I am low income. I am entitled to the ****** ************* Assistance Program. The Program sent payment on my behalf but yet sent me an overdue notice threatening disconnect my light services during the time of a pandemic. I called Elmhurst Mutual Power & Light Company and they told me that the payment has not yet been sent but a pledge to pay has already been received from ****** ************* Assistance Program. I requested something in writing that my electric services would not be disconnected by 05/24/2022. They refused to send me any written notice that my power will not be disconnected.

I am rejecting this response because:  I never stated any form that I needed from Elmhurst.   I requested something in writing from Elmhurst that my power would not be cut off.  They refused.  I had a right to request such verbal communication in writing.  There is no need for a law firm to be engaged in this complaint.  I have a right to complain to the better business bureau.  Unless, Elmhurst has felt there may be some potential liability, there is no reason to engage the assistance of a law firm.

    Sincerely,

Facts and assumptions bearing on my situation: ELM violated easement laws all utilities placed outside of the right-of-way zone, must have an easement. There is no easement for power service to my eastside neighbor from my property. Eastside neighbors property is comprised of two lots: the front lot on the northside of ***************. in ******** **, and the other is adjacent to the north right behind of the front lot and, per title, both lots have the 10 easements of the property line running northerly and southerly. The east side neighbor has already claimed the easement on the east side of his lot where he has previously installed a power pole. The pole installed on my property has a power line connecting across the lot from west to east which also requires an easement. ELM should have installed the new infrastructure on the east side to the existing pole, not on my property. The Bresemanns, the original owners, created the easements when they plotted the properties. ELM was established in **** and inherited this area for its business from ****************** (PSE). The house on the eastside neighbors property was built in ****. When I purchased my property, an overhead powerline was running above my property from a power pole installed on my westside neighbors property without an overhead easement. Based on the historical dates, I assume that ELM installed the power pole and the overhead powerline ignoring the existing easements on the eastside neighbors property. They also maintained it through its useful life by frequently restoring power after the storms. During construction of my new home, ELM installed underground power line infrastructure and a power pole with overhead powerline on my property to service my eastside neighbors house that is located on their rear lot. All of which is installed outside of the right-of-way zone and do not have the easements. I would think that the correct way of installing the utility equipment would be to

I am rejecting this response because: ********************** intentionally does not admit the fact that Elmhurst does not have the easement where they installed power equipment on the front lot, and it is unlawful.  Without admitting it and without removing the power equipment from my property, BBB file cannot be closed without the adverse funding to Elmhurst.

    Sincerely,
