will be paying $50-110K more than upfront than what ****** had led me to believe.

    We understand that solar is new to a lot of people and there is a significant amount of information relating to incentives and other solar incentive programs. Smart Roof is not an accountant and recommends individuals to speak to their accountants for any tax incentive advice. Smart Roof and any of their associates should never be spreading misinformation. If we find that there are any mis-advertised claims we will cease these immediately.

    I am rejecting this response because:  I understand that Smart Roof is not an accountant, in addition, Smart Roof is not an SREC trader either.  But the quote from Smart Roof's sales representative ************************* (he said he's the head of solar sales at Smart Roof) provided written claims (attached in the original complaint) about two rebates that your company cannot offer, one from ********** and the other from ***********.  This is in direct contradiction to Smart Roof's stated policy of "Smart Roof and any of their associates should never be spreading misinformation".  I've provided written quotes from Smart Roof's representative.  Not sure what else the company would need to take actions to correct sales behaviors directly against their written policy.

    1) There's an unequivocal boundary between 'providing information' and embedding a supposed incentive directly in the quote. The latter is nothing short of a deceptive sales tactic.
    2) **********.com, the vendor allegedly offering the incentives, categorically refutes any such incentive and asserted that Smartroof is not even an authorized party to make such claims.

    I reported earlier regarding the leaking gutters following the roof replacement carried out by your company at my property. Despite the initial repair conducted by your company, I regret to inform you that the problem has persisted, and the gutters continue to leak significantly towards the surfaces of my property. The ongoing leakage is causing further damage to the property's exterior, and I am concerned about potential consequences if the matter remains unresolved. I understand that complications may arise in any construction project, but as a paying customer, I expect the work to be completed to a satisfactory standard. The recurrent issues with the gutters raise concerns about the quality of the roof replacement work and its potential long-term impact on my property. I once again request that you promptly arrange for a qualified representative from your company to reinspect the gutters thoroughly and identify the root cause of the leaks.     You can clearly see the newly added wrapping on the gutter helmet, which I never requested, next to the fireplace. This was done by your gutter technicians, and Roof Smart is not willing to acknowledge these unnecessary mistakes. Due to this, we are unable to reach an agreement with smart roof.

    We have successfully addressed the initial issue mentioned in the warranty claim. However, the member raised a separate matter unrelated to the warranty claim. In response to the member's concerns, we proposed a solution to their pre-SmartRoof condition. Regrettably, the members declined this proposed resolution. 
    Both parties involved have come to a mutual agreement and this claim is now closed.

    Smartroof helped me file a claim with my insurance company to fix hail damage to my home. When the project designer came to help me choose the work to be completed, I was very clear to him that all the work scoped out in the insurance estimate would need to be completed and that anything upgrades or deviations MUST be clearly explained to me. He told me and my father that aside from the gutters, which we agreed upon to be out of scope, all other work in the insurance claim would be done. Additionally, he told us that all materials (aside from the upgrades which were agreed upon) would be the equivalent materials which are currently available on the market. This was not the case as i found out that Smartroof was not going to use a metal cricket around my chimneys and was forced to agreed to a change order in order to keep the materials the same as expected by my HOA. Once the work was "completed" and the construction teams left (which was now over a month ago), I noticed that the work was not actually complete. The metal trim around the windows (which was included in the insurance estimate) has not been replaced. Additionally, there is caulking missing in a corner of my home between the siding and brick work. Finally, there is a section of my roof where the shingles are not laying flat. I would like smartroof to have the appropriate teams to come back on site to finish the job and fix the issues.

    My roof repair took 90+ days to complete, and we still have issues. On Friday, June 30th, we got some pretty heavy rain in ************, and my roof started leaking again in the exact same spot that SmartRoof told me was repaired. Then today Monday, July 3rd I noticed water damage in the ceiling and walls as a result of the roof leaking in numerous spots. I was assured by numerous individuals within SmartRoof that everything was finally correct when the work was completed on October 19, 2022 (work started on July 12, 2022) but that can't be the case if we are having multiple leaks less than a year later.

    I hired SmartRoof to install a Solar roof. SmartRoof was referred to me by *** **** (the manufacturer). as a partner. As this is a new product, we had prolonged contract negotiations and pricing discussions. ********************* was the representative I was working with. I was hoping to cover 100% of my electricity usage through solar power. ****** gave me a total cost of $86,414 for a 12.15KW system. My upper limit for cost was $70K. We negotiated a lot and reduced the system size to 11.43KW for a price of $68,880. I agreed to it and paid Smart Roof advance of 34% $23,419.20. Work started. We also had to replace 3 plywood panels at a cost of $115 each.After the roof was installed, SmartRoof sent me an invoice for $62,444.80. I asked them about it and they sent me the contract for the 12.15KW system and demanded that I pay the 86414-23419.20=$62,994.80.As per my records, the total cost was $68,880. I paid $23,419.20 Making a balance of $45,460.80 I contacted the sales representative, ******, but he had resigned his position a few months back and moved on from SmartRoof. He distinctly remembers that we had reduced the price. I have his email correspondence attached. SmartRoof has deleted his accounts inhouse and at DocuSign and they cannot retrieve them. In this time, Smart Roof threatened me with a collection against my credit. I paid $49,444.80. The *** ********** solar panels are rated at 45W per panel. My roof currently has a total of only 254 panels. Pictures of my roofs solar panels attached. This lines up with my claim that we had installed a 11.43KW system. If it is 12.15KW as SmartRoof claims, I should have 270 panels. Please refund my overpayment of $3,984 asap.

    On August 4, 2022, my husband ***** ******* and I signed a contract with an authorized representative of Smart Roof Inc. www.smartroofinc.com (Agreement number ******) for a detailed design and project specifications of a custom solar roof replacement for our home. We wrote a check to Smart Roof Inc. for $7,500 (see page 4) and they cashed it. In an email dated Friday, October 14, 2022, Smart Roof said the system design forming the basis of the original Agreement was no longer valid: “The GAF engineers came back with a revised proposal…Your system would be going from a 5.22 kw system to a 3.24kw system. I have attached the...final design for you to review…” Smart Roof said they would follow up with a change order to the original contract. They did not. Their representative left us a voicemail on November 7 “regarding the design change we need your approval on,” acknowledging that the terms of the contract would not be met by SmartRoof. The proposed new system design would be inadequate for our needs and is unacceptable to us. SmartRoof is clear that they cannot meet the original terms of our contract, and we no longer want any roof from them. We have requested SmartRoof return our deposit. In mid-March, I called the phone number for SmartRoof on our copy of the Agreement ###-###-#### and spoke to SmartRoof representative **** ************, who said he would check with ***** ****** and start the refund process. When we heard nothing, I called again on March 28. He again said he would check on the status of our refund. On April 11, I sent a certified letter to the address in McLean, VA shown on the original agreement, and the address given in the Agreement for cancellation, Smart Roof LLC at 10411 Motor City Drive, Bethesda, MD 20817, asking for a return of our $7,500 deposit. The PostOffice confirmed receipt and signature for the Bethesda letter on April 13. We still have heard nothing from anyone at SmartRoof and need our deposit back immediately.

    I engaged SmartRoof to discuss solar panels installation. This feedback is not regarding the installation or the product but my experience during their sales and more importantly their practices. The rep showed up at my house on time. He was very polite, engaging, and nice. When everything turned bad, close to the end, I was told that the entire conversation, in my home, with children talking, was recording from his phone. The rep didn’t say that he would be recording inside my own home when he arrived, and started the recording in a very untrustworthy and hidden manner. But when I requested for the recording to be deleted since I was now made aware and the child was talking in the background, I was nicely reminded of Virginia law regarding recording. I had to quote COPPA. The manager on the phone was dismissing that matter as well. This practice of recording people in their own home and their dismissiveness to my direct request to delete the recording are a massive breach of trust and makes me question their ethical practices. I’m waiting to receive confirmation for my request now.

    We were approached by a sales rep from SmartRoof about working with us and our insurance to replace our roof. It was relatively seamless until our "design" meeting, which is a sales/upgrade meeting. Our rep, ****** *******, told us that we had $1,500 EXTRA of recoverable depreciation (extra money) from our project and that we could choose to apply it to a new skylight or an upgraded roof vent. "Free money!" he said, and guaranteed we would not have ANY our of pocket expenses other than our deductible and any plywood that needed to be replaced. We chose the skylight with our "extra" money. Come time for the invoice, we are being charged for our "upgraded" skylight, despite MONTHS of back-and-forth about this very issue. The insurance has confirmed that recoverable depreciation can NOT be used for items that weren't damaged by the storm, which the skylight was not. We were completely and utterly conned, and they are maintaining that we owe for the skylight. Their reneging is unethical at best. In addition to the skylight cost, per Traveler's Insurance, their calculations of the amount of recoverable depreciation are not correct. From my insurance rep: "Following numerous discussions with you all, it has been determined that the difference in payment due is due to the amount of REC DEP for work that has not been completed. The amount of 289.67 was left off the final invoice because it was for unfinished work. However, according to our calculations, the depreciation for that work is significantly larger and costs $1,185.88." Not to mention - they left the inside drywall around our skylight a mess with jagged edges that they never repaired.

    I signed a contract with Smart Roof on 7/2/2021 for a standing seam metal roof. Contract price was $26800 with a down payment of $7000. On 8/5/2021, I signed a change order form to include my shed for an additional $7688. On 9/22/2021 I sent $11496 after the building permit had been approved. Work did not begin March 16, 2022. Within a half hour of the work crew arriving I received a call from the project manager on the work foreman's phone. I was told that the shed price was not included and it would be an additional $7688. I was told to sign electronically so work could begin. Fortunately I was able to find the 8/5/2021 change order form, so no extra charge. Incompetence, fraud or both, I'm not sure but it is part of a pattern. On 8/16/2021 2 Smart Roof employees signed an agreement on a list I wrote concerning unique aspects of the job. One of those items dealt with awning braces on the roof. ********* Metal indicated when contacted that drilling through the metal panels would invalidate the warranty. The braces were to be treated like a sky light with flashing. On the day that section of roof was to be completed the foreman and project manager were upset, forgetting the agreed upon list. The panels were cut so they fit around the braces, no flashing was installed and the caulking was low quality workmanship. In talking with *********, they indicated snow guards were need to protect gutters, cars and people. Smart Roof ordered snow guards and sent me a bill for $1900. I counted 15 snow guards in the box I received. I said I would get my own snow guards. I had 112 snow guards purchased and installed for $1620. When the job was close to being complete, I noticed 12 extra grey panels, lots of fasteners and ice and water sheathing. It fits a pattern of padding the bill. Lastly, a ridge cap doesn't match the pitch of the roof, there a scratches on the panels that need painting, and flashing needs to placed around awning braces and chimney.

    The site visit with the crew completing the work was moved to today at 11am. We have additional touchup paint arriving at *** *****s house this Wednesday 3/15/23. During our visit with *** ****, he requested that we get this completed by the end of March, and with weather permitting, we plan to get this installed the week of the 20th. We have the rest of the required materials on site and verified by our Project Manager with *** ****. 

    The shed roof change order was likely a miscommunication and oversight, things we can only make up for in better customer service and attention to detail and sincerely appreciate the member's feedback. This change order and the case of the snow guards have both been resolved. 

    After speaking with *** **** this Tuesday, he is happy with the service he is receiving and looks forward to getting this closed out!

    I am rejecting this response because:  Smart Roof is trying pass off attempted fraud as honest mistakes.  Who in their right mind would call a customer at the last minute of an over $7000 increase in cost for a job without double checking to make sure there was no error.  Calling a half hour after the crew arrived to a job that had been on hold for 6 months appears to be an attempt to pressure the customer into a snap decision to agree with an electronic signature.  The snow guard situation was not resolved, it was a deliberate attempt to cheat the customer.  Being caught is not resolution.  The same project manager who called with the over $7000 increase in overall job cost also signed off on list of concerns by the customer.  One of the items was that the panels needed to be shaped around awning braces and the use of flashing like what is done with skylights.  This was based on the customer's conversation with a rep from ********* (manufacturers of standing seam panels).  When it was time for that section of roof to be worked on, I received a phone call from the same, clearly annoyed project manager.  Either out of spite or poor workmanship, caulking was smeared around the braces with no flashing.

    Currently, there has been a dramatic change of attitude with the customer service rep.  This new rep seems intent on meeting the standards expected for a standing seam roof installation and providing the customer service that every customer should receive as indicated on the Smart Roof website.  I am withholding any further judgement until the job is completed and inspected.

    We have been in contact with **. **** throughout.  We have turned over the personnel associated with the original installation, from the field supervisor, project manager, and operations manager.  We are endeavoring to bring his project to completion, and reach an amicable solution.  We have a metal crew and Project manager heading to his home on 3/28 to review the installation and necessary remedy.  We will have more information after that meeting. We take the customer's concerns seriously and intend to get them remedied as soon as possible.  We remain in contact and will continue to do so until we get this resolved.

    I met with 2 Smart Roof reps on Tuesday 3/28/2023.  They showed up right on the minute of the agreed upon time.  Both seemed intent on taking care of the "cutting of corners" and "slip shod" workmanship directed by the project manager from a year ago.  I don't fault the work crews who did the installation so much as the excessive work hours per day to finish the job and the unethical antics of the project manager.  The workers showed up at 7:30 AM to put in 13 hours on Friday 3/18/2022, worked Saturday 3/19/2022, and 14 hours on Monday 3/21/2022.  They finished work in the pitch dark.  Those long hours and working in the dark are not conducive to quality workmanship.  The project manager attempted to scam the customer, never introduced himself, never sought customer feedback, nor made arrangements with the building inspector.  I will hold final judgement until the project is complete.  I am encouraged by the attitude and knowledge of the new project manager and the experienced metal fabricator to resolve issues with the original installation.

    I spoke with ***************************** , SmartRoof employee, on January 9, 2023, and we ended our conversation agreeing on the following items:1.***************************** would contact the AR Team concerning the $1700.00 for the Ridge Vent.2.**************** and I agreed that I would withhold the $1700.00 payment for the Ridge Vent until an amicable resolution on payment of the $1700.00 pending a follow-up conversation(s).On June 28, 2022, ********************************* visited our home for us to select the color and type of shingles we wanted placed on our roof. ****************** stated to us that the insurance company would only replace the type of shingles that was currently on the roof that was rated at 60-mph wind resistant. Based on his statement to us, we selected the ***** Heritage Rustic Cedar shingles with an upgrade to the Architectural type that would withstand a 130-mph wind resistant with a 30-year warranty at a cost of $1700.00.There was no mention of a Smartvent at this June 28, 2022, meeting with *******************The above statements highlight and summarize the conversations with ***************************** and ********************************* from my notes on the dates listed above.Prayerfully we can come to a peaceable settlement of this pending matter.*******,******* (****) and *************************
