    Our records indicate that the account was opened with an electronic application.
    Subsequently, the account was used for purchases and payments were applied to the
    balance. Due to non-payment, the account charged off with an outstanding balance. Please
    note that we have no record of prior correspondence requesting a copy of the application.
    Upon receipt of the customer’s complaint, an investigation was conducted regarding their
    claim of identity theft. Based on our investigation, the claim was denied as the account
    information matches their personal records.
    The Fair Credit Reporting Act (“FCRA”) requires that, as a furnisher of information to
    consumer reporting agencies, we report accurate information regarding a consumer’s
    account history. We have reviewed the account and determined that the information reported
    was complete and accurate as of the date(s) we furnished it. As such, in the absence of
    additional facts, we will not change the reporting of the account to the consumer reporting
    agencies.

    I had gotten a new bank account in September of 2024, I forgot to reset up autopay causing me to miss Octobers payment, on October 10th I made a payment of $50 towards me $110 min payment due and set up the autopay to take the remaining $60 and continue making the min payment each month moving forward, when setting up autopay it does not disclose that it will still be pulling out the full $110 due for the next due date. Thus causing that payment to return and fall past due again, causing this issue to come back up in December, they attempted to pull $141 which returned as well, causing an additional late fee. I called today 1/10/2025 and explained what caused the account to fall behind and that it was due to lack of disclosures upon autopay enrollment and request the late fees for November and December to be waived since I have now made a payment of $224 towards bring the account current. When speaking with one agent she waived one of the fees, I spoke to a supervisor for the second who was zero help at all. Stated they would submit it for review and they do not have the ability to make any exceptions due to this lack of information. This is ridiculous. What is the point of supervisors if they cannot make any decisions when it comes to fee waivers based on the situation? I have otherwise been on time each month and would appreciate both fees to be waived.

    Our records indicate that the customer set up a new recurring payment schedule to withdraw
    the minimum payment as shown on their last billing statement. The first recurring payment
    was returned due to insufficient funds, thus increasing their subsequent minimum payment
    amount.
    As advised during the enrollment process, we offer options for recurring payments of either
    the last statement balance or the minimum payment as shown on the last statement. Please
    note that these recurring payments continue to process as scheduled, even if a customer
    makes additional payments in that billing period, unless they cancel the pending payment. As
    such, while the customer made a one-time payment, their recurring payment processed for
    the minimum payment on their statement and was returned due to insufficient funds. Their
    following payment was also returned for this same reason. As a result, fees were assessed,
    the account became past due and was reported as such to the consumer reporting agencies.
    As this delinquency is accurate, it will not be removed.
    The customer recently contacted us to request fee waivers. The representative waived one
    late fee as a courtesy and transferred the call to a supervisor for further assistance. While we
    regret any dissatisfaction, as the second waiver requested was outside of policy, it required
    additional review. The supervisor submitted the customers request, which was approved
    later that same day, and both waivers will appear on their next statement.

    Our records indicate that this account was opened and used for purchases but no payments
    were received. The account charged off due to non-payment with an outstanding balance.
    We received prior correspondence from the complainant advising that this account was a
    result of identity theft. An investigation was conducted but denied based on the information
    on file that linked to the complainant. As these letters claimed identity theft, they were
    handled via our fraud investigation process, which does not include sending validation
    documents. We apologize for the inconvenience this caused.
    Upon receipt of the BBB complaint, we completed a new investigation for identity theft, and
    the claim was accepted. As such, the complainant is not responsible for repayment of the
    balance, and we requested that the consumer reporting agencies delete the tradeline
    associated with this account from their personal credit file.

    This account is enrolled in a recurring payment schedule, and we have received monthly
    payments keeping the account current.
    Finance charges on purchases are assessed each month that the balance is not paid in full
    by the due date even if the card has not been used for new charges within that billing period
    as per the cardholder agreement.
    We confirmed that the Annual Percentage Rate (APR) was correctly established in
    accordance with the terms and conditions of the account. The initial APR for purchases and
    cash advances were fully disclosed in our initial offer of credit and again when the credit card
    was received. Additionally, the interest rate is variable and will adjust accordingly with
    fluctuations in the Prime Rate.
    Please note that this complaint was submitted by a third party and for the security of the
    account, we can only disclose account details to the primary cardholder. A response was
    sent to the cardholder with further information.

    I had a paid off Credit Card with Merrick Bank, with a $1,000 Limit in which I had paid and asked to be closed. I had to make many calls to this company with little to no luck of getting someone to get on the call without being disconnected. Fast forward a month later early in 2024 I get a statement with charges exceeding my line with fraud charges I never charged. I called and after again many attempts I explained the senerio they were not my charges and I would not be paying. There is no where on there site to do this so I had to call. It took me two days of calling just to get through to them. I was basically brushed off as no one would ever get back to me and now I am being harrassed by ********************** stating I am being sued for $2000 for them selling this bad debt to a collection company. How is this even right and why should I have to pay for fraud charges they did not handle correctly.

    the balance being paid in full or of a prior closure request. The card was used for new
    purchases following the last payment and we attempted to contact the customer to verify if
    these charges were fraudulent. The customer contacted us in response to these notifications.
    Their calls were transferred to the department that could assist but were then disconnected.
    We thank the customer for their patience and apologize for the long hold times as we
    continue to assist all of our customers. We have no record of any more recent calls with
    Merrick Bank, as indicated in the complaint.
    Due to non-payment, the account was then closed and charged off. Please be advised that
    at charge off, CW ******************************** I became the owner of the account.
    ********************** is no longer servicing the account and is unable to adjust the balance or
    provide details regarding any collection attempts post charge off. If the customer believes
    that any charges are fraudulent or if they have concerns regarding the collection efforts on

    Merrick credit card would not take off a fraud charge years ago. They closed my account because I refused to pay for the fraud charge. I told them I would pay for what I charged, but Not the fraud. They denied it. They have not contacted me in years & all of a sudden, this awful bank put a charge off on 2 of the credit bureaus without notifying me first, which is the law. I had an attorney to write a letter about the 2 credit bureaus. (Certified mail). Once they got the letter, they then put the charge off on the 3rd credit bureau without any ***************** score went down 22 points. These people are evil. I will have to get the attorney send them another letter. I see a law suit coming up if they do not take the charge off from all 3 credit bureaus. I would never use Merrick Credit cards if I were you. I learned the hard way. They do not take fraud charges off. DON'T trust them.
