I attended their Timeshare event where a $100 visa gift card was offered. I was given a Visa gift card. That Visa has a balance of $0 and never received any funds; I was told it would have received the funds within 24 hours. I contacted them and received no response. They are scammers.

We have spoken with this client, verified the issue with the card given to him, and replaced the $100 gift card. A $100 Visa gift card was emailed to him. Please let us know if you need any other information to resolve this.

The information in this complaint is not correct. Our contract (attached) clearly states on the third page that Encore Law has 18 months to complete the Release of Ownership. The copies of the client's contract with their Timeshare can easily be obtained from the client's Timeshare Resort if they no longer have the copies of it that were sent home with them when they first purchased the Timeshare. We are trying to reach this client to better understand what her complaint is regarding because it seems based on her complaint that the Release of Ownerships have been completed. Please let us know if you need any other information regarding this complaint.

    Business response

    10/28/2024

The issue with the BBB's website over the last few days has delayed this response. The timeframe in our contract for a release of ownership is 18 months, not 6-9 months. Our contract states that if the release of ownership is not completed within the 18 months, Encore Law will be responsible for all maintenance fee payments on that property until the release of ownership is completed. This client's properties were released. Please let us know if there is any other information needed to resolve this issue.

I received a flyer for an exclusive dinner event in Naples, Florida. The flyer had my address but had my fathers name. My father has been dead for 21 years and never lived at my address in Florida. I think this is a scam. And I’m just curious how they got that information. I called the number and they said encore law was the people that were putting this on. The brochure has were in business for 16 years and they were recommended by you The Better Business Bureau with an A+ rating. I guess if they’re using dead people, they would have an A+ reading wouldn’t they.

Our mailed invitations are sent out to Timeshare owners based on the publicly available owner information at the county recorder's office. The address this invitation was mailed to is the address listed in that publicly available information from the County Recorder's office. We have now removed this person's information from our database due to her request to not be contacted.

Our recommendation to this person is to contact her father's resort because his timeshare deed was most likely transferred to her, as that is the only way our company would have obtained her address information. Although this person decided to lodge a complaint regarding our invitation, we are willing and able to help her be released from that Timeshare Ownership if she needs our assistance and contacts our office.

We were trying to exit our timeshare. My health at 80 is deteriorating and I am not able to travel anymore. We were contacted by Encore Law and invited to a meeting. At the meeting we were pressured and coerced into agreeing to pay them a fee for exiting the timeshare. We feel we were misled and lied to. There was a clause in their agreement that stated it could be rescinded within 4 days but they never told us about it. They are now threatening to send us to collection if we don’t honor the contract. We have told them we want to cancel the contract, but they have been very stubborn about enforcing it.

    Business response

    09/10/2024

Our staff met with this client on 8/7/24. Our staff completed a verification call from our corporate office with both of them on 8/8/24, where all property information and fees were explained to them in detail. The rescission period is listed on numerous contract documents (attached) and copies of all contract documents were sent home with the clients. There is also a promissory note that the client signed regarding paying the fee for the Release of Ownership for their two timeshare ownerships.

After speaking to the client and due to their age and the lack of funding, our company has agreed to fully cancel out their contract. Please let us know if you need any other information to resolve this issue.

My wife and I attended a seminar in Jacksonville at the Hyatt Place hotel on July 10, 2024 at 3 PM. As compensation for attending this presentation we were promised a $100 pre-paid Visa card. We sat through the whole presentation. When we were checking out, the young man at the computer said that he had accidently left all the gift cards at the airport when he arrived in Jacksonville. I knew that this sounded very suspicious, thinking to myself that we had just been scammed out of the gift card. The young man however took all our information (name, address and phone number) and promised to have a card sent to us. Needless to say, I have yet to receive any gift card. I have called the Encore Law office in Knoxville several times. Each time the answering service promises to have someone call me back. I'm still waiting for a return phone to address the issue. All I want is to receive what we were promised…a $100 pre-paid Visa gift card.

The issue with the Gift Cards at the meeting was valid. Our staff will email this guest another $100 Visa Gift Card to resolve this issue. Please let us know if you need anything else to address this issue.

On 6/24/2024 at noon I attended a presentation by Encore Law. The first young man I met with gave me the piece of paper I've attached. Notice that there are no addresses or phone numbers on their letterhead. The card they sent in the mail also promised to help you get back "100% of your timeshare's purchase price", which they also did not do. It is all about spending money with them. The presentation was very much like a timeshare presentation, with the first hour spent rapport building with the presenter. I don't remember his name but he wore a blue suit, no socks and what looked like alligator shoes. Attendees were promised $100 cash at the end of the presentation, I did not receive this. We were also provided "lunch" which was very cold food from OliveGarden. I threw most of what I took away because it was inedible. The presenter ended up being the person who was my one on one after the presentation. I had a couple of questions. His tone took a different turn once I asked about the cost of assisting with getting out of a timeshare, which he estimated to be $3900-4100 per week deeded. His pitch became high pressure and I told him I felt that his language was too high pressure, to which he called me "stupid" and said that I could take my attitude about my timeshare value and said even if I hadn't already said I wasn't ready to make a commitment he would not accept me as a client because I was "too stupid". He was very abusive and I'm surprised none of the other people there said anything. I quietly gathered my things and left while he was still insulting me. He seemed like he was either coked up or on meth because his face was redder and redder and his eyes were very glassy. This from a man who claims to be a "church goer" and "never smoked weed in his life". I spent a total of two hours there. The only reason I still have the mailer is because I didn't bring it with me, which they tell you to do, hiding evidence.

We have spoken to this guest and explained that she would have received the gift card when she was checked out of the meeting. The guest left before that point, which is the only reason why she did not receive the gift card. Due to her being upset about the meeting, we have mailed her two gift cards to her home address. Please let us know if you need any other information to address this issue.

After entering into a contract with Encore Law to terminate my timeshare. I had a lack of communication with the person who I interfaced with and other issues that resulted with me not being able to read the contract completely. As a result, when I decided to cancel the contract, I was told that I was beyond the period of time to cancel to get my money refunded. My request is to have my money refunded, because no service was provided.

Our release department has been in contact with this client and is prepared and ready to complete the Release of Ownership for him once this is resolved. Our Customer Care staff has also spoken to this client, and explained that a client changing their mind regarding being released from their deeded ownership is not a valid reason for a full refund. The client received copies of all contract documents as they were completed through DocuSign and were emailed directly to the client. Please let us know if you need anything else from our company to address this issue.

    Business response

    08/05/2024

Our contract documents clearly show that there is a 3-Day rescission period. This client's reference to text messages he sent, were texted to a land line and were never received. These are not valid reasons for a full refund.

Encore Law will fulfill our contractual obligation and complete the Release of Ownership for his deeded timeshare ownership, once this issue is resolved. Our staff will also send the client the requested $100 Gas Voucher. Please let us know if you need anything else to address this issue.

On March 7, 2024, Encore Law charged me $8731.76 to get me out of my Diamond Resorts timeshare obligations. I informed them that I haven't had any contact with Diamond in years, not even invoices. I just wanted to eliminate the timeshare obligation. I was instructed not to contact Diamond Resorts directly. I was provided a termination agreement breakdown of the cost as follows: $6482.76 liquidation, $1800 transfer fee, $449 transfer fee. At the end of May, Client Services, Encore Law instructed me to write Diamond a letter informing them why I wanted out of my timeshare obligation. Client services reviewed and reformatted my letter (5/31/24), then had me send it to Diamond. On June 8, I received a surprised letter from Diamond informing me that my timeshare membership had been cancelled as of 4/7/2015 due to foreclosure. I had never been contacted by Diamond, so I was unaware of a foreclosure process. I forwarded the response to Encore Client Services, and informed them that I wouldn't be needing their services after all. On 6/11/24, I requested a refund minus any expenses (for the time spent on my letter) although none of the itemized expenses listed above were actually implemented. After Encore's reluctance to issue a refund, (6/14/24) I requested an itemized account of expenses charged to my account. To date, this has not been provided. Client Services later stated that senior management would have a fair and amicable proposal/resolution by weeks end. It has been weeks with no response from Encore Law. I am requesting your assistance in not only retrieving the $8731 spent on a service that was not provided, but to investigate the legitimacy of this practice. Any assistance or recommendations will be greatly appreciated. Thank you,

Our staff has contacted this client to inform him that Encore Law has agreed to a refund of the remaining funds above and beyond what was expended to date. The partial refund amount is $4,731.76, and this offer was emailed to the client. We are waiting on his response.

    Business response

    07/31/2024

Our contract does not stipulate that a cost breakdown is required to be sent to a client that stopped the Release process after it has begun. There are numerous fees associated with a Release of Ownership, including document fees, drafting fees, retainers, and our man hours. Our offer of a partial refund of $4,731.76 remains available to the client. Please let us know if you need anything else regarding this issue.

Although, BBB has closed this file, please be advised that on 8/2/2024 I responded to BBB's July 31 complaint update.  Based on my response to BBB, Encore Law contacted me by phone an hour later and stated that they had decided to provide me a FULL refund.  An email confirmation with terms of the agreement was to follow by the 8/5/2024.  On 8/8/2024, I left a message with Encore Client Services concerning their failure to provide the email agreement confirmation.  As of today (8/12/2024), there has been no response from Encore Law.

I respectfully request that this information be added to your file.

we contracted with ******* ********** to terminate our timeshare. we were assured this was a simple matter. we were assured the time frame would be a few months-at the most. it has been almost one year. not only have we had to pay additional fees to the time share holding company of almost one thousand dollars, we are no closer to completing the transaction. we have made numerous phone calls and sent emails with no response. over and over we have tried to obtain a resolution.

    Business response

    05/28/2024

Our staff has spoken with Mrs ******** to resolve this issue. We met with Mrs ******** on 8/3/23 and our documents allow us 18 months to complete the release of ownership, and if the release of ownership is not completed within the 18 months, our company will pay all maintenance fees until the release of ownership is completed.

Due to Mrs ********** understanding of what was said to her verbally at our meeting regarding the typical completion time, our company agreed to reimburse Mrs ******** for her recent maintenance fee payment. She has agreed to move forward with the release process and remove this complaint once she receives the reimbursement check.

    Business response

    06/19/2024

The reimbursement check was mailed to the client, as agreed upon. The client has the necessary documents that our Release department sent to them, and the client needs to complete those documents and return them to the release department. Also, the client has the direct number for our release department, and there is a link in every Release Department email to schedule a call with the Release Department.

The client agreed to drop the complaint once they received the reimbursement check, but the complaint has not been dropped. The release process will resume once this issue is resolved and the complaint is dropped.

Please let us know if there is any other information you need to resolve this issue.
