    Aprox 5/11/23 I sing a contract with rep ***** for ****** it included 6 total sheets of plywood and 40ft of fascia free and I told that if any additional materials were needed I would be notified by phone, verbally. I was home all day during the work process, I also went outside and talked with the man in the truck overseeing the work I specifically ask if there were any additional problems, he said no all is going well. No ever contract me about additional materials need ,nor did they obtained my authorization for any additional materials or work to be done as promised by company rep ****** I have a witness that was here with me doing contract signing. After under was put on,a rain cam and a leak cam thru my ceiling fan and water all over the floor I showed a worker,they stop the leak, I was told all roof flashing would be replaced, it was not same blue flashing from over 30 years ago still on part of roof,no wind test was done. I was promised 6 months same as cash on loan,that was also false. I am paying for the agreed contract amount but the additional billing was not authorized. Workers left 4 rolls of underlayment, 3 rolls of ************** rolls flashing, 2 buckets of liquid tar, 2 pals of new tacks,3 sheets of plywood, 4 boxes of shingles a man in a truck came and picked it all up ,he left 1 plywood not enough room on truck I asked did I pay for all of that,he said no just extra un used. I feel like it was a breach of contract and unethical business practices. Please assist if you can.

    08/10/2022 $9,174.32 Roof repair or replace.They want more of real cost.They put a lien on my property.*************************** began with a terrible attitude towards us to the point of threatening ** that they were going to put ** in prison for not paying them, and since we did not give him the second check, they decided to put a lien on our property. We have inquired with other companies and the one that charges ** the most is $7,800.00 for ***** sqft. I don't know why they want to charge. more than $23,000.00 if we already paid a check that our home insurance sent us for $9,174.32. We think that's enough adding $1,000.00 I paid for my deductible. ************************* says that the second check we got from our home insurance, also belongs to them in its entirety and since we didn't give it to him, he was very rude to us, emphasizing his threats in a terrible tone of voice. We recognize that we made the mistake of signing the contract without estimating the charge, then they came out with that invoice with that high amount of money. We trust them and now they want to hurt us with that lien on our property. I have had open heart surgery for a few years and this anguish with them is killing me when I should be as relaxed as possible. We're asking that you please reach a fair amount for us to pay, they're charging us 3 times for roof repairs and It's not fair.     We are writing in response to the complaint you filed with the Better Business Bureau regarding your agreement with Legacy Roofing. We understand that you signed a contract with Legacy Roofing on 8/10/2022, which clearly stated that all the roofing insurance proceeds you receive would be for the pay to Legacy Roofing. You worked with the ** to get the settlement, and once we received the *** funds and your deductible, your roof was repaired to your satisfaction on 11/8/2022.
    However, we understand that you have since received a check from your insurance company for $17,967.28, and you have refused to give this money to Legacy Roofing. We want to clarify that this money was not intended for you, and it would be considered insurance fraud if you were to keep the funds for yourself.
    We want to assure you that we have followed all the necessary procedures and obtained all the required approvals from your insurance company. We are attaching a letter from Elite Resolutions Public Adjuster explaining everything that happened between when you signed your contract and now, as proof that we have followed all the correct processes.
    It is important to note that by law, you cannot keep this money, and we urge you to act in accordance with the terms of your contract. We understand that you may have concerns or questions, and we would be happy to discuss this matter with you in further detail to come to a resolution.

    I am rejecting this response because:

    I was doing some research and wanted to be sure about what I was going to tell you. The price for the roof's repair of my house is not worth more than $10,000 which the contractor have already been paid. The $17,967.28 check the insurance is paying is for the depreciation on our house.  According to the law, that check does not correspond to the contractor because he is not the owner of the house, the owners are my husband and I, we do not want to keep that check as they say, I rather not to receive a single dollar than let the contractors keep that money that don't belong to them, that's illegal, simply I do not like injustices and since that check does not belongs to them I prefer that insurance not pay for it, but nowhere in the law does it say that the contractor has to keep the property's depreciation check, that is fraud and it's not me who's trying to do it. Therefore I need them to remove the lean that they put on my property, that's unfair since what they are doing with us is against the law. What are we supposed to do now?

    We cannot remove the lien until we receive full payment for the services rendered. The insurance company has determined that the depreciation payment should be directed to the contractor. Please consult your insurance company for further clarification. If necessary, we may proceed with collections to resolve the matter.

    I emailed the insurance company and they still haven't responded to my letter, so I'm asking you for a few more days to send you a respond please. What they answer me will be the final answer to close this case. Please have some patience, hoping tomorrow May 30, they will reply my email. Today is a holiday and I haven't received anything yet.
