This account is enrolled in a recurring payment schedule, and we have received monthly
payments keeping the account current.
Finance charges on purchases are assessed each month that the balance is not paid in full
by the due date even if the card has not been used for new charges within that billing period
as per the cardholder agreement.
We confirmed that the Annual Percentage Rate (APR) was correctly established in
accordance with the terms and conditions of the account. The initial APR for purchases and
cash advances were fully disclosed in our initial offer of credit and again when the credit card
was received. Additionally, the interest rate is variable and will adjust accordingly with
fluctuations in the Prime Rate.
Please note that this complaint was submitted by a third party and for the security of the
account, we can only disclose account details to the primary cardholder. A response was
sent to the cardholder with further information.Initial Complaint

I had a paid off Credit Card with Merrick Bank, with a $1,000 Limit in which I had paid and asked to be closed. I had to make many calls to this company with little to no luck of getting someone to get on the call without being disconnected. Fast forward a month later early in 2024 I get a statement with charges exceeding my line with fraud charges I never charged. I called and after again many attempts I explained the senerio they were not my charges and I would not be paying. There is no where on there site to do this so I had to call. It took me two days of calling just to get through to them. I was basically brushed off as no one would ever get back to me and now I am being harrassed by ********************** stating I am being sued for $2000 for them selling this bad debt to a collection company. How is this even right and why should I have to pay for fraud charges they did not handle correctly.Business response

Our records indicate that this account was opened with Merrick Bank. We have no record of
the balance being paid in full or of a prior closure request. The card was used for new
purchases following the last payment and we attempted to contact the customer to verify if
these charges were fraudulent. The customer contacted us in response to these notifications.
Their calls were transferred to the department that could assist but were then disconnected.
We thank the customer for their patience and apologize for the long hold times as we
continue to assist all of our customers. We have no record of any more recent calls with
Merrick Bank, as indicated in the complaint.
Due to non-payment, the account was then closed and charged off. Please be advised that
at charge off, CW ******************************** I became the owner of the account.
********************** is no longer servicing the account and is unable to adjust the balance or
provide details regarding any collection attempts post charge off. If the customer believes
that any charges are fraudulent or if they have concerns regarding the collection efforts on
the account, they may contact CW ******************************** I directly at P.O. Box

Merrick credit card would not take off a fraud charge years ago. They closed my account because I refused to pay for the fraud charge. I told them I would pay for what I charged, but Not the fraud. They denied it. They have not contacted me in years & all of a sudden, this awful bank put a charge off on 2 of the credit bureaus without notifying me first, which is the law. I had an attorney to write a letter about the 2 credit bureaus. (Certified mail). Once they got the letter, they then put the charge off on the 3rd credit bureau without any ***************** score went down 22 points. These people are evil. I will have to get the attorney send them another letter. I see a law suit coming up if they do not take the charge off from all 3 credit bureaus. I would never use Merrick Credit cards if I were you. I learned the hard way. They do not take fraud charges off. DON'T trust them.Business response

Our records indicate that the customer's dispute of rental transactions for incorrectly billed
amounts was twice denied due to lack of evidence in support of a billing error. The account
subsequently charged off for non-payment. A statement reflecting the charge-off was issued
to the customer and the charge-off was reported to the consumer reporting agencies on the
same date. The reporting of the account was previously verified in response to indirect
disputes submitted to the consumer reporting agencies. The customer's dispute remains
denied; in the absence of additional facts, we will not change the reporting of the account to
the consumer reporting agencies.

On December 15th 2024 I made a payment of $35. I received the email about a week later stating that the money had been returned because my account was closed. My bank account was never closed and I never received a refund and now I'm being harassed with phone calls saying that if I make a payment then I would be able to use my Merrick Bank account again because at the moment is suspended.I made my payment on time and I feel like this is something that is legally wrong and I feel like they can do it whenever they want and I will be going through this issue again.Business response

Our records indicate that we received the customers payment; however, it was returned
unpaid by their financial institution. As no valid payment was received by their due date, the
account was accurately assessed a late fee, and their payment account was deactivated.
Late fees are assessed when payments equaling or exceeding the minimum amount due are
not received by the payment due date.
As a result of the returned payment, the account became past due and outbound calls were
placed in an effort to assist the customer with bringing the account current. Please be
assured that these calls were made in accordance with applicable laws. We recommend that
the customer contact their ******************** institution for additional information regarding the
returned payment, as Merrick Bank did not receive the funds.
The customer called and spoke to multiple representatives regarding their payment. The
representatives advised that the payment was returned by their financial institution and the
payment account was deactivated. In addition, they were advised that their Merrick Bank
account remained open and to contact their financial institution regarding the payment, as
Merrick Bank did not have possession of the payment, as it was never received.
Upon further review, we determined that during a call, the customer requested no further
telephone communication; however, the representative failed to update their account. We
apologize for the inconvenience this may have caused. Please note that we require an active
phone number on the account. As per section 22 of the Cardholder Agreement, You agree
that we may refuse to authorize Purchases or Cash Advances or close your Account if we
are unable or unauthorized to contact you by telephone.
As a courtesy, we waived the $29.00 late fee, which will be reflected in their next monthly
billing statement.

Our records indicate that the customer's account was closed due to a high risk of returned
payments and fees were assessed for returned and missing payments in accordance with
their cardholder agreement. Monthly installments of the customer's annual fee will continue
to assess while the account maintains a balance. The balance remains owed and the
account is currently past due.
