I receive a half-dozen spam emails a day connected to "Defense Gutters". Every email has a different "from" address and a different domain name, so they cannot be effectively blocked. Links in the email trace to Digital Media Solutions. I would like my email address removed globally from all DMS connected lists. The email address I want removed appears in the "Desired Settlement" field.

Last night, the ******* tried to sell me a fraudulent loan through their subsidiary "Loan Advisor," which operates under the shell ******* of ************ LLC. This was done through SMS with the ******** number of ************** that reads "Thanks for submitting this request. It is approved" with a hyperlink to the website that can ONLY be accessed on mobile devices, instead redirecting to ****** on desktop or tablet.I have never requested any loans from this *******, so I investigated this ******* further and found that they are also selling fraudulent mortages, extended warranties, ******** plans and student loan relief plans under multiple subsidiaries and shell companies. As a result, I have taken to informing the ******** and ******** ************************* about their fraudulent business practices in the hopes that they stop. One day later, I received a new text message from the ******** phone number ************** that reads "We have reviewed your request! For the entire amount you have been pre-approved: for the full amount:" with a different link that functions similarly to the one they sent me last night. I want this ******* to stop violating the **** and start paying me $1,000 for every violation they made, which at the time of writing, is at least 2.

This lead generation company has been calling me several times a day, using false names and "spoofed" local phone numbers to hide their identity from consumers. They have mostly been promoting debt relief, ask you qualifying questions and then transfer you to reps at different companies. They get paid by these other companies for each lead that is sent.My phone number has been on the national do not call registry since 2006 and should have been on their internal do not call list (what a joke) since January 2021. I have received over 35 calls since the beginning of July 2022.They have even attempted to falsify an opt-in to one of the companies when I called them out for the intrusion. This company has several lawsuits against them for violating TCPA regulations, as they continue to disregard the laws set forth to protect consumers.

DMS has not placed any calls to your cell phone since it was added to our internal DNC list in 2021. Please direct your complaints to the parties responsible for placing these calls.

I am rejecting this response because: DMS Group is willfully being untrue to avoid legal action.

The company that received the transfer from the call center has identified and confirmed that the call came from DMS Group and included the contact information (attached).

That call was then linked to several other calls to my cell phone.

    Sincerely,

Starting on February 19th 2022, I began to get text message advertisements from "SimplyJobs.com", "SimplyGigs.com" and "Ultimatejoblist.com", all from the same code, XXXXX, on my cellphone. My number is on the Federal Do Not Call list, and I never contacted any of these companies or gave them permission to text me. I sent the company notice that they were violating both Federal and State law, and ALSO "opted out" of the text messages, which was acknowledged by the message "you are opted out and will receive no more messages. For help, please call *******-****. Since that point, the company has sent at least EIGHT more messages. At this point, I need to speak to the company's ATTORNEY or LEGAL REPRESENTATION to resolve this matter. Not only is it a TCPA issue, it is also a harassment issue as well. They need to be aware that simply "removing my number" will not suffice at this point. I fully intend on vigorously pursuing this matter to it's legal conclusion.

Business Response /* (1000, 5, 2022/03/29) */ We have investigated this matter and reached out to the consumer directly. DMS only contacts consumers based on express written consent under the TCPA. We have added the consumer to our Do Not Call list. Consumer Response /* (3000, 7, 2022/04/01) */ (The consumer indicated he/she DID NOT accept the response from the business.) The company was never given consent, and on top of that, continued to send telemarketing texts after told to stop, and acknowledged that request. They refuse to take any responsibility for this. I intend on pursuing this matter via litigation if necessary. Business Response /* (4000, 9, 2022/04/15) */ Consent was received for multiple phone numbers associated with this individual. DNC requests were accepted for individual phone numbers when received. Now that we know all of the numbers are associated with the same individual, all numbers have been DNC'd. Consumer Response /* (4200, 11, 2022/04/19) */ (The consumer indicated he/she DID NOT accept the response from the business.) AGAIN, even though they were specifically told to STOP, and acknowledged that request, my number ending in **** was telemarketer too via text, NINE more times. A cease and desist request was put in via the code XXXXX on 2/19/22. It was acknowledged by the company immediately. Yet, I continued to receive text ads on Feb 27, 28, 29, and March 15th, 17th, and 20th. A total of NINE (9) times after the request to stop. So even if consent was originally given, which it was not, the TCPA was STILL violated when the company did not stop when told to. I am offering DMS one last opportunity to resolve this matter. They need to have their attorney reach out to me no later than 4/25. Otherwise, I will forward this matter to an attorney that specializes in TCPA matters. Business Response /* (4000, 13, 2022/04/26) */ Ms. ******** We cannot discuss demands of this nature on this platform. We would of course be happy to discuss this further with you or your attorney. However, we ask that you please contact us at *****@dmsgroup.com
