Federal Trade Commission vs General Motors Holdings, LLC
The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.


On January 16, 2025, the business entered into a Consent Agreement with the Federal Trade Commission (FTC). The Agreement settles allegations that General Motors Holdings LLC and OnStar, LLC failed to clearly disclose to consumers the types of information it collected through its Smart Driver feature and that it would be sold to third parties, including consumer reporting agencies (credit bureaus). 

The types of information collected and sold include precise geolocation and driving behavior data—such as hard braking, late night driving, and speeding. The consumer reporting agencies used this sensitive information to compile credit reports on consumers, which were used by insurance companies to determine eligibility and set rates. 

Under terms of the Assurance, the companies agreed to:

Not disclose covered driver data to consumer reporting agencies for five years from the date the order is entered.
Obtain affirmative express consent from consumers prior to collecting connected vehicle data, with some exceptions such as providing location data to emergency first responders.
Create a way for all U.S. consumers to request a copy of their data and seek its deletion.
Give consumers the ability to disable the collection of precise geolocation data from their vehicles if their vehicle has the necessary technology and provide a way for consumers to opt-out of the collection of geolocation and driver behavior data, with some limited exceptions.
