    We signed a contract with ************************* or Top Notch Fence on May 29th, 2022. For the first month we were being told we were 3rd on his list, then 2nd on his list, he'll be here next week etc... we heard that excuse several times. He is now just ghosting us completely. We paid him a large amount of money for a fence job (over half the total amount).We have now asked for our money back due to no fence being built with no response from him.As another customer of his that has had the same experience as us has said, he came up with ever excuse in the book! I sure wish we could in some way contact the other party who has reported the same experience as us. We mostly communicated with him by text, but also email and phone. He does not respond at all now. He told us he bought all the materials for our fence from *********** but his ***** who is now in jail has the receipts for the materials and he has no access to them so he can't pick them up. We know now that was a complete lie as well. ********** has no record of him buying fence materials, but they do have a record of him buying a bunch of other things between May and now!I too have saved many text communications with him along with emails and record of phone calls.As the other complaintant did, we are also filing a lawsuit against this guy.We wish we would have looked this guy up on CCAP! Because it would have been very telling and we would have never hired him!It is sad that there are people in this world who have no morals, standards or character.

    I hired ****** to complete a fence project for me on May 17, 2022. He was referred to me by a friend, showed up timely up front and set a timeline with me to begin work a week later. Since *** hired him, he has been pushing me off indicating bad weather, trouble with other projects, etc. In addition, all of this was communicated via text despite my outreach via phone and his reasoning was bad reception for an out of town job. When I found a mutual friend, he began communicating but to tell him there was bad news. It is now July 6, 2022, and he is indicating his partner stole my money, and he is not completing the project. This was money received for an insurance claim; therefore, if it is not returned to me, I will not be able to get my needed fence for my property. I have text messages, a signed contract and no fence. This is theft by contractor. He indicates he will return my money via certified check that he will be in touch to send to me. And ** simply supposed to wait to do it his way. Between the excuses, the lack of communication, and from my research the misrepresentation from his business, I truly hope I get my money back and that he doesnt s**** anyone else over. He is also operating under a business name that is not registered but presents himself with letterhead. I have uploaded the contract and bank check that he cashed on May 17, 2022. I have all of the text messages indicating he has my money and not completed the service with no firm commitment of when I will get my money back. You will also see he has letterhead with a business name that cannot be validated in an LLC search,

    Thank you for processing my claim.  My last communication was with *** yesterday when he indicated he would be in touch to return the funds.  I am not confident in this given the history of the experience.

     

    I am in the process of filing a law suit for the money as Theft by Contractor if it is not returned to me easily.  Additionally, I am inquiring if it would be helpful to send the saved text messages to store with the record of this claim?  The texts  are very telling of how he conducts business, and I know he is in the process of s******* more people out of money, as well as I dont want him to be able to do so going forward.

     

    I also found a post on ******** from 2017 indicating  that he is fraudulently identifying himself as Top Notch Fencing with 2 people indicating he has scammed them.  I honestly would have never hired him had I known what I know now, but it was a referral so I trusted him.  And, now I am without a fence or the money needed to repair it.
