On June 28th, 2023 the business entered into an agreement with the Division of Occupational and Professional Licensing. The Assurance settles allegations that the business engaged in unprofessional conduct when it failed to respond to a Division audit letter. Under terms of the Assurance, the business's license was revoked. The Assurance was for settlement purposes only and should not be considered as an admission of guilt or a finding of violation of the law. - Pending Government Action:Government Action: BBB reports on known government actions involving business’ marketplace conduct:Division of Consumer Protection Complaint
The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On March 1, 2022, Utah Division of Consumer Protection (the Division) filed a Complaint against Avolta Power, Inc. and Bello Solar Energy, LLC for failure to comply with an administrative subpoena issued on November 22, 2021. The subpoena seeks "a copy of each version of any contract(s) used to sell residential solar systems to consumers from January 1, 2020 to the present date, and un unredacted copy of each contract for any consumer who canceled the contract described above. The subpoena further requested the businesses to identify whether the consumer was charged a cancellation fee; if so, the amount of the fee and how much of the fee the consumer paid; and any consumers whose accounts were sent to collections as a result of non-payment by the consumer of the cancellation fee.
The Division asks the Court to enter a declaratory judgment that these businesses are in contempt for failure to comply with the Subpoena and order them to show cause why they should not be compelled to appear and comply with the subpoena.
