    A Brooks Pest Control sales representative knocked on my door and sold me a monthly service subscription. When going over the details, the rep asked me to sign his tablet without allowing me to review what I was agreeing to. He also failed to mention that canceling the service would incur a $250 cancellation fee. After several months, the pest problem not only persisted but worsened, and whatever they were spraying killed my grass. I called to cancel the service, only to be informed of the $250 cancellation fee. When I questioned why this fee wasn’t disclosed upfront, they claimed I had signed a contract and that I was provided with a copy. However, I didn’t receive a copy of the contract until after I signed, and the rep never disclosed the cancellation terms or allowed me to review the contract on his tablet before signing. Now, they’ve sent me to collections for the cancellation fee. I believe this is unfair as the terms were not disclosed, and I was not given the opportunity to review the contract before signing. I am requesting that they remove me from collections and waive the cancellation fee due to their lack of transparency and failure to provide the contract in advance.

    To Whom It May Concern: I am writing to formally dispute any alleged agreement or obligation with Brooks Pests Control, as I have never signed or consented to any contract. The facts of this matter are as follows: 1. An individual identifying himself as “Steve” knocked on my door and offered pest control services for a stated fee of $79. I agreed to the service, and my card was charged accordingly. However, no service was ever performed. 2. Subsequently, I discovered an unauthorized charge of $45 on my account. I immediately contacted Brooks Pests Control, requested a refund, and explicitly instructed that no further charges be made to my account. Despite this, my requests were ignored. 3. Brooks Pests Control has now demanded payment of $563, claiming I owe this amount. Furthermore, I have been subjected to repeated emails, letters, texts, and other forms of communication threatening to send this alleged debt to collections. The actions of Brooks Pests Control, including unauthorized charges, failure to provide agreed-upon services, and harassment through excessive communication, constitute violations of California law, including: • California Civil Code § 1710 (fraudulent misrepresentation), • California Civil Code § 1761 et seq. (violations of the Consumer Legal Remedies Act), and • California Business and Professions Code § 17200 (unfair or deceptive business practices). Additionally, this harassment may violate the California Rosenthal Fair Debt Collection Practices Act (RFDCPA) under Civil Code § 1788, which prohibits abusive or deceptive debt collection practices.

    Started service May 2024. Promised a service every other month. Received my first service just fine and they got rid of my pests. I was supposed to have a service in June and I was charged. They forgot about me and I had to call and get a service in July. They did not send me a text or reminders telling me of my upcoming service. Someone called me at 8am in September saying they were there to treat my home and they would not treat because the doors weren’t unlocked and no one was home. I called the buisness and asked to cancel because i have paid $500 for two pest control services and they keep forgetting about me/not communicating when they are coming. The man I spoke to on the phone was yelling at me and interrupting me every time I spoke and told me if I wanted to cancel, due to their negligence they would charge me $250. I asked to speak to someone else and he told me he was the only person that would handle my issue and so I hung up and called customer service back to speak to another associate. He then called me 6 times and left me a voicemail letting me know he would charge me cause I hung up “for no reason” and “that’s what was gonna happen”. I requested 4 separate times to speak to a manager about the situation and no one reached out. He proceeded to charge me, even tho they set me up for another service and I agreed to continue cause I didn’t want to pay $250 to cancel and I would deal with it. They again on October 10 did not send me a reminder text and someone showed up not able to treat the back of my home but agreed to treat the front and said they would return to treat the back on another day. It is November 27 and I have not had any other treatments. They are taking peoples money and not providing promised services or good customer service. I have voicemail but can not attach.     I hire Brooks to control rats. They set traps an never came back to take rotting rats out or reset traps. I cancelled them because they are not performing the service i pai for. Now, they are charging me a lot for cancelling. I called them to try to work things out an di only got threats.

    6/26/24 was the day the company representative told me I could cancel at anytime free of charge. I paid $79 for 1 month of service. Post cancelation date, the company has been wrongfully charging $45 each month from my account. The business has not tried to resolve it. I spoke with a representative named Asher who threatened to charge my card for a service that was supposed to be canceled after the first month. I am currently in the process of moving and they said that once I receive the lease, to show them proof for cancelation. On the phone in a recorded conversation per company line, Asher stated that he would charge us over $200 to cancel the subscription that never existed. I stated, do not charge or cancel me with penalty, and he repeatedly threatened he was going to do so. He went on saying he is the boss and there is no one else above him to speak with. There was a lot of turmoil, lies, and fraud in the contract and conversations with this company. You can see in the contract that it was altered post signature. I signed for only a month to cancel and they changed the wording which is a considered invalid and not legally binding. Please assist to make this right. I did not sign an annual contract and I was being given incorrect information. As the company representatives have ensured me, I would like to cancel without penalty, as promised. Also, I would like for Asher to be given corrective action for his failure to provide quality customer service.

    On Thursday 9/12, a technician was sent to my house to perform a pest control service. He was here 16 minutes, and talked on his phone to a friend the entire time, not focusing on his task. My cameras showed him walking talking and stealing my water to fill his pest control tanks. I wasn’t informed he was coming out, I only knew because my cameras alerted me, then I got billed $162.38. I reached out to them to complain about the poor service. I told them I no longer wanted to use them because they stole water from me, performed a very poor job of providing pest control, didn’t removing webbing on my house and walked around aimlessly on camera. They wanted to send a different tech out when I am home. I told them I don’t have time to watch them do their job, I pay them for a service that they aren’t providing adequately and it’s not my responsibility to watch them perform it. I told the to cancel the services moving forwards. They then charged me a $200 cancellation fee. I can understand that if I failed to keep up my end, but THEY failed, charged me the fee, then a cancellation fee. This is theft. They don’t provide good service, then charge me for the service and to cancel subpar services.

    The sales rep came to my door on 8/7/2024 to solicit business, and then he proceeded to lie and deceive regarding the safety of the products they use. They use carcinogens in all 3 products they applied to my property and food garden area. Boston repeatedly reassured me that essential oils are used -- and that nothing harmful is used. I repeatedly expressed that I didn't want any product used that would be harmful to the garden insects, birds or reptiles -- or humans Boston repeatedly assured me none such would be used. He only spoke of essential oils and non harmful solutions. They charged a $251 fee to cancel the contract despite the lies of their salesperson. They will not refund the $55 for services not yet performed. I paid $99 for the initial service. From my conversations with customer service and the manager, it is clear that they have zero concern for the deceptive lies of their salesperson. I request a refund of the $55 for services not rendered and for the $255 cancellation fee.

    Date of issue July 26,2024 Michael W******* came to treat home for rats. He looked at the interior and said there was nothing he could do because of the condition of the house. He gave us his personal phone number to offer to come on his own to help clear the house. He left us with 4 traps. Originally I paid $72. I had to sign a contract for him to do anything. Nothing was said about a long-term contract nor about a cancellation fee. I called to cancel and have been unsuccessful. My account manger threatened me that if I hung up on him, he would send it to a collection agency. Nothing has been done for treatment of the issue with the rats. Strangely, the account manager/representative had no reaction to the tech offering to bring his family to clean our house "on the side".

    9/5 first contact with company, spoke to Ashton. I told him my concern was that we had a party on 9/14 and were looking for results by then. He promised we would see results in a week and we agreed to sign up. Ashton assured me mosquitos and flies would be part of our service. 9/6 Tech showed up and told us the problem would be worse in a week, we refused service at this time 9/6 Called and spoke to Josiah, he admitted Ashton lied and said they would come out and perform the service and then come again Friday 9/13 to clean up and redo service to make sure it was good for the party. He noted that flies and mosquitoes were not part of our package and they would need to be added. 9/6 received service by Joshua 9/11 Called customer service to schedule follow up service and was told that wasn’t possible, call was transferred to an account manager and they were able to schedule it for Friday, noted flies and mosquitoes were an issue and I was told they would address it then with fly bait. 9/13 Frank showed up for service. I requested the fly bait they promised. He said he was new and didn’t know what that was. 9/13 I called customer service to request the fly bait, phoebe answered and told me I made up ‘fly bait’ and refused to transfer the call to an account manager. 9/13 I called back and spoke to Danica, she transferred the call to Carson, he said they would send someone between 3-5 that day with the fly bait and mosquito boxes since that was still a concern. No one showed up. 9/16 Called customer service to cancel our contract with no consequence given their continued lack of service. Jorge explained that all the agents I spoke to were new and that’s why I got wrong information and continued to make excuses. He Asked for another chance however I refused given my on going attempt to give them chances. He refused my attempt to speak to his higher up. Immediately after the call I was charged a $225 cancellation fee. Requesting $225 fee be refunded

    August 6th, 2024 I signed up for Brooks Pest Control service after being lied to about the actual cost. Last week I emailed Brooks wanting to cancel my service / contract as what I am being charged for the service is not what I was led to believe when signing up. I was told I needed to call in and speak with a manager, which I did yesterday. He listened to the video recorded when I signed up and said it was clear to him of what I signed up for. He sent me the recording to listen to and it is absolutely not clear at all. The wording is very manipulative. The recording states "your initial service was discounted from $399 to $99 and your monthly bill is $33 starting in 30 days. Services will be performed quarterly and this is a 12 month agreement." After being told repeatedly by the salesman that all I would be paying for is the service of $99 broken up into three payments, with the employee coming out three times to spray over the next year, it was clear to me that it was only the initial service fee I was paying for, broken up into three payments. The sales man assured me multiple times there were no other fees. I told the manager yesterday that no where on the contract was there a total cost for the service, or that I am expected to pay hundreds in total. I was told by him that it wasn't a very good sales tactic if they did that. That made it clear to me that I was lied to and manipulated. After the phone call where I was told there was nothing he could do. I gave a negative google business review. The company reached out to me and told me to reach back out to get this handled. I did today and was told, again, that there was nothing that could be done. I was led to believe I would pay 99 dollars. What I will end up paying is 495 dollars. All I want is the contract terminated free of charge.
