    On May 31, 2023, Danny Pagett came to our home and measured out backyard to discuss a black aluminum fence to be installed. He let us know that it would be installed within 3-4 weeks. We are still waiting on this. Each time I contact him, he has another excuse as to why we haven't heard from him. I wrote a check on May 31, 2023 for $3,614 which he cashed right away. I have contacted him multiple times, many times with no response. I contacted him today and asked for him to return my money and that I no longer felt comfortable using him for this. He responded back with " Can't sent aluminum back I told Ken the doctor game me to go ahead that I can go back next week to work just have to be a little easy". At this point, it's been almost 3 months of no shows and I just want to get my money back.

We paid over half the fence amount and the patio in full. We are now in contact with an attorney and plan to sue him for his actions.

    Problem:
    We have filed a complaint once already. This man has taken over $7,000 of ours and done nothing. We still have no fence and we only have a portion of our patio. He continuously gives excuses as to why he can’t come finish the work. He refuses to give us our money back.

    We hired Pagett’s Fencing to put up a 3 row ******** fence. We hired him on 9/21 with a finish date for 11/21. In this time there were roughly 2 hours of work, digging holes. In the following next 15 months they only dug a more holes, never brought any materials on-site, and did not return to finish the job. We made a payment for the materials. They have no show, no called on several occasions over the past 15 months when promising to finish the job. They have stopped returning our calls for requests of refund or our initial payment. I’m not stuck with 18 holes in the ground, and just hope and pray no one gets hurt in them. I need the refund to complete the job by another fence company, which I had to hire to put up a pasture fence up while waiting to hear from Pagett’s Fencing.

    On 10/12/2021, I hired Pagett's Fencing to build a paddock fence and yard fence for $7300. On 10/18, I paid $3650 (half) with an agreement to pay the rest on completion. It took multiple phone calls from me to get them to start the paddock, and by 12/3 it still wasn't complete. In addition, the materials used were inferior, the wire is not pulled tight, and the posts have not been set straight. I told the owner, Danny P., that I did not want him to build my yard fence and would like a refund for the amount that I paid over the cost of the paddock fence, which was $800 (see attached contract). He agreed and said that he had other customers cancelling jobs also. He told me there was a restock fee that I would have to pay of 15-20%, and that it would take 2-3 weeks to get my refund. By 12/24 (3 weeks later), I still didn't have a refund. I contacted ****** *****, the company that sold him the fence supplies, and was told their restock fee is 15%. With the $3650 I paid, less $800 for the paddock fence and the $427.50 restock fee (15% of the $2850 left after the paddock cost is subtracted), I should receive a refund of $2422.50. I have been calling and texting Mr. P. for the past 7 weeks asking about my refund. Several weeks ago, he told me his CPA was mailing out the checks for all of his customers who are seeking refunds. Apparently this is untrue, as no refund check has arrived. I told Mr. P. that I would like to resolve this issue between us, but that if I needed to pursue legal action I would. He then threatened to take me to court, saying that he should have charged me $1600 for the paddock. I want to resolve this issue as peacefully as possible. The contract states that "all work [is] to be completed in a workman like manner according to standard practices." Compared to the fence builders I've hired at my other properties, this work is clearly subpar. Mr P. has not been forthcoming with a refund and is now refusing to return my phone calls.
