We took 2 motorcycles for specific repairs. Other work was done that we did not approve. More specifically that I had said not to do. It was done anyway and I was forced to pay for the services to be able to take my motorcycles home.

    Business response

    05/05/2022

Hello, I have attached a copy of the invoice for Mr. ***** ***********.  When this vehicle came in to us for service/repair ********** gave myself and my technicians a laundry list of items to take care along with requesting a Safety Inspection of this motorcycle.  After the safey inspection was concluded a suggested list of items that needed to be addressed was given to Mr. and ***********. A written estimate was given to the **** to review.  2 of the 5 jobs that were listed were declined by the client and not completed.  The other 3 jobs were approved by the client and were extensive jobs and noted on the work order as estimates only.  This is also noted at the bottom of everyone of our work orders, under our policies and disclaimers section.

The job that the **** are disputing is listed as Service Job 2 on the work order. My shop did try making contact with them on 4/6/2022 via email and also made a several phone calls thereafter trying to reach them for approval. in a 3 week period we had NO REPSONSE and it was taking up space on one of my motorcycle lifts.  This job had become a safety issue from the beginning because the rear fender was rubbing the rear tire and needed to be ground down so there was no contact.  If there is contact between the tire and fender the tire wears incorrectly and potentially could pop the tire causing a injury or death to the rider.  This part of the job was approved by ********** at the moment the motorcycle was dropped off.  We emphasized to ********** that we dont have set labor hours on this type of job because it is a special situation and that it is difficult to know how much time can/will be spent cutting down the fender. Another safety issue that we ran into was when my technician removed the rear tire for a new tire to be mounted he discovered that the rear brake drum rivets had fallen out and the drum was falling apart as he was moving it and that the brake shoes were hanging only by one rivet.  This is a huge safety issue, it was necessary to replace the rear brake drum and brake shoes.  The chain guard was also broken and was sitting on the bike only being held on by one bolt.  Again, these are all safety issues that we needed to address.  Once we were finally able to get a response from *********** on 4/21/2022 it was explained to her and her husband by my technician on these things and why we did proceed on replacing the parts.  She was upset so I offered to have my technician remove the parts from the motorcycle and I would remove the charges off of the **** and the motorcycle would be ready for pickup the following week.  She agreed to this during our phone conversation then called our shop back 30 minutes later and told my employee never mind about pulling the parts and they would pickup the motorcycle the following day and pay their ****. Per these last instructions that is exactly what we did.  Nothing else was said by either party at the time of pickup. The client received a copy of the work order and the itemized charges.

Photographs and video is available of the parts that were removed.

I hope that you find this dispute in my favor and that the funds are returned to my business.  We work very hard to make sure we follow our clients wishes as well as make sure every motorcycle that leaves our shop is safe.

    Best regards,
