    The company agreed to a settlement payment of $800 and pay at least $100 over the course of 6 months beginning 8/19/24 and to bring my account current once I made my first payment. I made my first payment and the company didn't bring my account current as agreed which has now negatively impacted my credit score. Today I received a call from the company stating that my account was 93 days past due and I explained to her the arrangement of the settlement that was made. She said that I had not made any payments towards the settlement which is inaccurate and said my account will be charged negatively until the arrangement is honored. Mind you these calls are recorded and I have payment statements that prove I have indeed been making payments towards the arrangement made. I'm unhappy about the company not bringing my account current and my credit being impacted due to this. I also am frustrated that the company isn't on the same accord and I have the company calling me harassing me every week about when I'm going to make my next payment when I have established that upon making my last payment. I was also pressured to make a larger payment initially by one agent, and when speaking to another agent I was told that making a larger payment was untrue

    I disputed this account account on August 20, 2024 for this reason. ********** completed their investigation on August 28, 2024. I am requesting a description of the procedure that was determine the accuracy and completeness of the information that I disputed. According to ** ****** * ******************** you are required to complete your investigation of my dispute and provide me with the results within a reasonable period. If your investigation finds that the information is inaccurate or cannot be verified, you are obligated to correct or remove the disputed information. Here are the details of the disputed entry: Account Name/Number: U.S Auto Credit Description of Inaccuracy: I am disputing the accuracy of the account listed under with account number ********** The report incorrectly shows a balance of $941 and indicates that I have 13 late payments. Requested Action: If the information is incorrect and cannot be verified, request that it be removed from your credit report.     ATTN: Compliance Manager ******** ********* I revoke US Auto Credit's power of attorney over this account. and request their finance licensing number & their bond number to collect the debt in Texas. I have documentary evidence that US Auto Credit misrepresentation this account as a loan when it is a Retail Installment Sells Contract, & I have never entered into any contract with US Auto Credit. Neither can they produce a wet ink signature contract from me and US Auto Credit which would obligate me to pay a debt. ******** ********* does not have knowledge of this contract and neither is authorized to deny the Cancelation of this debt & I request that this matter be escalated. Section 201.102 of the Texas Finance code: An out-of-state financial institution must file an application for registration with the secretary of state, before operating a branch or other office in this state, by complying with the law of this state relating to foreign corporations doing business in this state, notwithstanding a provision in that law that.... Section 305.001 in Texas Finance Code: Liability for Usurious Interest (a) A creditor who contracts for, charges, or receives interest that is greater than the amount authorized by this subtitle in connection with a transaction for personal, family, or household use is liable to the obligor for an amount that is equal to the greater of:... Texas Finance Code: 302.001. CONTRACTING FOR, CHARGING, OR RECEIVING INTEREST OR TIME PRICE DIFFERENTIAL; USURIOUS INTEREST. (a) A creditor may contract for, charge, and receive from an obligor interest or time price differential. (b) The maximum rate or amount of interest is 10 percent a year except as otherwise provided by law.... An installment sale cannot be used when the property or asset is sold at a loss or if the personal property or real property is sold by dealers.     I pulled a copy of my consumer report and noticed some items I would like to dispute. I have suffered emotional distress as a result of this matter and I have felt suicidal lately as a result so I demand this matter be resolved in a fair and equitable manner, which hasn’t been done. U S AUTO CR ********* These account are related to a transaction and experience that falls under the EXCLUSION section of the ****** definitions; rules of construction section. It was also reported without my written consent and therefore is a result of identity theft (as defined by the ******* ***** **********), and the accounts SHALL be deleted. This account is not related to any transaction authorized by me, the consumer as I did not give written instructions to your agency to report this, which is a violation of the permissible purpose section of the ****, which holds your agency liable for damages of at least $1,000 per the civil liability section for willful non-compliance. Please DELETE this item from my consumer report! DELETE THESE ITEMS AND ISSUE ME A NEW, UPDATED COPY OF MY CONSUMER REPORT!

This has caused significant financial and emotional distress. As outlined in 15 USC ***1 Section 602, I assert my right to financial privacy and expect my information to be handled confidentially. Additionally, 15 USC ***1 Section 604(a)(2) underscores that a consumer reporting agency cannot share account information without my explicit consent, which I have not given. I have noticed discrepancies on my credit report attributed to U S AUTO CR, adversely impacting my financial situation. I urgently request the correction of these inaccuracies. Furthermore, I want to emphasize 15 USC 1666(b), which prohibits creditors from treating credit card payments as late under specific circumstances.     I had a car towed in 2019 and I was unable to retrieve the vehicle because US Auto Credit contacted the tow agency telling them not to release it to me because it was in repossession and they would send someone to Retrieve it, but I made payment arrangements with them prior to it getting towed. US Auto Credit never sent anyone to get the car even though the tow agency reached out to them several times and sent storage bills. The owner of the tow yard said he never experienced anything like this. 7 months after it was towed and I was unable to retrieve it due to US Auto Credit, the tow company sent me a bill for $3800 in storage cost along with a lean stating it was going into auction. I contacted the tow yard again and was told I still could not retrieve the car and they only sent me the letter because I was the registered owner and they were still fighting with US Auto Credit saying they were coming. Now in 2023 US Auto Credit is reporting on my credit $16000 in late fees and stating they can not locate me. All this is lies and they can not charge me for late fees on a car they put into repossession making it impossible for me to retrieve. They made this situation not me and are causing a hardship in my life due to it. I have all documents from the tow yard showing IS Auto Credit is at fault not me. There is record with the state DMV that this car was sold at action so they can not hid that all this happened.
