I contacted Mold Consulting group (aka The Mold Law Group) on October ******* seeking assistance with mold testing and remediation protocol guidance in my mothers home. I signed a contract for professional Environmental analysis by a certified mold inspector and review by an industrial hygienist. The reported in writing prior to the inspection, verbally at the time of the inspection and again in email writing to industrial hygienist after receiving report of history of basement flooding. At the time of the inspection I verbally authorized the inspector permission to remove a piece of paneling or cut and remove a piece of carpet to allow for complete inspection of the basement. It was determined source of mold infestation was a leaking pipe. I again questioned the source of mold and the industrial hygienist confirmed a pipe being the source. 2 days ago my local mold contractor kicked up a loose tile in the basement which revealed rampant mold, under the basement tiles. There are 750 sq ft of infected basement flooring tiles with underlying mold. The Mold Consutling/Law group failed to accurately test and report the true source of our mold infestation. They did not include removal of carpet or basement tile in the remediation report. Had we followed their HEPA vacuum recommendations, the mold would have never been properly treated *** tens of thousands of dollars would have been wasted.I emailed this company December 3 requesting a refund in the amount of $3750 and sent a photo of a lifted basement tile showing mold as evidence. **** ********, CONSULTING DIRECTOr, replied at the end of the day I have escalated your request to the team for review and I will have someone reach out to you tomorrow to talk about a solution. Is there a good time I can call you tomorrow? And replied immediately 12:15 or 3:15 tomorrow works for me. I did not receive a reply or phone call today.I am requesting a refund of the environmental analysis I paid

At Mold Case Consulting, we prioritize safety and comprehensive environmental assessment with the utmost care and precision. Our approach to property evaluation is designed to protect both our clients and our team by following stringent safety protocols. Understanding the Mold Case Consulting testing requires a careful, methodical approach, especially in older properties. For homes built before 1981, numerous building materials may contain hazardous substances like asbestos. Our commitment to client safety means we take no unnecessary risks during our inspections.

Mold Case Consulting does not do invasive testing beyond the visual conditions of the environment, which is stated in our protocols and reports. The reason why is because of liability due to putting individuals in a dangerous environment, which could create a potential exposure to unknown environmental hazards, such as asbestos. The proper safety protocol would be to test the environment for asbestos BEFORE any invasive testing is done, specifically tiles to be removed. According to *************************************, materials are presumed to contain asbestos if installed before 1981. Examples of these materials, as well as other presumed asbestos-containing materials, are:
      Thermal system insulation
      Roofing and siding shingles
      Vinyl floor tiles and adhesives
      Plaster, cement, putties, and caulk
      Ceiling tiles and spray-on coatings
      Industrial pipe wrapping
      Heat-resistant textiles
Automobile brake linings and clutch pads

Ms. ****** informed us this home was built before 1978 and presumably the tiles kicked up by her third party contained asbestos-containing materials, which would create a dangerous environment involved.

The following limitation is listed in our companys report and protocols:

Mold ************ has no prior knowledge or knowledge of any hidden, unapparent, or adverse environmental conditions regarding the property named in this written protocol, including the presence of mold, bacteria, hazardous waste, toxic substances, or pathogenic materials. ***************** makes no guarantees or warranties, express or implied, regarding the condition of the property. This report is not a total environmental assessment of the property. This written protocol is based on the visible conditions of the inspected areas and materials. ***************** reserves the right to revise opinions and conclusions for said written protocol if necessary and warranted by the discovery of new or additional information. This report is specific and limited in nature and shall not be relied on as a statement that no microbial, benign, or pathogenic substances exist, or do not exist within this property. It is always possible that hidden microbial growth exists beyond any visibly accessible areas. The additional area may be subject to change based on new facts or findings. We have used all the sources and data made available to us by all parties. We do not warrant the accuracy of third-party information. Should any party with an interest concerning this property come into contact with any data that has been omitted from this report or arises at a later date, please contact ******** ******** immediately at ************ or **************************** with the information that we may appropriately amend this report.

On October 16th I was contacted by Mold Case Consulting about results from my mycotoxin sample and was advised i needed to talk to a specific doctor urgently they told me it would be a $500 fee to speak with the doctor and they would call me within 48 hours. After 7 days I called and requested a refund because i was NOT EVER called by said doctor. Still today I have not been contacted. I was told by ****** Roof that he processed a refund and it would either be refunded to my card or I would recieve a check. I have now called ****** on 3 occassions with a call back number on his direct line and I am being IGNORED with still no refund. This is seeming very much like a SCAM to me.

    11/12/2024

Dear ******************** you for your feedback. We have looked into this matter and found there was a miscommunication with you and the doctors' office. The refund was put into our processing system and was idle. Our Director of Client Strategies ****** Roof about the same time was called into a family emergency that kept him out of the office for an extended period of time. This led to the delay in the refunding process. We acknowledge the delay and therefore have at this time provided you with a full refund. If there is anything else we can assist you with please feel free to reach out.

I began to use the services of Mold Law Group ( now Mold Case Consulting) In July of ******* first my calls were answered and returned pretty quickly or in a timely manner. I worked with *****. I was told many things about my possible case that I've learned are not true. They make it seem very cut and dry and while you are still in the paying phases, show empathy and offer promises of resources that are rarely brought to fruition. I was told they would assist in finding an attorney to take my case, however, every time I got the email that a local attorney had agreed to consult with me, that attorney not only would have no idea what I was talking about, but they would also not even be in the correct field of practice. After I paid for all phases, help died down immensely. It'll now take weeks before I hear back, only to be told I'll get another call back by a certain time and that call never comes. They were VERY quick to help while phases were still being paid for.I spent nearly almost 15k on what is so far incomplete, factitious and lackluster results."Medical Doctor **************** of Treatment Report".....the doctor they put me with said right off the bat, " I'm not interested in diagnosis'". However, that is the service I was told I would be getting. Mold and mycotoxin poisoning in itself is not a medical diagnosis; Mold Law Group must be keenly aware that it is not as simple as that, or they're company would likely not be as "needed". I brought this up and I was given a word salad response on why a diagnosis isn't needed. If it isn't....why is that mentioned verbatim in the phase document?I feel I paid (Immensely) for services that were promised and not received. The generic protocol sent by the doctor could've had severe negative affects to other mold related/induced illness I have since been tested for. I was passed on to someone named ******, who also made promises of calling, helping, offering resources...none of which transpired.

Dear Ms. ******************* you for sharing your feedback with us. We want to address your BBB complaint thoughtfully and with care.

On September 3, 2024, ****** ****, our Director of Client Strategies, reached out to you and your attorney via email to offer assistance. Since then, Mr. **** has not received a response from your attorney, and were uncertain about your representation in this matter. If you are represented, we kindly ask you to share your attorneys contact information so we can assist you effectively.

We also wanted to recap some recent communications. On September 6, we sent a doctors report to your email, which you opened. Following that, on September 16, we provided a questionnaire link, which you also accessed. On September 23, we emailed you a packout estimate that you reviewed.

On October 22, at 4:27 PM, we had an extensive discussion about how we can support your case, and we followed up with you on October 23 at 3:55 PM to address your concerns, including the details in your medical report. During that call, we reiterated our willingness to speak with your attorney. Despite our outreach via text and email on October 24 and 25, we have yet to hear back from you or your attorney.

We would like to address your statement: I was told many things about my possible case that Ive learned are not true. We encourage you or your attorney to reach out to us so we can clarify these concerns and provide any necessary information.

Additionally, our communication with the doctor assigned to your case indicates that she is awaiting correspondence from you. Its important that you contact her as soon as possible to keep the process moving smoothly.

Regarding your referral to an attorney, please note that the referral was for a complimentary real estate attorney specializing in landlord-tenant matters. While he may not be a personal injury attorney, he can assist with urgent issues related to potentially hazardous living conditions.

We truly want to help you navigate this situation, so we highly recommend reaching out to us or your attorney as soon as possible. Your well-being and satisfaction are our top priorities.

    Warm regards,

    Mold Case Consulting

    11/11/2024

    I reject this response.

Austin did send an email to the one attorney I was in correspondence with. However, I have since told two people, ***** and ****, at Mold Litigation that that attorney was not taking the case and provided the name of the firm who is taking my case.

You did not receive a reply from them because there is a lack of documentation, follow through and communication on your end. There are also too many hands in the pot and none of you seem to be communicating with one another.

I did get the doctor report, I never claimed not to. I reached out to the doctor ( *** ****) who you are in contract with twice about updating the timeline, discrepancies and misspellings but received no contact back. I can not submit such a poorly done document to my attorney.  I even messaged someone through chat asking them to tell *** **** that it had been sent, twice. The first time was September 24th, the second time was October 22nd and again on November 6th.

I did not receive and update from them until after this report was filed.

I have done the questionnaire twice. Whomever it is you outsource for those things is not relaying when they have been completed. If you are able to see something has been viewed than why are you unable to see how often I have opened and completed the questionnaire. It is extremely time consuming, so to have to do it multiple timeswhile ill, homeless and a single parent, is a system glitch on your end that needs to be rectified.

You sent the packout and it stated that you could add as many rooms as needed. However, the system you use would not allow me to add two more rooms. I contacted ***** in regard to this on September 23rd. He stated I should go back in and add the two rooms and a new estimate would be sent. That estimate was not corrected and if it was, I was not sent it. I called repeatedly in regard to this specific matter to no avail.

****** did reach out to me, but similar to *****, I was told Id get a call back in regard to the issues at hand but did not hear back from him until this complaint was submitted. In fact, suddenly, after filing this complaint, I have multiple people from your company reaching out to me, which I find odd seeing as how I went over a month hearing back from *****. Suddenly everyone is SUPER willing to offer follow up and follow through. I did receive multiple calls and a few emails from all of you (after the complaint) with a sense of urgency/annoyance in each message. I find that perplexing that you have not seemed to take into consideration that I am the paying client, and you seem unwilling/unable to schedule a time to speak that works for me as well, and not just you. Due to the wishy-washy nature of phone calls, lack of follow through and so many people now contacting me at once, I would like all further communication to be done via email and not by phone. I would prefer to be in contact with ONE person due to the lack of communication internally.

*We did have an extensive phone call. My complaint to BBB had been submitted one to two days prior to that phone call. It went live after we spoke. But it does seem to have ignited some sense of integrity and follow through. *

9/24 10:17 17 minutes said he would call me back, did not. I called again on 10/2 1:52, left a message

    10/7 1:26 Called ***** and left a message.

10/7 1:40- ***** finally returned my call from maybe the message left on 9/24. I asked again about the updated packout and timeline from *** ****.

***** called back on 10/7 at 1:40 . I asked yet again about the updated packout and updated timeline from the

10/11 10:08 am- Called *****, left a message about packout and updated timeline from *** ****.

10/22 12:13- Called ***** trying to get an answer on same issues, left message

I was passed to Austin who up until my complaint, did not reach back out for over 3 weeks.

At one point, it took a month for anyone to reply.

I sent a reply email to Austin on November 6th, but now...possibly because you thought the complaint was closed...I am not receiving replies.

I could get no or minimum correspondence until the complaint and have had an influx of calls ( when I have been in doctors appointments) and no emails or correspondence about speaking when it is convenient for both parties.

The referral was seemingly automated and not an approved referral. There is nothing complimentary about a referral that was not approved or acknowledged

by the other parties involved. This was not just one referral to someone who either wasnt in the correct field and/or had no connection or prior knowledge of your organization.

This organization seems to lack integrity, honesty, organization, follow through, transparency and honesty.

I am rejecting this response because:

On November 12th ******** ***** reached out to me via email. She said going forward that she would be the one to assist me. She wanted to speak to both myself andf my attorney on the phone. However, my attorney has nothing to do with the issues I have been asking them to rectify for over 2 months now. I replied back on November 15th. She replied back the same day and said she would follow up with me by the end of the day, she did not...a common reoccurring theme.

On November 18th, Natishca reached back out via email and stated she hoped to have an update by the end of the day. She did reach back out the same day and said she would be in touch the following day. It is now November 21st and no one has contacted me sense.
I am constantly being given the runaround with issues I'm repeatedly told will be rectified but never are. I no longer want to utilize the dishonest and unorgnaized "help" from the company I paid over 13k to use. I feel they are preying on people in bad situations and the lack of follow through has interfered with my life in multiple ways.

This year I payed mold law group ***** dollars to build a case due to mold in my apartment. When the day came to have the inspector come to my apartment she deemed the residence as untestable and canceled the appointment. I would like to note that she didnt even open her work briefcase or even open/used the test kit. When I called the next day and asked to follow up on the appointment that the inspector canceled to get my refund I was ignored. Furthermore they DID NOT provide any service whatsoever. I am looking for a refund of the ***** dollars via check that was wrongfully charged for a test kit that was never used. I should have looked closer at the BBB reviews because there are a few that warn you of this scam.

    Business response

    07/16/2024

These statements are not accurate. We have contacted the inspector and had numerous conversations regarding this inspection. None of our inspectors would willingly drive 4+ hours to a job and of their own volition decide not to process samples. Inspector is stating that they were turned away from the property. We offered to have a reinspection completed on your behalf which was denied. We are unable to process any refunds as this inspector was required to drive 4+ hours to do the job on a holiday and per all accounts was turned away. This is reinforced by your nondecision to allow us to send a new inspector to the property. We will always try and assist however possible but are unable to do so if we cannot get an inspector into the home.

    Complaint: 21995005

I am rejecting this response because:
What is stated is not true. There was no offer for a re-inspection. If this was true there would be proof of such offer. According to your response you have proved that there was no service offered, besides having someone come to the property. Furthermore I have proof that the inspection company had canceled the appointment due to their decision that I had included in the original message. Now, it shouldnt be my issue that this inspector drove 4 hours, thats the companys scheduling issue. Furthermore I dont know ANY company that charges 3k dollars for someone to show up and do nothing. I am willing to settle to cover that persons service, however, it will not be 3k dollars.

On May 24, 2024 I paid Mold Law Group $3,750 for services they promised but did not provide. I have requested a refund of 50% of the money as they did provide some services, but not all. They misrepresented themselves and made promises they did not keep. They attempt to strong are customers into using only their internal labs and tester's, even when labs and mold test are performed by other licensed and accredited companies. I have been told they do this to overcharge their customers.

Our records indicate that we have fulfilled the extent of the engagement letter initially signed. We see you signed on for Phase One of our process and we completed the environmental analysis, and subsequent Written Protocol per the engagement letter signed. Records also indicate that we were in the process of pairing you with one of our partnered attorneys and you elected to no longer utilize that service. I was misled by this company to believe that they were a law firm based on advertising, and paid a large fee towards them without seeing a contract or paperwork. They took payment without sending me this information. Upon reading the contract and doing more research I realized that they were not a law firm and requested a refund within 90 minutes of the original payment. I did not at any time receive services from this company, and they have refused to refund me through this time. Any and all communications I have sent have gone ignored, and unaddressed. They continue to email me to schedule services that again I have not received and do not have a need for, but they will not refund the payment. It has been over a month now with no real resolution and I cannot fathom spending $3250.00 for them to have done nothing. Their services would include consulting, urine tests, house tests, etc and I have done all of these things independently. I strongly feel taken advantage of.

    ******,

As soon as a client engages with our ********* services, we are required to pay our inspectors immediately in order to ensure they set aside the time to schedule with our clientele. Given the nature of the services we perform our clientele often only have a day or so to collect this evidence, in order to ensure we can move expediently as possible, the inspectors we partner with will often have to move already existing jobs to facilitate our clientele. We can reschedule the inspector originally chosen to come back out, but the services have already been paid for and a refund is unable to be processed at this time.

I am rejecting this response because:

    1) The inspection itself does not cost $3250 and I not only cancelled it with your company same day I called the company that was scheduled directly to cancel it same day. Their policy is a $50 cancellation fee. Even if I had received the inspection they charge $300 for. I further have not and do not wish to receive any of the other services listed on the invoice.

    2) I was previously offered a partial refund on 05/28/2024 of $2,000 when speaking to ****. He told he would try to get a larger refund because I had not received any services from the company and that I had been trying to get a refund since the day the payment was processed. He never followed back up and now I am being told no money is able to be refunded when nothing has changed between now and 05/28/2024.

    3) I have not received and do not wish to receive any services from this company. Every time I have reached out has been in an attempt to cancel services and there have now been multiple times where I get scheduled for "an appointment" to talk about this refund wherein I am not contacted or met for these appointments.

I am rejecting this response because:

Once again I did not and have not received services from this company. Further the contract was not even received until after payment and I did not know what I was consenting to at time of payment because the advertisements do not match the services provided.

Every step of the way when I call I have been told we'll look into this, we'll try to resolve this, we'll schedule a meeting with blank person. And then these meetings never come to fruition, no one reaches out to me, or attempts to resolve the situation.

I would consider this matter resolved if given the original promised refund of $2,000. I was told in the conversation on 05/28/2024 that I could receive this money but that the dispute charges would need to resolve before receiving a refund so why go back on this? It again does not sit well with me as I have not received any of the services invoiced and again called back within 90 minutes of the original payment to process and all I've attempted to do was cancel services from the beginning. But I am disabled, in need of the money, and have yet to see a humanizing interaction with this company. All that you care about is money.

I reached out to the law group, about the lawyer that was assigned to me. I called the lawyer 3 times and sent an email. I have a court case on Friday and I haven't heard anything from the lawyer and I was told to be patience with a case on June 21st. I have not got any service since I made a payment in April. Then to be told to be patience and I don't know how attorney work. So work when they get paid.

The Mold Law Group was supposed to get a mold kit to me prior a specific date and they told me they would ***** it to me. I advised if the kit didnt arrive by that specific date I requested it then the entire purchase would not be effective for what I needed it for, ******** reassured me that they were aware. The number provided for ***** tracking was bogus, it kept saying invalid. Then the mold test kit didnt arrive until ***** hours after the date. I called The Mold Law Group demanded a refund at this time I was instructed by ****** to send the kit back and that I would be refunded. I did as instructed and still no refund. They even went so far as to say they didnt receive the kit when I have proof from the **** of a signature. I requesting a prompt refund of ******

As stated by our Client Strategy Director, we are happy to issue a refund once the testing kit has been returned to us. There has been no delivery of the test kit to our office according to all records. Please provide us with the tracking information, and as stated once we have received the testing kit we are happy to issue the refund.
