The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.
Update: On November 15, 2023 the court granted that the state's motion for default judgment is granted since the defendant failed to file an answer or otherwise provide a defense response to the civil action, and no cause has been shown for the Defendant's failure to a timely file an answer. To date, here has been no determination on any equitable relief.
On March 17, 2023 the West Virginia Attorney General Patrick Morrisey filed a lawsuit with the Kanawha County Circuit Court against Larry Morehead d/b/a L & M Construction who allegedly performed home improvement projects for consumers in Kanawha County without a license, failure to complete the work, and failure to furnish proper notice of the three-day right to cancel. Charges filed allege the business is in violation of the West Virginia Consumer Protection Act (WVCCPA), West Virginia Contractor Licensing Act (WVCLA), and the FTC Rule three-day right to cancel.
The action seeks to permanently enjoin Morehead from providing home improvement or contracting services as the owner of a business, or as an employee, agent, subcontractor, or in any capacity Additionally, the action seeks to award the State judgement against Morehead in the amount representing all payments collected by Morehead for unlawful home improvement contracts and additional amounts consumers have paid or will pay to others to complete the work or repair damages to property caused by Morehead, as well as a civil penalty of up to $5,000 for each violation of the WVCCPA, as well as reimburse the state for all its costs including reasonable attorney fees.
