PUBLIC SERVICE ANNOUNCEMENT! Do not buy anything from Capital City Auto Auction, owner Joe P***, unless you personally crawl all over the vehicle with mirrors, lights, cameras and anything else that will help you, to make certain you are getting what they are calming it to be. I personally bought a vehicle, advertised and announced, to have a 6.2 LSX engine. After I loaded it and got it home it has a 6.0. I got in contact with the auction and had many conversations. In the end, to bad, I'm on my own. That is false advertisement and I disgraceful way to do business. Please be do your do diligent or you will be sorry.   The vehicle was purchased 09/27/24. It's a **** Chevrolet Silverado ****

[I would request that the complaint be edited to remove the bold verbiage indicating that the comment is a public service announcement, or a statement added that the complaint is neither endorsed or published as a public service announcement. Public service announcements are a specific type of announcement which are commissioned by a government or non-profit group to raise awareness on an issue that is of interest to the general public. In the case at hand, the complainant is an individual not a nonprofit or a governmental entity. To leave this description would likely create a false impression as to the validity and accuracy of the statement and would unjustly and potentially negatively impact our business.]

Response: The crux of this complaint centers on the subjectivity of what qualifies as an LSX 6.2 engine. While the engine was a 6.0 block it had been modified with 6.2 parts and bored out to a 6.2. This unit was put on an “offer” because the vehicle reserve was not met. At which time the high bidder, sought out the owner and freely negotiated the terms of his purchase in a face to face conversation after the bidding closed.   The vehicle in question was advertised with the language and description provided by the owner. This vehicle was sold as-is and where-is. The purchaser was afforded every opportunity to inspect the vehicle before the auction and after the bidding closed while he continued to negotiate terms of the sale. Additionally, the customer signed a contract that provides in pertinent part, “[p]roperty is being sold ‘AS IS, WHERE IS’…Neither the Seller nor Capital City Auto Auction, Inc., as auctioneer, shall be liable for any representation or warranties, express or implied, respecting the physical condition, size, milage or characteristics of the property being sold.”(emphasis added, “Classic Car Auction Registration Agreement”).  The terms of the sale are final.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

The vehicle was announced and sold as a 6.2 LSX engine. It was never disclosed as a 6.0 modified engine. I provided proof it is a 6.0 which is clearly stamped on the block. Even if it is a 6.0 built to 6.2 LSX specs it is not a 6.2 LSX engine as it was advertised. I understand "as is" conditions but I did not get "as is" which would have been a 6.2 LSX engine. I trusted Capital City Auto Auction to do the right thing and help me resolve this issue but they did nothing in an effort to help resolve this issue, they just took the word of the seller as the truth when it is obviously not. I'm certain that Capital City Sold what was presented to them by the seller, but they have means to force the seller to make this right and choose not to most likely because the seller is a regular customer of the auction. If you buy a loaf of bread at ****** and it's bad you don't contact *** ****. You go back to ******.  Bottom line is, I want what I paid for and will not quit until I get it. If this doesn't work, I will find another way.

    Regards,

    ***** ******
