After receiving a written estimate for some roofing repairs from ******************* which would total, in his words, no more than 2-men for 10 hours at $175 per hour. Lindholm proceeded to invoice us for 33 man hours. While the crew was working on the house, we found 3 men working on the job and immediately called *** to ask for an explanation, and if there had been the need for work to be completed beyond the scope of the estimate. *** never replied, and he never came out to the house to make such an assessment. Instead we were billed almost double what we had originally agreed on. We promptly paid the high end of what we had agreed in the estimate, and continued to give Lindholm the opportunity to explain to us why we owed them so much more money. Instead, we were ignored by both *** and **** the office worker, no explanation was ever provided. 7 months later, after continued efforts to get an explanation for the additional charges, one of the owners, ***, explained on the phone that *** had indeed made the mistake on the project, and that no additional work was completed beyond the scope of the estimate. He offered $75 off of the invoice. We were then threatened with a lien, and ultimately paid the difference to avoid a legal fight.

The customer agreed to a time and material proposal to perform work that was completed and not done to their satisfaction by another roofing company. We did a difficult job that required 3 men and scaffolding to do safely and to osha regulations. We provided a 575 discount to services rendered because the customer was not expecting the amount of time required to perform the work correctly. After 7 months the customer still refused to pay the balance owe, the owner of lindholm roofing *** lindholm spoke with *************** he agreed to take the final 75 off with the understanding the invoice would be paid that day. 2 weeks went by with no payment. We sent an email indicating we would place a lein on the property which we are legally allowed to do per out contract. The customer willing called in and gave a credit card to pay to 1700 balance to avoid a lein and lein fees. We will not be issuing any further discounts or refunds. Please close this case, work was performed, paid and there is nothing else Lindholm Roofing can do for the customer.

    Complaint: 21833214

I am rejecting this response because:

Unsurprisingly, this response reflects an egregious misrepresentation of the facts.

    1. I did not agree to anything with another roofing company, not sure where this made up fact is coming from.

    2. While I do recognize that 3-men were sent to the job, the attached email below shows the salesman, *******************, estimating that it would be a 2-person job. Now, especially if OHSA requires 3-men to ensure safety, then the business would be responsible for ensuring accuracy in their estimate for this requirement. This seems to be the biggest problem in the dispute. There are three possibilities in this scenario:

            (1) *** knew that he was going to have to send 3 people, but instead told us that he would send 2 so that the estimate would be lower, which would give himself a better shot at winning the business. He knew he would send 3, as per OHSA requirements, and would bill us accordingly. This be all accounts would be a blatant misrepresentation, which would constitute fraud.

           (2) *** is completely unaware of OSHA requirements and mistakenly quoted 2-men instead of 3-men. Perhaps it could be an honest mistake. When we alerted *** the first day of the job of our concern about the extra person working at our home. He did nothing to address our concern, or explain why there were 3-men instead of 2, as quoted. In this case, the incompetence of the sales person, and the Lindholm, was responsible for blatant misrepresentation.

          (3) Lindholm as a business organization is so disorganized that the communication between the sales team, the work crews, and the billing office utterly failed. Regardless the responsibility is on the business.

    3. I see the $575 is discounts differently. I see them as admissions that Lindholm screwed up. They thought they could appease use by offering marginal discounts rather than actually giving a genuine explanation for the excess billing. They knew that eventually, if they needed to, they could attempt to intimidate us with the threat of legal action, despite their fraudulent practices.

    4.  *** Lindholm did speak with my wife. She gave no such indication that we would pay the invoice that day. Rather *** Lindholm said he could take off $75 and send the invoice, to which my wife did not say she would be willing to pay.

    5. We did not call in after receiving the threats, this is another lie. Not sure why this company has so much trouble with basic facts.

I would like Lindholm to admit that they intentionally deceived us to win our business using an  OR they made egregious internal communication mistakes which led to the mistake in billing. These are the only two possibilities in this dispute.

In doing so a full refund for the excess billing beyond the estimate is reasonable recourse given the facts of the dispute.

    Sincerely,

    *****************

Attached is the signed contract dated 8/24/23 by *********************. The price line states $175 per hour per man plus material.  We are a family business in its 3rd generation. We do our best to provide quality service and be honest and help our customers. We recognize there could have been better communication and *** mentioned that to ***** on the phone. It is unfortunate that we will not be able to end this dispute with the consumers desired resolution.

We performed according to the signed contact. Lindholm roofing is seeking for the BBB to review documentation and close the case.

I am rejecting this response because you have still not address the issue in the dispute.

    I will simplify my question:

If OHSA requires 3 men to safely perform the job that your Project Manager, *******************, was estimating. Why did he only estimate 2 men for the job?

Please refer to ***'s email attached. Also refer to your earlier comment that 3-men were needed to satisfy OHSA safety requirements.

    Sincerely,

Hole in living room ceiling after roof work on 10/03/2023.For more than a month, I was told the company would fix the hole. On November 8th, I was told the "powers to be" had decided the hole was not their fault and was told I could deduct a $100 off of the invoice.I have not paid the company anything yet but believe it will cost more than a $100 to fix the hole. I would like to resolve this situation as soon as possible. I am more than willing to pay for the roof but I am not paying to repair the hole in the ceiling without an adjustment to the invoice. I have attached a more detailed complaint along with a text I received saying not to pay the bill and the company would fix the hole. I would appreciate any help in resolving this situation. As I do not believe anything Lindholm says, I believe an outside party's help is needed.

    Better Business Bureau:

    Hello -

Lindholm Roofing came out today and fixed the hole in my ceiling.   Thank you for your help in resolving this situation.  I am sending my payment to them by Fed Ex on November 30th.  I am not sure if I have to do anything else to show that my complaint was resolved but I wanted to let the BBB know right away that the hole was fixed.
