I Stay in the Trails of ********* Community. In Order to Get a Parking Permit I Would Need Current Registration and Insurance so Since I Was Not Able to Provide That I Was Not Able to Get the Parking Permit. On July 12, 2024 ASAP Towing Towed the 2011 Dodge Ram 1500 Truck From My Parking Space. I Wasnt Able to Get the Truck Out Until July 16, 2024 Because ASAP Towing Said That I Had Needed a Picture ID and Permission Stating That I Could Get the Truck Out of Their Tow Yard Since the Truck Was Not in My Name. Once I Provided What They Asked For They Released the Truck to Me and I Paid $730 to Get it Out. $500 in Cash $230 on Cash App. On August 2, 2024 They Towed the Truck Again. I Took the Lyft to the Tow Yard a Few Hours Later and They Would Not Release the Truck to Me Due to the Tags Being Expired. So I Expressed to Them That I Had Previously Got My Truck Out and the Lady Stated That the Law Has Changed so I Asked Her When Did This Law Change and She Said It Would Have to Have Been Recently so This Is the Reason I Cannot Get The Truck Out at This Time. So I Asked to Talk to the Supervisor. The Man Came to Talk to Me and He Said That Due to the Law He Could Not Give Me the Truck. I Told Him That I Was Able to Get My Truck Out Just a Few Weeks Prior and He Said I Don't Know Who Gave You the Truck but We Have Fired People. The Same Woman Who Released My Truck July 16th is the Same Woman That Was Working in the Office on This Day. I Asked Him When Did the Law State That a Person Could Not Recieve Their Truck Because of Expired Tags and He Had Said January 2024. I Understand the Law is the Law Yet I Feel Like They Robbed Me of $730 by Not Honoring the Law July 16th When I Was Able to Retrieve the Truck the First Time They Towed It. The Law is the Law but Bending the Law for Financial Gain Should be Against the Law Especially If the Establishment Is Going to Pick and Choose When They Break The Law.Initial Complaint

My car was towed from my apartment complexs parking stalls at the end of July. Ive had issues with the management company and property manager before. She claims she didnt know it was my car which is ridiculous being that Ive parked in-front of here living room windows for two years and have greeted her many times while entering and exiting my vehicle. My issue with the two company is over my request for documentation. My car was removed from private property CA towing laws and regulations require there to be written authorization for its removal, 3 times Ive spoken with them. My car according to the property manger was taken sometime ther night of Thursday July 26th or Friday morning the 27th. Im writing this August 14th.. I wont count weekends, but thats 13 days now they have had my car and charging fees. Seems like they want to get the most of a victim or be able to profit from the car sale. Ive asked that document be sent by email. Its a fairly simple accommodation request being that they have my only form of transportation. I wish this could have just been a dispute between me and my apartments and them engaging in retaliation for complaints made for mold growth but aside from that Ill now have to seek advise for what may be predatory practices done by ASAP towing and Recovery. The only document they sent me was an intimidating one about vehicle abandonment and failure to comply could result in me losing my drivers license. Trying to come up with cash for fees while Living with a disability is practically impossible, made even worse by the rent increase the property informed me of shortly after having my car towed. I want my car back, its removal was done with bad intent. I should not be bullied for payment fees or bullied out of a car.Initial Complaint

(This is part of my email to company, leaving out part of the other companys names that were involved)Dear ASAP Towing,I trust this message finds you well. I am writing to you concerning an urgent matter that has, as of today, remained unresolved, despite prior communication attempts.Recently, on 2nd February, 2024, my 2015 Mazda3 was illicitly towed from (I inserted my apartment complex for them) visitor parking space. This was done without any prior warning or legitimate justification, causing me considerable distress and financial inconvenience.I must point out that there was no indication on my tenant parking permit suggesting that it was not valid for use at this particular space, nor had I been made aware of any limitations on its use. Therefore, I believe the towing of my vehicle from this location was improper and unjustified.I am, thus, seeking full reimbursement for this unfortunate incident, in line with my rights as a tenant.Despite multiple emails to the concerned parties BFM, ***, and your organization, ASAP Towing I have yet to receive any satisfactory response.My request for legal justification, evidence in the form of photos or video footage of the incident, and reimbursement has been repeatedly ignored, prolonging the resolution process and exacerbating my distress.While I would greatly prefer to resolve this outside of court, please note that, should we not reach a satisfactory agreement, I am inclined to pursue legal action. Understandably, I hope it doesn't escalate to this point and we can come to a mutually agreeable resolution.In the unfortunate event that a lawsuit becomes necessary, I will be compelled to seek redress to the full extent of the law, including but not limited to, damages, legal fees, court costs, and accrued interest.I am hopeful we can resolve this matter amicably and promptly. Unfortunately we cannot provide a refund. Please contact our office if you are in need of more information regarding your vehicle. I am surprised that you do not have pictures showing you were parked where you should not have. All pictures are given either from us, security which in this case is *** security and or the management office. Your community has strict rules and regulations regarding parking which are given to you at the time of your lease agreement or purchase which you likely signed and agreed to in order to live there correct? You are well aware of those rules and regulations and know it would not be printed on your vehicle permit which as you know only allows you to park in your assigned space. We are just doing our job when we are called out to remove a vehicle. Warnings are not given by us nor are they required this is not our job. I believe warnings are not given because the inconsideration shown by violators such as yourself feel that other residents should just have to wait for you to get a warning first to make the parking spot available to the rest of your community? Residence have a right to legally park in their own designated spot but not in a visitor spot, visitors have a designated area and the right to have available parking without having to wait. Parking is needed right away and those not following the rules and regulations of their community show no regard for others trying to find parking by parking illegally in areas that belong to others will be towed away at the request of management and your hired security company, and towing charges are a vehicle owners expense as it is written on signs and mandated by the ********** Vehicle code.

Their information is inaccurate and concerning. There is no limitation on my parking permit. Sign says parking permit required. Which is what I had. Anything outside of that, a competent person would know that it would need to be legally in writing or signage.

This person parked on private property with signs posted with all the legal verbiage required by the vehicle code that no overnight parking is allowed! At the property owners request we showed up to remove the vehicle which we did by law is 1 hour after the property owners request. She showed up as we were hooked up with the vehicle and offered to release vehicle at the drop fee of $100.00 she refused. We added to say that if she did not then we had no choice but to impound the vehicle which would amount to much more, $485 to be exact but she refused and was the one to be threatening and verbally abusive to the driver. We then called out the sheriffs who let her know we were in our legal right to tow away her vehicle and charge a drop fee and also an additional standby time for keeping us longer than necessary and wasting our time! So in total she finally paid while the deputys present!! We will not be refunding her!Customer response

I am rejecting this response because: in fact the employee was threatening and demanding more than the standard tow fee of $360 to be paid zelle or cash only. When the sheriffs came he reduced the fee to $150. The Sheriff's are aware of this company's fraudulent tows as I spoke to the watch Commander who is also doing an investigation. This tow company targeted different areas of *********** coming all the way from *************** to take advantage of people as they threatened to tow if money wasn't paid up front. I would like to proceed with my complaint and need my refund. I spoke with the dental office which I'm a client of and denied anyone from the management contacting the towing company.

Bandit tow. These people threaten you and will do anything to keep your car. This company claimed that a security guard called and said I was parked illegally. My community DOES NOT have security. These people work with others who scope out cars even on private property. They even tried to send me fake text messages between them and our security which again WE DO NOT HAVE. I showed up at my appointment time to retrieve my car. The guy said his driver would be there in ***** minutes. When he arrived, he was extremely hostile asking us what do you want? When I told him which car was mine and requested that he give me a detailed invoice and before I paid I wanted to check my car for damages, he became extremely aggressive towards my family and I. He was looking to fight and threatened to beat our a** Then said he wouldnt give me my car until 2 days later on Monday. Is that even legal? These people are the scum of the earth and their business is not legitimate. Please look into this scam business.Business response

We understand how upset people get when their vehicle is towed away. We are a family operated business we do everything in our power to defuse a situation and not escalate things as this customer claims we did.
We are called out by either security, management, property owner and or authorized HOAs board members who are in charge and responsible for keeping the property safe, secured and free of all unauthorized ilegal parking as its stipulated within their communities rules and regulations. We have a signed contract with every property as required by law in order to tow out of any public or private property. There are situations and I do not know should this be the case since we do not know where or when this vehicle was towed as they did not give that information, but should we see the customer is being verbally abusive and or aggressive, and angered as I feel this was the case with this customer we do not go into details of the name of the authorized agent that signed and requested the tow away. We keep it simple and say it was security/management and to contact their management office for more details to whoever was authorized and requested to have the vehicle towed away. We are not allowed per California vehicle code to tow away without authorization unless its in a designated fire lane or or blocking access to any entrance, or exit. The authorized agent is considered acting security and is authorized by the property owner or management to do so. Mr/*************** was illegally parked and its why he/she was towed! If they have an issue they are able to to take us to court and prove their case as to why they should not have been towed! We have cameras fitted in every truck, we by law have the vehicle photographed before and after it is towed, we have a signed contract and a signed or digital request to tow away his or her vehicle. If our driver was so aggressive and threatening he/she should have called the police but they did not. Its obvious he/she is falsely accusing us because they were the angry, aggressive and threatening person in this case to our driver who only was doing his job. We will not refund. I am rejecting this response because:After this incident, I did have an opportunity to talk to my HOA who did confirm that we have security which I was not aware of. I was only parked illegally due to our community not having enough parking for residents like me. This is an ongoing issue that ultimately HOA needs to fix. However, I did call the police after this employee threatened my partner and I. I did call 911 and the dispatcher at the local sheriffs office told me togo to a safe location to escape this employee as he was approaching us. Dispatch also informed me they couldnt come out for hours nor could they make this business give me my car back, but how is it okay to keep my car from me? I was quoted $485 and because this employee had an ego, he was allowed to keep my car for 2 more days which left me with a $520 bill. Look at the reviews for this company, this is not an isolated incident. I dont appreciate being called a liar when there is a ******************* as we were being threatened. I am but angry about the tow I am upset that my life was threatened and my car was kept from me causing me to pay more than originally quoted.

I parked my car in front of my own garage because the garage door was broken and couldn't be opened. This morning, a driver from this towing company came and towed my car from my property. I intervened and stopped him, but he demanded a $140 drop fee before he would release my car. He insisted on cash or a Zelle payment. In order to get to work on time, I had no choice but to pay him the $140 and have my car released. Afterwards, I did some research and contacted other car owners who had their cars towed by the same company. Many people mentioned that they always claim their credit card machine is broken and only accept cash or Zelle transfers. I believe this raises suspicions of predatory towing and fraud because it prevents car owners from disputing the charges through their banks. Furthermore, I understand that the driver engaged in predatory towing since the tow truck was still parked on my property, and when I asked him to unconditionally release my car, he refused and demanded payment. Additionally, this towing company's pricing practices seem fraudulent, and I have documented the receipt as evidence. They ************* two wheeled dollies under my car's tires and then claimed additional "labor charges." I strongly question their professionalism and demand a refund of the amount paid. Otherwise, I will report this towing company to the relevant authorities to investigate their legality.Initial Complaint

My Son and I visited ********************************** in the ****************. We had a lot of trouble finding parking. We drove around for 45 minutes without finding any parking. We ended up finding a parking spot in the ****** Hills Plaza. Approx 2 1/2 blocks away from *****************. We parked there because we were also going to shop at the *** Ash store in the parking lot.After our shopping experience we went to look for our car, and it was gone. We called the ************** They informed me that my vehicle was towed by ASAP Towing in ***************.I called ASAP Towing. They told me that my car was there. They informed me that I would have to pay $430 to get my car back.My Son and I had to take an UBER there to ASAP Towing. Once we arrived there I gave them the keys to my car. They pulled up the car and I retrieved my registration out of the car. My vehicle is a 2013 ***** Accord. I gave them my registration and my Drivers license.When I was going to pay the $430 fee, they told me their credit card processing machine was broke. They informed me that I had to pay them with Zelle or cash. I ended up paying the $430 fee, which is absolutely ridiculous, with *****. Once the payment went through, they gave me back the keys for the car.After my Son and I drove 90 minutes back to our residence, I noticed I had several areas of my car were damaged. See attached photos.Based on what I have read about the reviews of this Company on ****** and Yelp, and what I witnessed in the parking lot. I believe this ASAP Towing in conducting predatory towing in all the parking lots adjacent to the **********************************.I would like ASAP Towing to refund me my towing fee of $430 and pay for all of the damages they caused to my vehicle. I purchased this ****************************** 2013. I have taken very good car of my car for the last 10 years. My car was towed by ASAP Towing while it was still on private property (inside a condominium community). I saw my car being towed right in front of me, I demanded the tow driver to uncondtionally release car to me under ********** Vehicle Code *****. The tow driver refused and instead he drove the tow truck out of the condo community and to the public road. There the tow driver dropped off my car and charged me $195 drop off fee. This is a clear violation of the ********** Vehicle Code *****. The tow driver is subject to a civil misdemeanor, a fine of $2,500, and/or three months in jail.
